SCTM#1000-81-1-10.1 The proposed action has been reviewed to Chapter 268, Waterfront Consistency Review of the Town of Southold Town Code and the Local Waterfront Revitalization Program (LWRP) Policy Standards. Based upon the information provided on the LWRP Consistency Assessment Form submitted to this department, as well as the records available to me, it is my determination that the proposed action is INCONSISTENT with the below listed LWRP polices and therefore INCONSISTENT with the LWRP: Policy 1. "Foster a pattern of development in the Town of Southold that enhances community character, preserves open space, makes efficient use of infrastructure, makes beneficial use of a coastal location, and minimizes adverse effects of development." 1. The lots were merged in accordance with the Town's merger law to prevent higher density of single family residences in sensitive areas of the Town. The existing lot is waterfront and located on a boat basin connected to the Peconic Estuary. Recent findings have indicated that an increasing trend in nitrate concentrations and adverse impacts has been attributed to the increase in residential development in un-sewered areas due to on-site septic systems and landscape maintenance practices. The SUFFOLK COUNTY COMPREHENSIVE WATER RESOURCES MANAGEMENT PLAN ((SCCWMP) 2015) identifies nitrate causing the most widespread concern. Additional contaminants of concern found in groundwater include perchlorate, 1,4-dioxane §snd pharmaceuticals and personal care products (PPCPs). Contamination by volatile organicRECEIVED compounds (VOCs) and pesticides also have been identified as a serious threat to (0(g(O , groundwater. MAY 2 8 2015 9 110 Nitrate is added to the groundwater and surface waters by septic systems in un-sew M� ®F APPEALS areas and by lawn fertilization and agricultural practices. Higher concentrations of nits - generally observed in wells with more densely developed residential and/or agricultural use areas. The SCCWMP correlates property size with higher concentration of nitrogen. Parcels that are less than an acre, groundwater nitrogen concentrations exceed target levels of 6 mg/L. In areas where property sizes are 1/4 acre or smaller, groundwater levels are predicted to exceed 10 mg/L. The proposed lots, if approved, would equal 24,263 sq. ft. and 25,873 sq. ft. and septic systems are proposed. The action would contribute to increased nitrogen concentrations in groundwater and surface waters. Contaminated groundwater and other nonpoint pollution sources are the primary contributors to water quality degradation of the Peconic Estuary contributing to algal blooms and hypoxia (SCDHS). Due to the threat of further contamination and pollution, in the SCCWMP the SCDHS proactively recommends that Article 6 be amended to require one acre density in hydrogeologic zone IV to protect surface water quality, unless provision is made for: 1. a higher level of treatment than is provided by a typical on-site wastewater treatment system, or, 2. the development rights from existing undeveloped open space controlled by the developer are transferred, in accordance with standards adopted by the SCDHS in 1995. Although the recommendations are not implemented yet, the known impacts of additional density adjacent to surface waters, requires consideration of the recommendations and mitigation. Neither recommendation is proposed in this action. Further, no buffers adjacent to the water body or best management practices for landscape maintenance are proposed; therefore the action does not meet or further Policy 5. Protect and improve water quality and supply in the Town of Southold and Policy 6. Protect and restore the quality and function of the Town of Southold's ecosystem. 2. The Hamlet Study, 2007/2008 Hamlet Stakeholder recommendations, the Comprehensive Plan and the Local Waterfront Revitalization Study recommend that density be located close to the hamlet centers with supporting infrastructure. Policy 4.1 "Minimize losses of human life and structures from flooding and erosion hazards."The following management measures to minimize losses of human life and structures from flooding and erosion hazards are recommended: specifically A. Minimize potential loss and damage by locating development and structures away from flooding and erosion hazards. Portions of the property are located in the FEMA Flood Zone AE El 8'. The Suffolk County FEMA Flood Zone delineation does not match the surveys submitted. The FEMA Flood Zone AE El 8' flood zone extends farther west on the Suffolk County GIS system (see figure 1). Structures located within these areas have the potential to suffer loss and pose hazards to life and property. Wilcenski, Chairman Date: May 15, 2015 Re: Request for ZBA Comments for Steven &Andrea Kolyer SCTM#1000-81-1-10.1 ZBA# 6860 The Zoning Board of Appeals requested comments on the application of Steven & Andrea Kolyer