FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: The subject property is an undeveloped lot on the
Sound in Southold, reached by a right-of-way that ends at the southeasterly comer of the
property. The lot measures 26,675 sq. ft., but more than half of this area is on and below the
Sound bluff. The area above the bluff measures 100 feet deep from the bluff by 113.94 feet
wide along the southeasterly lot line.
BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated January 8, 2001,
denying a permit to build a house on the property because the proposed building envelope
showed setbacks of 30 feet from the bluff (31 feet from the Coastal Erosion Hazard Line)
and 20 feet from the southeasterly lot line. Code section 100-239.4A(1) requires a 100-foot
setback from the bluff and section 100-244B requires a 40-foot front yard. The Building
Inspector determined that the southeasterly yard of the proposed house is a front yard.
AREA VARIANCE RELIEF REQUESTED: Applicant requests variances from both the bluff
and the front yard setback requirements, sufficient to permit a house to be built on the
property. Applicant stated that the 50 x 50-foot building envelope which was set forth in the
Building Permit application, and the basis for the Notice of Disapproval, was proposed
simply to show that variances are needed to build a house on the property.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony
presented, materials submitted and personal inspection, the Board makes the following
findings:
1. The subject property was created in 1967 by an approved division of a large family
parcel on which there was one house. The intention was to allow family members to build
one or more additional houses. Applicant's proposed construction is the first such house
to be proposed. As a consequence of the 1967 land division, the subject property is
bordered by family-owned lots (and the Sound) on the northwest, northeast and southeast.
2. The buildable area of the property measures 100 feet deep from the top of the bluff
by 114 feet on the southeasterly lot line. In light of the setback requirements now in the
Zoning Code, no construction is possible without variances.
3. The Suffolk County Department of Health has approved a septic system located in
the northeasterly portion of the property. A report from the Suffolk County Soil and Water

Conservation District states that the property is well covered in grass, that the bluff face is
heavily vegetated, and that the bluff toe apparently is not reached by high tide and is not
eroding. There is no evidence that construction of a house will have an adverse effect or
impact on physical or environmental conditions provided there are suitable restrictions on
the construction activity and suitable provisions for controlling water runoff from the
house.
4. Viewed against the current setback requirements in the Zoning Code, the
variances requested by the applicant are substantial. However, the most restrictive
provision — the 100-foot setback from the bluff — was not in the Code when the lot was
legally created in 1967. Applicant stated a willingness to locate the house well back toward
the southeasterly lot line, which moves it away from the bluff but reduces the area that the
Building Inspector has identified as the front yard. Locating the house close to the
southeasterly lot line is reasonable, although the required front yard setback variance is
substantial.
5. Construction of a house as permitted by the action set forth below will not
produce an undesirable change in the character of the neighborhood or detriment to nearby
properties.
6. The action set forth below is the minimum necessary to enable applicant to
construct a house on her property while preserving and protecting the character of the
neighborhood and the health, safety and welfare of the community.
RESOLUTION/ACTION: On motion by Member Dinizio, seconded by Chairman Goehringer,
it was
RESOLVED, to DENY the application for variances for construction in the 50 x 50-
foot envelope specified in the application, and ALTERNATIVELY to GRANT a variance
authorizing setbacks for house construction, including any decks, of at least 45 feet from
the top of the bluff at the closest point and at least eight (8) feet from the southeasterly lot
line, subject to the following CONDITIONS:
1. The house shall be equipped with gutters and leaders adequate to collect all water
runoff and to direct such runoff to drywells located well away from the bluff.
2. The Zoning Board, its Chairman, or other representative, reserves the right to
inspect the property during and after all phases of construction.
3. The foundation over-cut shall not extend more than 15 feet around the house and
no closer than 30 feet from the top of the bluff.
4. Applicant agrees to place hay bales and use light construction equipment to
help mitigate any possible environmental damage during construction activities.

Dear Mr. Goehringer:
Today we have inspected the site of a proposed house at Horton's Point off of Hyatt Road in
Southold as you have requested(SCTM# 1000-54-1-4).
Land slopes towards the bluff. The'area is in good grass cover. Stakes had been'placed for the
corners of the proposed house. Distance to the bluff edge is as shown on the survey. The bluff face is
heavily vegetated with trees, vines and briar. The lip along the top is near a natural angle of repose.
Some trees had been cut in the past and the logs left on the bluff face. There is no access to the toe of the
slope,however the vantage point from above and the existing Gazebo was good. The high tide line does
not appear to reach the toe of the slope. There are no toe stabilization structures anywhere within the
area. There are beach grasses along the back of the dune and growing onto the beach all along the toe of
the slope. The toe does not appear to be actively eroding.
Due to the size and placement of the proposed house and the possibility of a deck or patio being
installed, it is very important to contain any surface water runoff from flowing over the bluff face. All
roof runoff should be directed into drywells and if a patio or deck is installed that should also be
designed to contain the added surface'water runoff. Debris from cuttings, leaf litter and lawn clippings
should not be thrown onto the bluff face because it will smother existing vegetation and add excessive

