Southold Town Board of Appeals
September 25, 1999
A regular meeting of the Southold Town Board of Appeals
was held 7:30 P.M., Thursday, September 25, 19~9, at the' Town
Clerk's Office, Main Road, Southold, New York.
There were present: Messrs. Robert W. Gillispie, Jr.,
Chairman, Robert Bergen, Herbert Rosenberg, and Charles
Grigonis, Jr.
Also present: Mr. Howard M. Terry, Building Inspector.
Absent: Mr. Serge Doyen, Jr.
PUBLIC ME.~RING: 7:30 P.M., Appeal No. 217 - Upon appli-
cation of Lewis N. Griffin~ Bay Avenue, Mattituck, New York,
for a special exception in accordance with the Zoning Ordinance,
Article l-V, Section 500, Subsection 9~ for permission to use and
maintain premises as a public garage. Location of property:
Mattituck~ New York, bounded north by Sound Avenue, east by
Pacific Street, south by now or formerly of Clara Benjamin, and
west by now or formerly of S. B. Hamilton. Fee paid $1~.00.
The Chairman opened the hearing by reading application
for a special exception, legal notice of hearing and a~fidavit
attesting to its publication in the official newspaper.

CHAIRMAN: I~ there anyone present who wishes to speak
for this application?
Mr. Lewis N. Griffin, Mattituck, New York, stepped
forward and stated he appeared for the application and would
answer any questions the Board might have.
Mr. Griffin was requested to amend his application to
eliminate all reference to a gasoline service station on his
application for a public garage since he was making separate
application for the public garage. Mr. Griffin agreed to do
same.
CHAIRMAN: Is there anyone else present who wishes to
speak for this application? Is there anyone present who wishes
to speak against this application? Are there any questions any
members of the Board would like to ask Mr. Griffin?
(No one wished to speak.)
Resolution was offered by Mr. Gillispie, seconded by Mr.
Bergen and carried, ~AS application of Lewis N. Griffin,
h~ving been considered at Public Hearing No. 217 on September
24, 19%9, and the Board finding that the public convenience
and welfare and justice will be served and the legally estab-
lished or permitted ~se of neighborhood property will not be
substantially or permanently injured and the spirit of the
Ordinance will be observed, therefore be it
RESOLVE~ that the application be granted for a public
garage subject to the following conditions:
1. No major repair work shall be performed in the open.
2. Pumps, lubricating and other devices shall be located
at least fifteen (1%) feet from the line of any street or high-
way, right-of-way or property line.
3. All fuel oil or similar substances shall be stored
at least fifteen (15) feet distant from any street or lot line.
$. No automobiles, or automobile parts, dismantled or
damaged vehicles and similar articles shall be stored in the
open and no parking of vehicles other than those being serviced
shall be permitted except in the case of wrecks which are towed
on the .premises; the operator of this service station shall have
three (3) months in which to dispose of these damaged vehicles
or shall place them indoors.
5. Signs to be in accordance with Article IV, Section
~08 of the Building Zone Ordinance of the Town of Southold.

Permission is denied, under this application, for the
operation of a gasoline service station~ an application having
been made separately for this. The following words shall be
elminiated from the application No. 217 referring to ~soline
service station: Line 2, paragraph i - "two gasoline pumps."
Line 2, paragraph 3 - "The sale of fuel would be incidental.
to this operation."
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,
Mr. Rosenberg, and Mr. Grigonis.
PUBLIC HEARING: 7:~5 P.Me, Appeal No. 220 - Application
of Lewis N. Griffin, Bay Avenue~ Mattituck, New York, for a
special exception in accordance with the Zoning Ordinance,
Article IV, Section ~00, Subsection 9, for permission to use
and maintain premises as a gasoline service station in conjunction
with the public garage. Location of property: Mattituck, New
York, bounded north by Sound Avenue, east by Pacific Street,
south by now or formerly of Clara Benjamin, and west by now or
formerly of S. B. Hamilton. Fee paid $1%.00.
The Chairman opened the hearing by reading application
for a special exception, legal notice of hearing, and affidavit
attesting to its publication in the official newspaper.
CHAIRMAN: Is there anyone present who wishes to speak
for this application?
Mr. Lewis N. Griffin stepped forward and stated he would
answer any questions the Board might have.
Mr. Howard Terry, Building Inspector, explained to the
Board the map appearing in the file and gave the location of
the property and proposed garage.
CHAIRMAN: How big is the building going to be~Mr.
Griffin?
MR. GRIFFIN: %0 ft. by 60 ft.
CHAIRMAN: What are you going to service in particular?
MR. GRIFFIN: It will be a public garage for trucks.
CHAIRMAN: What type of construction will the garage
be of?
MR. GRIFFIN: Cement block. There will be three doors
on Pacific Street and one on Sound Avenue.

