No. 4892 — TAD SPERRY 1000-9-4-14.1 STREET & LOCATION: Equestrian and Midlothian Avenues, Fishers Island DATE OF PUBLIC HEARING: January 4, 2001 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's lot is .16+- of an acre with frontage along Equestrian Avenue and Midlothian Avenue (unimproved). The lot is improved with a dwelling situate as shown on the March 10, 1999 survey prepared by Chandler, Palmer & King, with a dwelling and two accessory buildings. BASIS OF APPLICATION: Applicant applied on March 8, 2000 to the Building Department for a permit "for renovation and addition to one family dwelling." After review the application, the Building Department issued a July 3, 2000 Notice of Disapproval for a dwelling at 1-1/2 feet from the front property line at several points on Midlothian Avenue, for the reason that such construction is not permitted under Article XXIV, Section 100- 242A if the project will create "any new nonconformance or increase the degree of nonconformance with regard to the regulations pertaining to such buildings." AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance for a new deck and entrance stair and deck, and renovations to the existing dwelling as shown in Exhibit on the Floor Plans (Exhibit 14) and Site Plan (Exhibit 5) prepared by Susan E. Young, Architect. The southerly setback from the proposed addition to the property line will be reduced from 5'7" to 1'3" at its closest points. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Granting of an area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because the deck addition will have a front yard setback of no less than 80+-feet from the improved Town road, also known as Equestrian Avenue. There will be a setback of 1.5+- feet on the unimproved Town right-of-way called Midlothian Avenue. However, Midlothian Avenue is a "paper road" only and is an un-used right-of-way that is very unlikely to ever be developed or improved. All of the adjacent properties bordering upon Midlothian Avenue are accessed by way of other improved Town roads, and none of these properties utilize Midlothian Avenue for access of any kind. 2. Within its front yard area, it borders the improved road, Equestrian Avenue, and also a private right-of-way that this parcel shares with one neighbor. Furthermore, this property also borders the unimproved and vacant "paper street" named Midlothian Avenue in what the Zoning Code defines as a "street" side or front yard, that would otherwise be considered to be a side yard of the property. Therefore, the applicant requires an area variance in order to make the improvements that they seek in this application. 3. The requested area variance is substantial. The variance as approved allows for an increase in the nonconformity of the building by reducing an already nonconforming setback from 5'7" to 1'3" from the edge of Midlothian Avenue. However, the determining factor in approving this particularly variance is the fact that this "paper street" is unimproved, un-used, and inaccessible to any traffic, including pedestrians. This status is extremely unlikely to change within the foreseeable future. 4. The variance has not been self-created. This small parcel with its preexisting nonconformity has a further hardship since interpretation of the code shows that this property has three front yards. 5. There is no evidence that grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the deck addition will not create any change to the existing conditions in the neighborhood. 6. In considering this application, the Board deems this action to be the minimum necessary and adequate to enable the applicants to enjoy the benefit of renovations and an addition to the existing dwelling, while preserving and protecting the character of the neighborhood and the health, safety, welfare of the community. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: worse problems on other sides: (Unsafe entrance near the Right of way to the north. No privacy to the North. Lack of any accommodation between house and land yields ungainly appearance.) This new entrance & deck to the west &south solves all problems (3) The amount of relief requested is not substantial because: Midlothian side is unused, & private. Paper"street" is not a past or future street but just natural sloping land - lawn trees& cliffs not used by anyone for access. If going a bit closer to this lot line will help the serious problems of this house it is probably worth it. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: The existing entrance is inches from an active right of way used by cars. New west stair entrance is safer - away from cars yet more visible from Equestrian Ave. where people are coming from.The deck with its light tube foundation is easy on the environment. (5) Has the alleged difficulty been self-created? The permit was disapproved pursuant to Article XXIII Section 100-242A. Our proposed addition is 1.5' from the lot line. Existing non- conforming setback on that frontage is five feet. The lot is steeply sloping, narrow, irregular, unique and non-conforming. NEIGHBORHOOD CHARACTER WILL BE IMPROVED • See Photographs& Drawings (Exhibits 6, 13, 14 A, B, C). 