No. 5013 —ARLINE YOUNGMAN. PARCEL 1000-68-3-6 STREET & LOCALITY: 1010 Salt Marsh Lane, Peconic DATE OF PUBLIC HEARING: October 18, 2001. FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: Applicants' property is located on the northerly side of Salt Marsh Lane in Peconic. A copy of a former survey of applicant's property shows the property 98.29 ft. along the private right-of-way and 312 ft. in depth to the high water line of the Long Island Sound for a total lot size of 30,576+- sq. ft. The property is improved with a single-family dwelling and accessory structures. BASIS OF APPEAL: Building Inspector's August 14, 2001 action which reads that the building permit request, to locate a 12 x 22 ft. accessory garage in a front yard (the yard facing the applicant's access/right-of-way), is disapproved under Article III, Section 100-33C for the reason that the front setback is less than 40 feet to the front line. AREA VARIANCE RELIEF REQUESTED: The applicant requests an area setback variance to locate an accessory garage in the front yard area of this waterfront property. The original request of the applicant was to locate the garage at five feet from the west side line and 15 feet from the southerly front line. The Zoning Board of Appeals held a public hearing on this matter on October 18, 2001, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal observation by Members of the Board, and other evidence, the Board finds the following facts to be true and relevant. ADDITIONAL INFORMATION At the October 18, 2001 public hearing, the Board requested, and applicant agreed, to increase the requested front yard setback from 15 feet to 20 feet. On October 22, 2001, applicant submitted an amended plan locating the 12 x 22 ft. garage at 10 feet from the westerly side line and 20 feet from the front line (along applicant's right-of-way). REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The proposed 12 ft. by 22 ft. accessory garage would be located in the front yard of a long, narrow soundfront lot in a heavily wooded area served by an unimproved right-of-way. Most of the garage will be screened from view by the woods and brush and its front yard location will not harm nearby properties. A Page 2—October 25, 2001 Apri. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because location of the garage on the lot is limited by mature trees, a driveway and a pump house. 3. The area variance is not substantial and relates to the environmental considerations to preserve the wooded nature of the lot near the right-of-way and the character of the neighborhood. 4. The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood because the variance will permit the accessory garage to be located within an area that will preserve mature trees in a wooded area. In considering this application, the Board deems this action to be the minimum necessary and adequate for the applicants to enjoy the benefit of a new accessory playhouse structure with deck, and that the grant of this variance will preserve the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion by Member Tortora, seconded by Member Horning, it was RESOLVED, to DENY the original location of the proposed garage, and ALTERNATIVELY, TO GRANT a variance, permitting applicant to construct a 12 ft. by 22 ft. accessory garage in the front yard to be set back 20 feet at its closest point from the front property line and 10 feet from its closest point to the westerly side property line, SUBJECT TO THE FOLLOWING: 1. The accessory building shall be for garage or storage purposes incidental to the principal residence. 2. The accessory building shall not be used for sleeping or living quarters. 3. The only utility shall be electric for lighting or outdoor plumbing. 4. The accessory building shall remain at one-story height. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The above mentioned permit requires a set back of 10 feet from the closest point to the westerly side of the property line, while the actual foundation laid is 8.6 feet from that line. However, the appropriate code for accessory buildings (100-33 sections B and C) which was provided to us at the time of original application seems quite clear regarding setbacks from lot lines. Our property is a waterfront parcel whereby such accessory structures may be located in the front yard as shown in the original notice of disapproval,dated August 14, 2001. Since our lot is surveyed at 30,888 sq. feet the setback to the adjacent lot line is covered by section B(2) which requires that "such buildings shall be set back no less than five (5) feet from any lot line,"not ten feet as stated in the permit. We appear to be only in violation of that permit by a matter of six inches from the front property line and that only at one corner of the foundation. (and that could be adjusted if the town so insists). We would appreciate your earliest reponse in the hope that this should obviate the need for a second hearing on April 18, and allow us to proceed with the construction. I attended the hearing for the variance (in October) and understood that your Board was,most concerned that the garage not be positioned close to the dirt road, and should be at least ten feet from our property line. Also, we understood that if the western part of the garage is more than 5 feet from our neighbor that would be all right. We submitted the application for a variance, but the foundation on our property at present does not measure the same. It is just inches different. During the winter, we were not there when the mason,and assistant measured out the garage inaccurately, and poured concrete in a legal fashion. At present the foundation measures 19.4 inches from the property line, instead of 20 inches, and 8.6 inches on the westerly side. My neighbor on the westerly side has no objection to this location and no other neighbors object. So you see we are just inches off the plan. - - ' - We have displayed in the window of our house a Building Permit- issued to us from ' your Building Department. The builder is anxious to get the garage built and we feel bad that we are preventing him and his staff from making money- it is cruel not to give them work when they need it in the winter months. One side of the base is nearly ten feet from our easterly neighbor and the other end is 8.6 feet and we are 19.4 feet from the road (which is a dirt lane). We would like permission to build the garage on this structure- and we have a letter from our easterly neighbor Mary K. Farley stating that she has no objection to any of the measurements (see letter attached). Mr. Goehringer kindly visited our premises on March 8th, and he knows that we are in a remote rural area, surrounded by trees and bushes, and the placement of the garage where it is now, would blend in well with the vegetation around us, and would be the perfect spot for the building and would not upset the neighbors. We would appreciate so much your permission to go ahead as soon as possible -the builders need the work and we are preventing them from earning money, which is very bad in these difficult times.