CHAIRMAN: How close is the nearest school?
MR. GRIFFIN: At least a mile.
CHAIRMAN: How big a parking area will you have?-
MR. GRIFFIN: It will be 60 b~ 158 in front and the
property goes back about 500 feet. There is over an acre.
The Chairman then read the five conditions imposed when
granting service station applications.
CHAIRMAN: How far will the fuel tanks be from the property
lines?
MR. GRIFFIN: About 50 ft. from Sound Avenue and about
30 ft. from Pacific Street.
CHAIRMAN: Are there any other questions anyone wishes to
ask Mr. Griffin? Is there anyone present who wishes to speak
against this application?
(No one wished to speaks)
CHAIRMAN: What do you think is a reasonable length of
time to sllowwrecks to remain on the property?
MR. GRIFFIN: I would say three months. (Mr. Griffin
went on to explain the procedure concerning wrecked cars~ the
length of ttme it takesthe insurance companies to settle cla!m~
etc.$ The Board also discussed with Mr. Griffin a suitable
location on his property for placing the wrecked cars.
Three months was the period of time agreeable to Mr.
Griffin and the Board of Appeals for holding wrecked cars
before disposing of them.
Resolution was offered by Mr. Bergen~ seconded by Mr.
Gri$onis and carried, WHEREAS application of LeWis N. Griffin
having been considered at Public Hearing No. 220 on September
2~, 1959~ and the Board finding that the public convenience
and welfare and justice will be served end the legally estab-
lished or permitted use of neighborhood property will not be
substantial ly or permanently injured and the spirit of the
Ordinance will be observed~ therefore be it

PUBLIC HEARING: 8:00 P.M.~ Appeal No. 219 - Application
of F. J. Rossi~ proprietor of Duck Point Motel, Depot Lane,
Cutchogue, New York, for a special exception in accordance with
the Zoning Ordinance~ Article III, Section 300, Subsection ll~
for permission to erect and maintain a directional advertising
sign on the property of Mrs. Hull $. Chew, southeast side Main
Road, Laurel, New York. Fee paid $1%.00.
The Chairman opened the hearing by reading application
for a special exception~ legal notice of hearing and affidavit
attesting to its publication in the official newspaper.
CHAIRMAN: Is there anyone present who wishes to speak
for this application?
MRS. F. J. ROSSI: I don't think we have enough directional
signs on Route 2%. There is one in Cutchogue and nothing between
Cutchogue and Riverhead~ and to catch the public traveling east-
erly we need another inbetween. The sign will be a directional
arrow like the one on Depot Lane. It will be located before the
other signs, approximately IH to 1%0 feet past the property line,
about half way in~ctween the Mattituck motel sign and the gas
station.
After further discussion as to the location of the proposed
sign~ Resolution was offered by Mr. Bergen~ seconded by Mr. Grigonis,
and carried~ WNWJ~EA8 application of F. J. Rossi~ having been con-

Board finding that the public convenience and welfare and justice
will be served and the legally established or permitted use of
neighborhood property will not be substantially or permanently
injured and the spirit of the Ordinance will be observed, there-
fore be it
RESOLVED that the application be granted as requested with
the following stipulation: the sign is to be no closer than five
(5) feet to any property line and approximately midway between
the property of the Long Island Ice Corp. on the west and the present
Mattituck Mo~l sign on the east. Permission is granted for a
directional arrow and is good until revoked.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,
Mr. Rosenberg, and Mr. Grigonis.
The minutes of the Meeting of September 17~ 19%9, on
motion of Mr. Grigonis, seconded by Mr. Rosenberg and carried,
were approved as submitted.

MrS Rosenberg, ~d Mr. Grigonis.
By resolution offered by Mr. Rosenberg, seconded by Mr.
Bergen and carried, 7:30 P.M. (E.D.S.T.), Thursday, October 8,
19%9, Town Clerk's Office, Main Road, Southold~ New York, was
set for hearing upon application of A. John Gada, a/c Alexander
Robinson, Private Road, Eztates Section, Fishers Island, New
Y~rk, for a variance in accordance with the Zoning Ordinance,
Article III, Section 300, Subsection 7, for permission to locate
private garage with reduced setback. Location of property, north
side private road~ Fishers Island Estates~ Fishers Island, N~w
York~ bounded north by Fishers Island Sound, east by Pierre $.
DuPond 3rd~ south by Fishers Island Estates, and west by Van Horn
Rl y.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,
Mr. Rosenberg, and Mr. Grigonis.
It was further RESOLVED that legal notice of hearing be
published in the .official newspaper, The Suffolk Times, on date
of 0etober 2~ 1959, and the New London Day on or about the same
date.
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,
Mr. Rosenberg, and Mr. Grigonis.

The Board of Appeals discussed and approved the follow-
lng addition to the recommended procedure to be followed by
applicants seeking directional signs:
"In the interest of clarifying the suggested procedure
for applicants seeking directional signs, it is the determination
of the Board that the maxim,~_m sign permitted for direction~l
advertising of a motel or restaurant is interpreted as being
12 ftc 6 in. by 6 ft. 6 in., and not to exceed 50 sq. ft. in
area. ~'
Vote of the Board: Ayes:- Mr. Gillispie, Mr. Bergen,
Mr. Rosenberg, and Mr. Grigonis.