Dear Chairman and Board:
Pursuant to your request at the hearing on May 3 ,
2001 enclosed please find En-Consultant' s letter
regarding the determination of "rate of erosion" .
There is no significant threat of erosion on this
property.
We are also in receipt of County of Suffolk, soil &
water letter dated May 1, 2001 which recommends certain
erosion control measures which my client will accept .
The County did not realize that the 50 x 50 building
envelope submitted with the application includes
sufficient room for a deck. Therefore, the proposed
setback to the bluff is a minimum setback.
The health department application was submitted on
May 10, 2001, and will take approximately 4 weeks to be
reviewed. Nevertheless, the health department had
approved the location of sanitary and well in 1991 .
Please be advised that after the hearing I showed
Mr. Miller a copy of our deed which includes the right-
of-way, I believe that he realizes that we a have a
legal right to the access . In addition the parties
discussed the entrance to the property and an access was
designed which is more agreeable with Mr. Miller.

Dear Mrs. Moore:
In response to your request that I attempt to determine a rate of bluff erosion for the captioned property,please be
advised that the best available method of approximating the erosion rate of a dune or bluff is to measure the
difference in the locations of their crests from a fixed point over an extended period of time, and then divide the
number of feet of change in location by the difference in years.
Therefore, I have examined the two surveys you forwarded to me, including one prepared by Roderick Van Tuyl,
dated 19 June 1985 and amended 22 May 1991, and one prepared by Peconic Surveyors, dated 27 November
2000,-amended 11 December 2000. My calculations assume that the "top of bank" shown on the Van Tuyl
survey was measured on the original date of the survey, 19 June 1985.
According to the "top of bank" labeled on the Peconic map, the northerly, irregularly configured bluff crest
remained stable between 1985 and 2000. The more regular, i.e., shore-parallel, top of bank on the southerly end
of the property, however, transgressed landward by approximately 13 feet between 1985 and 2000, indicating an
approximate erosion rate of 10.5 inches per year (13 feet/15 years). Specifically, the southerly terminus of the
top of bank shown on the Van Tuyl survey was located 96' west of the monument in the southeasterly corner of
the property in 1985, whereas the southerly terminus of the top of bank shown on the Peconic survey was located
83' west of the monument in the southeasterly corner of the property in 2000.
As far as what future information can be interpreted from this data, one could extrapolate that the crest of bluff
will transgress landward to the easterly property line in approximately 95 years (83'/10.5" per year). Such
extrapolation, however, relies not only upon the accuracy of the source information (the surveys) but also upon
the assumption that the bluff is in fact eroding chronically and gradually landward over time. To the contrary,the
bluff could be relatively stable over time but then move substantially landward during sporadic, avulsive storm
events, whose future frequency and intensity are not predictable. Therefore, the accuracy with which the

Pursuant to Town Law section 267b-3 the Southold
Town Zoning Board of Appeals is to analyze and assess
the personal benefits anticipated by the applicant
against the potentially deleterious effects that a grant
of the relief requested would have on the health, safety
and welfare of the effected neighborhood or community.
In performing this balancing test, the Zoning Board is
charged with the responsibility to consider the five
factors enumerated in Town Law Section 267b-3 (b) . The
variance should be granted for the following reasons :
1 . No undesirable change will be produced in the
character of the neighborhood or a detriment to nearby
properties, if the variance is granted.
The proposed house is to be located on one of four
parcels in a small subdivision created in 1967 by Juell
M. Die . Due to the setback requirements from the Bluff
and Coastal Erosion Line the area suitable for
construction is only 100 ' in depth by 113 ' in width.
The development . of this parcel will not produce a
change to the character of nearby properties because the
only house on one of the four lots in the subdivision
was owned by Mrs . Wockenfuss' s mother, has remained in
the family and is Janet Wockenfuss and her sister Ruth
Brown, the family always intended to provide for the
development of the parcels as a family compound. The
parcels have been treated and maintained as separate
buildable parcels and the applicant has been paying
taxes on this parcel since 1968 .
2 . The benefit sought by the applicant can not be
achieved by some method, feasible for the applicant to
pursue, other than an area variance .
The developable area of the parcel is only 100-' in
depth by 113 ' in width, the applicant can not construct
a house on this parcel without a variance from setback
to the bluff, as the house is set back from the bluff
the front yard setback becomes smaller and less
conforming. This parcel obtained 280A approval and
access has been authorized. The applicant had obtained
Health Department approval in 1991 and had intended to
construct the house at that time, however, family health
problems_ prevented the construction. Thereafter,
Article XXIII section 100-239 was adopted by the Town.
The setback to the bluff could be increased provided the
setback to the front yard is decreased. The appeal
included both variances in order to enable the Zoning
Board to consider reasonable, alternatives .
3 . The area variance is not substantial The
application of the balancing test weighs in favor of the
grant of the variance. The applicant has reduced the
front yard setback in order to provide some flexibility
of design. The front yard is off -of a 15 ' ;right-of-way
with 280A approval and the setback to ' the front yard
could be reduced to 5 feet off the property line.
4 . The variance will have no adverse effect, or impact
on the physical or environmental conditions in the
neighborhood or district .
The bluff is . stable and construction will be kept
landward of the bluff. The footprint permits a deck and
house to be constructed.
5 . The alleged difficulty was not self-created.
The conditions of the property, topography and
additional regulatory restrictions which were not in the
Town code when the applicant acquired this parcel create
the difficulty.
-6 . The variance requested is the minimum variance
practicable given the personal benefits anticipated by
the applicant .
We respectfully request that the appeal be granted,
together with any further relief that is deemed
necess and easonable.

