No. 5000—GERALD AND DOROTHY WANSOR 1000-111-4-12 STREET & LOCATION: 1525 Vanston Road, Cutchogue DATE OF PUBLIC HEARING: October 18, 2001 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's property is shown as Lot 333 on the Map of Nassau Point Club Properties, and is a corner lot located along the east side of Haywaters Road and the south side of Vanston Road (a/k/a Old Cove Road) in Cutchogue. The property consists of 25,734 sq. ft. in area and has a lot depth of approx. 103 feet along the southerly property line. The lot is improved with a one-story frame dwelling as shown on the survey prepared by Harold F. Tranchon, Jr. dated August 2, 2000. BASIS OF APPLICATION: Building Inspector's July 27, 2001 Notice of Disapproval for the reason that Section 100-244 and Section 100-242A, the setback from the front property line is required to be 40 feet. Applicants' proposed additions/alterations to the existing dwelling will be set back at approximately 31 ft. from the front property line. AREA VARIANCE RELIEF REQUESTED: Proposed entry deck with fully extended stairs at the west side of the house, which addition will be 31 feet at its closest point. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. Grant of an area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because applicant seeks to build a small deck (approx. 225 sq. ft.) with surrounding steps, which will act as the entrance to their home. This type of entrance is common and consistent with the area. 2. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to pursue, other than area variances because the lot is narrow in width and has streets located on two sides. 3. The requested area variance is not substantial. 4. Grant of the variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. No evidence was presented to suggest that the physical or environmental conditions in the neighborhood would be adversely impacted. 5. Upon application of HENRY AND VIRGINIA STEINBRECHER, 1525 Haywaters Road, Cutchogue, NY for a Variance to the Zoning Ordinance, Article III, Section 100-31 for permission to construct addition with an insufficient frontyard setback, at 1525 Haywaters Road, Cutchogue, NY; Nassau Point Subdivision, Section D, Map 806, Lot 333 ; County Tax Map Parcel No. 1000-111-4-12. The public hearing concerning this application was held on July 28, 1983. The board made the following findings and determination: By this appeal , applicants seek permission to construct a 21 ' by 16 ' bedroom-bath addition at the westerly corner of the existing one- family dwelling structure. The proposed addition would leave a setback from Haywaters Road at approximately 19 feet at from a tie line along- Ole Cove Road approximately 66 feet. The present frontyard setback of the existing dwelling is approximately 35 ' from Haywaters Road. For the record it is noted that the setback of the house from the easterly property line is 44 feet and from the southerly property line approxi- mately 61 feet. The lot in question contains an area of approximately 27, 000 square feet and is a corner lot as defined by Article III, Section 100-13 and Article XI, Section 100-119 . The board members have visited the site in question and are familiar with the land, improvements and immediate surroundings. In considering this appeal, the board determines: (1) that the variance request is substantial in relation to the requirements of the zoning code (more than 53%) ; (2) that the circumstances are not . unique; (3) that by allowing the variance , as applied, detriment to other properties may be created; (4) that the difficulty can be obviated by a method feasible other than a variance; (5) that the relief requested will not be in harmony with or promote the general purposes of zoning as applied; and (6) that the interests of justice will not be served by allowing the variance, as applied-- (see notation below) .
