No. 4946 — LEONARD TIRADO 1000-111-8-1 Location of Property: 3850 Nassau Point Road, Cutchogue Date of Public Hearing: April 5, 2001; April 19, 2001 Findings of Fact PROPERTY FACTS: Applicant's property is located at Nassau Point in Cutchogue, and has frontage along three streets: 92.06 along the east side of Wunneweta Road, 231.45 ft. along Menhaden Road, and 181.81 feet along the west side of Nassau Point Road in Cutchogue. The remaining depth is 205 feet along the southerly property line. The property is improved with a single-family, two-story dwelling, shown on the February 23, 1979 survey prepared by Roderick VanTuyl, P.C. BASIS OF REQUEST: Building Department's Amended Notice of Disapproval for the reason that under Article XXIII, Section 100-231-A, when a fence is located within the front yard of residential zones, the same shall not exceed four (4) feet in height. AREA VARIANCE RELIEF: The applicant proposes a fence at a height of six feet instead of four feet, for the purpose of screening the property and enclosing a proposed pool in a front yard area. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. An undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties because applicant is proposing a 6 ft. fence to enclose a pool in the front yard. 2. The benefit sought can be achieved by some method, feasible for the applicant to pursue other than an area variance. The town code only requires that a four ft. fence enclosing a pool be erected to meet the minimum safety and protection standards. 3. The area variance is substantial in that a six ft. fence in the front yard represents a 50% increase over the maximum four feet allowed by Town Code. 4. The difficulty has been self-created. No. 4946 — LEONARD TIRADO 1000-111-8-1 Location of Property: 3850 Nassau Point Road, Cutchogue Date of Public Hearing: April 5, 2001; April 19, 2001 Findings of Fact PROPERTY FACTS: Applicant's property is located at Nassau Point in Cutchogue, and has frontage along three streets: 92.06 along the east side of Wunneweta Road, 231.45 ft. along Menhaden Road, and 181.81 feet along the west side of Nassau Point Road in Cutchogue. The remaining depth is 205 feet along the southerly property line. The property is improved with a single-family, two-story dwelling, shown on the February 23, 1979 survey prepared by Roderick VanTuyl, P.C. BASIS OF REQUEST: Building Department's Amended Notice of Disapproval for the reason that under Article XXIII, Section 100-231-A, when a fence is located within the front yard of residential zones, the same shall not exceed four(4) feet in height. AREA VARIANCE RELIEF: The applicant proposes a fence at a height of six feet instead of four feet, for the purpose of screening the property and enclosing a proposed pool in a front yard area. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. An undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties because applicant is proposing a 6 ft. fence to enclose a pool in the front yard. 2. The benefit sought can be achieved by some method, feasible for the applicant to pursue other than an area variance. The town code only requires that a four ft. fence enclosing a pool be erected to meet the minimum safety and protection standards. 3. The area variance is substantial in that a six ft. fence in the front yard represents a 50% increase over the maximum four feet allowed by Town Code. 4. The difficulty has been self-created. Mr.Tirado has recently installed 6'high stockade fencing on the property line. This fencing exceeds 8'in some areas due to the method of installation. If this fencing were to continue down my driveway and borerline Wunneweta Road,I would be completely blocked from viewing traffic when I try to enter Wunneweta Road. Old Menhaden Road is also a popular right of way to vehicular traffic and also a popular right of way to the beach used by many of the children and families in the area. A 6' high fence would limit anyone walking to and from the beach to see oncoming traffic. As we all know,many of the cars go at a high rate of speed and this would create a very dangerous situation. The property on the opposite side of Old Menhaden has a similar situation to Mr.Tirado. The property borders Nassau Point Road,Old Menhaden and Wunneweta Road. This property also has a pool with a 4'fence. We have lived here 11 years and there hasn't been any incidents of children entering their pool area. I have attached a partial list of pools in the area that I have observed from walking around the neighborhood. All of these pools have a 4'high fence enclosing the immediate pool area with landscaping surrounding the fencing. The look is tastefull to the area while providing the owners privacy to the pool area. One of the pools is actually in the owners front yard and I have yet to hear of any dangerous situations occuring. Nassau Point is such a beautiful place to live. As you drive into the area,you are surrounded by natual woodlands. A 6'fence is totally out of character to the neighborhood and is totally unacceptable. It would not only create an eyesore but would create a dangerous situation at a busy right of way intersection. When we submitted our application to build our pool on our most western side of our lot (facing Wunneweta Rd.) we failed to recognized the dangerous situation the under aged pedestrian traffic will post to this pool. The permission from Z.B.A. to build this pool on our Wunneweta side of our lot has been favorable and a final and official decision will be confirmed we believed on March 15th. We still have to submit another survey depicting the exact side of the pool and position of the machinery servicing it. A 4" foot fence around the pool will not stop an under age kid/teenager from entering our lot and pool. This is too dangerous. The town has even placed a " CHILDREN AT PLAY " sign right on my lot (enclosed picture) and this attest to what we are saying. The Old Menhaden right-away circumventing my lot serves has access to the beach to about 50 homes; the pedestrian traffic is copious in the early spring and summers months. I am enclosing a survey of my lot where I have marked where the fence and access door would go. I truly hope you give the green light to this variance request.