Dear Mr. Goehringer:
Today we have inspected the site of a proposed house at Horton's Point off of Hyatt Road in
Southold as you have requested(SCTM# 1000-54-1-4).
Land slopes towards-the bluff. The area is in good grass cover. Stakes had been placed for the
comers of the proposed house. Distance to the bluff edge is as shown on the survey. The bluff face is
heavily vegetated with trees, vines and briar. The lip along the top is near a natural angle of repose.
Some trees had been cut in the past and the logs left on the bluff face. There is no access to the toe of the
slope,however the vantage point from above and the existing Gazebo was good. The high tide line does
not appear to reach the toe of the slope. There are no toe stabilization structures anywhere within the
area. There are beach grasses along the back of the dune and growing onto the beach all along the toe of
the slope. The toe does not appear to be actively eroding.
Due to the size and placement of the proposed house and the possibility of a deck or patio being
installed, it is very important to contain any surface water runoff from flowing over the bluff face. All
roof runoff should be directed into drywells and if a patio or deck is installed that should also be
designed to contain the added surface water runoff. Debris from cuttings, leaf litter and lawn clippings
should not be thrown onto the bhiff face because it will smother existing vegetation and add excessive
weight.,

the SOUTHOLD TOWN BOARD OF APPEALS at the Town Hall, 53095 Main Road, Southold, New

Dear Sir or Madam:
Please find enclosed a copy of the Legal Notice describing the recent application. The Notice will be
published in the next issue of the Suffolk Times.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be now mailed with a map or sketch showing the construction area or
variance being considered. Send the enclosed Notice CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, on Monday, April 23`d, or sooner, including a copy of a map showing your project
area, to all owners of land (vacant or improved) surrounding yours, including land across any street
or right-of-way that borders your property. Use the current addresses shown on the assessment
rolls maintained by the Town Assessors' Office (765-1937) or the County Real Property Office in
Riverhead. If you know of another address for a neighbor, you may want to send the notice to that
address as well.
When picking up the sign, a $15 check will be requested for each metal stand as a deposit. If you
already have a sign and stand and only need the laminated printout for the face of the sign, an
additional deposit is not necessary and we can mail or fax it to you. Please post the Town's
official posterlsign no later than April 25, 2001. Securely place the sign on your property facing
the street, no more than 10 feet from the front property line bordering the street. (If you border more
than one street or roadway, an extra sign is furnished for each front yard.) The sign(s) must remain
in place for at least seven (7) days, and should remain posted through the day of the hearing. If you
need a replacement sign, please contact us.
By May 1 st, please submit to our office your Affidavit of Mailing (copy enclosed)with parcel numbers
noted for each, and return it with the white receipts postmarked by the Post Office. Later, when
the green signature cards are returned to you by the Post Office, please mail or deliver them to us
(but not later than the date of the hearing). If any signature card is not returned, please advise the
Board at the hearing.
On or about May 3, 2001, and after the signs have been in place for seven (7) days, please submit
your Affidavit of Posting to our office. These will kept in the permanent record. (If the metal
stands are returned to our office, your deposit will be returned.)

The Board finds that the right4wof-way is being improved and widened
so as to meet requirements' of ' iRooess under -280-A of the Town Law
and that this access will serve only a minor subdivision. Upon
inigpeotion of the Board it was found that the road will enable
emergency vehicles to get in and out up to this parcel.
The Board finds that strict application of the Ordinance
would produce practical difficulties or unnecessary hardship;
the hardship created 10 unique and would not be shared by all
properties alike in the immediate vicinity of this property and
in the same use district; and- the- variance will not ohange the