2. The present application by a new owner is an attempt to improve the appearance, usability, privacy and safety of the property. The existing building is a plain, functional house, built at a time when aesthetic elements of design might,not have been important. Today the owner's enjoyment of his property and the appreciation of his investment are matters of common concern. With our proposed construction completed, the appearance of the house will be improved. And neighbors and passersby will benefit from this enhanced pleasant environment. Here is how: Right now, the house is plunked on the lot with no attempt to reconcile the house with the steeply sloping terrain. The unsightly foundation, complete with basement windows, is visible from Equestrian Avenue. Applicant's plans call for a new deck and a new entrance to reconcile the terrain, cover the foundation, and provide the new owners with a level platform along with a new entrance. The existing entrance is situated only inches from an active right-of- way serving the property on the hill to the Northeast. This neighboring property looks directly down on applicant's structure; there is no privacy for either parcl. Relocation of the entrance will increase privacy and safety for both properties. Also, non-conforming unsightly out buildings • will be removed. I 1 • . 2 NEIGHBORHOOD SAFETY AND GENERAL WELFARE WILL BE IMPROVED See Photographs and Drawings (Exhibits 6, 13, 14 A, B, C, 15, 16). 3.The proposed construction increases privacy and safety by orienting the entrance away from the northeast and the right-of-way. The deck will hide the foundation, provide an entrance, and reconcile the house with the steeply sloping lot, thus helping the residents to safely circulate around the structure and to access various areas of the yard. The owner and neighbors, too, would benefit from this improved access and improved safety. This new orientation of entrance, and new circulation and activity patterns, would afford the owner views toward the trees in the back and side yards, rather than views of the house above. Privacy is enhanced by directing activities to the southwest rather than the northeast side of the house. MIDLOTHIAN AVENUE IS NOT USED A ROAD See Photographs, Site Plan,Tax Map, Survey(Exhibits 5, 14 D, E, F, 15, 16). • 4. Listed on the tax map as a "paper street", the land referred to as Midlothian Avenue is an unpaved, uncleared, buffer zone between properties. Some residents have mowed it. Others have left it as forest. It does not provide access to any property. The area is not flattened or improved. It is, indeed, no different from the surrounding natural land, with slopes, cliffs, and depressions. In some areas, thick vegetation and hilly irregular terrain make walking difficult. BUILDING CLOSE TO MIDLOTHIAN AVENUE CAUSES NO SAFETY PROBLEMS 5. It is safer to build close to Midlothian Avenue (where there are no cars) than it is to build close to the right of way (where cars drive by regularly). This right of way is the only route to the house on the lot above. Most people drive, rather than walk up the hill. THE FUTURE OF MIDLOTHIAN AVENUE See Site Plan, Tax Map and Survey(Exhibits 5, 15, 16). 6. We think there is no realistic possibility that residents would ever want Midlothian Avenue developed as a road. The properties have built around it as if this were their back or side yard. All properties use other roads (Oriental Avenue, Equestrian Avenue, Ocean Avenue and Halcyon Avenue) for access. Neighbors would not like to disturb their privacy or the orientation of their houses, houses that were developed through the years with the assumption that this avenue "on paper" is actually just lawn or forest with neither express purpose nor practical use. LOT COVERAGE IS NOT EXCEEDED 7. In this R-40 Zone, 20% lot coverage is allowed. The Property Record Card shows the Sperry lot size at .2 acres, or 8,712SF. Therefore, the buildable area of this lot is 1,742SF. (An acre is • 43,560SF; .2 acres = 8712SF; 20% of 8712SF = 1,742SF.) The deck (675SF) and house (960SF) cover 1,635SF, or 18.8% Lot Coverage. However, much of the deck and stair at the rear of the building, equal to 188SF, is at or near grade in a walk- on-walk off condition. (See Drawings & Site Plan Exhibit 5, Exhibit 6 First Floor Plan, South Elevation and East Elevation.) Owners project covers 1,635SF or 16.6% Lot Coverage. (1,742SF-188SF=1,635SF) All li • 3 CONCLUSION Because of the sloping nature of the lot and dangerous walking conditions, the owner needs a deck to use his yard safely. Let's assume the owner or the owner's children are outside and would like to make their way entirely around the house while staying close to the structure. (See Photographs: Exhibit 11.) Right now, this would be quite difficult and possibly unsafe. The proposed plan offers a safe entrance and vastly easier circulation around the property (Site Plan). There is no way to link the side and the back yard without a zoning variance to allow building closer to Midlothian Avenue. Notice that the width of the link is minimized (only 3ft) so as to stay as far away as possible from the lot line. Our solution (moving the entrance to the southwest side) lessens the danger now posed by the close proximity of existing entrance to the right-of-way. It is also a solution that requests the • least possible relief and allows the owner to enjoy this more pleasant configuration of his property. Owner is requesting the least possible variance.