which proposes to split a 50,137 sq.'ft. parcel into two non-conforming lots in the R-80 Zoning District. One lot would equal 25,873 sq. ft. (80,000 sq. ft. are required) and have a lot width of 122.5' (175' are required) and the other would equal 24,263 sq. ft. and have a lot depth of 152.7'. The subject parcel was originally part of the "Paradise Point Subdivision Section One", filed on April 11, 1963, and was shown as two small lots on this old filed map. These lots merged when the Town Board, during their later comprehensive planning efforts, acknowledged that the high-density zoning in this area was not in the best interest of the Town and changed it to the two-acre R-80 Zone. We have reviewed the Variance request to essentially return the lot sizes to the previous zoning in the context of the Town's Comprehensive Plan, which is comprised of a number of plans and studies and the Zoning Code itself. This request is inconsistent with the Town's Comprehensive Plan because of the adverse impact on the quality of the groundwater, which in turn will cause pollution to the Bay. This area is already densely settled and every home has a septic system, lawns and landscaping. Nitrates leaching from septic systems and fertilizers end up in the groundwater and are carried to the Bay. Nitrate pollution in the Bay leads to harmful algal blooms that kill fish and shellfish and destroy the water quality making it _;olyer- Page 12 — May 15, 201 unpleasant for swimming and boating. Chemicals from pesticides commonly used on lawns and landscaping also end up in the groundwater and ultimately in the Bay. . Adding another house with its septic system and landscaping in this location will increase the pollution of the Bay which leads to the conclusion that increasing the density beyond the current zoning should be prohibited. Through review of the aerial photo, it appears that the lot is heavily wooded. If the Variances are approved, the loss of trees - a valuable natural resource in Southold -will likely result. Based on the above, the Planning Board has found that the proposed action is inconsistent with the Town's Comprehensive Plan and cannot support the granting of the Lot Area Variances. Lot Area Variances can slowly undermine the integrity of the Code when taken cumulatively over time. We hope that the information provided to you is helpful. Paradise Point at Bayview contains 16 lots on 9.18 acres. The subdivision was approved by the Southold Town Planning Board in 1963. The two vacant parcels were originally approved as separate lots in the 1963 subdivision and are two of the remaining three vacant parcels. Both parcels are improved with bulkhead and separate marine structures; Map Lot 8 has a wood dock, ramp and float, and has independent electric service and lights. Map Lot 9 has a concrete boat ramp. Each lot was given it's own separate address. The dock was constructed on lot 8 (Tax Map#10) is located at a conforming setback(15')from the property line between the two lots. Each lot has a generous and conforming building envelope, each lot is able to support a conforming a house at least the same size and character of the other homes in the community. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: The prior owner Elfers acquired the two parcels in 1963 on one deed,described as lot 8 and lot 9 of the Paradise Point subdivision. Thereafter in 2003 the Kolyers purchased the property on one deed. The parcels received separate tax bills until the Kolyers asked the assessors for one real estate tax bill. The two parcels merged and do not qualify for a waiver of merger. In order to re-subdivide the two lots,area variances are required. (3) The amount of relief requested is not substantial because: The attached list of lots in the original Paradise Point at Bayview subdivision and the lots along the bay side of street are similarly%acre in size. The Kolyer parcels are each over 1/Z acre in size. While the variance request is substantial,due to the zoning designation of R-80,the subdivision was developed with lots that are less than%acre and less than 175'in width. The largest lots located on the Bay have approximately%acre of"buildable area"making the homes on theses lots conforming to the character of the neighborhood. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in•the neighborhood or district because: The two parcels would be developed outside of the flood zone; the building envelopes are in flood zone X. Each lot is completely fronted by a well maintained bulkhead which protects each parcel from flooding or erosion. Each lot can construct a sanitary system which is more than 100' feet from the bulkhead. There is public water in the street, with separate meters and a t-joint hook-up for each parcel. Each house can be constructed with conforming setbacks for a 1/z acre parcel. As a combined parcel,the setbacks from the road increase to 50' and side yards increase to 20'. A copy of the tax map showing which lots are improved and which lots are vacant. As testified at the hearing, the Kolyer parcel remains vacant and the only other vacant parcel is Mr. Boyd's parcel (SCTM#1000-81-1- 10.1) 2. A copy of the draft Planning Board Covenants and Restrictions. All subdivision applications require standard covenants and restrictions. As you can see from the enclosed sample of the draft covenants prepared for the Sutton subdivision which obtained an area variance, the Planning Board places the following conditions: 1. No further subdivision 2. An adjusted front yard Setback 3. Clearing restrictions pursuant to Town Code 240-49 4. Prohibition on use of fertilizers (extensive list) 5. Requirement to use of native and drought tolerant plants in landscaping 6. Requirement for new underground storage tanks must contain overfill & corrosion protections. The above standard covenants address the issues raised by both the Planning Board and LWRP. 3. In response to Mr. Horning's question as to the history of"Merger" and the code, the Paradise Point at Bayview subdivision was approved by the Planning Board in 1963 when the zoning code required lots to be a minimum of 12,500 sq.ft. As zoning increased to two acres, Town Code section 100-12 was adopted which made clear that lots in specifically listed Planning Board approved subdivisions were exempt from lot size requirements. Therefore any owners of contiguous lots in Paradise Point Subdivision were "grandfathered" and protected from merger. The Elfers' purchased two lots in the subdivision in 1963. These lots were exempt from merger throughout their ownership until 1997•. The Town adopted Local Law 23-1995 which repealed the exemption list, but gave owners a one year grace period to change their deeds to avoid merger. Lots in Paradise Point subdivision in common ownership after 1/1/97 merged. Mr. and Mrs. Elfers continued to own the two parcels until Mr. Elfers' death in 1992 and Mrs. Elfers continued to own the two parcels until her death in 2000. Mrs. Elfers' estate sold the properties to the Kolyer's in 2003 using the same description as in the Elfers' deed, "lot 8 and lot 9 on a certain filed map." The waiver of merger law has been revised over the years, most recently, because the lots were held in common by the Kolyers, this application requires area variances. As we discussed at the hearing, the two parcels are improved with a bulkhead on the boat basin are dry and unaffected by wetlands or other environmental regulations. The two lots can be developed in conformity with zoning setbacks. These lots can be developed independently as any non-waterfront lot in town. No fertilizers containing nitrogen, phosphorus, or potassium shall be utilized between November 1st and April 1st. d. The application of lawn fertilizer within 20 feet of any surface water except: where there is a vegetative buffer of at least 10 feet; or where the fertilizer is applied by a device with a spreader guard, deflector shield or drop spreader at least three feet from surface water is prohibited. e. Only organic fertilizers where the water soluble nitrogen is no more than 20% of the total nitrogen in the mixture may be utilized on the lots. A f. A maximum of 1 pound of nitrogen per 1000 square feet in any one application, with a cumulative application of no more than 2 pounds per 1,000 square feet per year is permitted. g. The use of phosphorous containing law fertilizer is prohibited unless establishing a new lawn or soil test shows that the lawn does not have enough phosphorus. Fertilizer labels have three bold numbers. The number in the middle is the percentage of phosphorus in the product, e.g. 22-0-15. Use of products with 0.67 in the middle or lower is not restricted. Products with a number higher than 0.67 may only be used if a new lawn is being established or a soil test indicates it is necessary. fi- 7 h. The application of lawn fertilizer on impervious surfaces is prohibited. Any fertilizer that is applied or spilled on impervious surfaces shall be immediately picked up. J 9. We purchased our home at 280 Basin Road three and one half years ago It is a lovely wooded neighborhood with generously sized lots, many of which are occupied by larger homes. I feel that while this beautiful lot on the basin, where I keep my boat at the PPA docks, is potentially appropriate for one new home, subdividing it into two smaller lots would not be indigenous to the surrounding neighborhood and not in the best interests of the community. As a conservationist, I would also be very concerned about two homes with two more septic systems built near each other and close to the basin and its tidal waters along with the effects of future fertilizer and pesticide run-off from two additional property lawns. Please consider my comments and observations as a concerned neighbor, as you deliberate this decision.
