No. 4923 — FREDERICK VON ZUBEN Location of Property: 1125 North Sea Drive, Southold; 1000-54-4-13 Date of Public Hearing: April 5, 2001. FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: Applicant's property consists of 26,503 sq. ft. in area with 100 ft. frontage along the north side of North Sea Drive, Southold. The property is 269.36 ft. deep and extends to the mean high water line of the Long Island Sound as shown on the December 16, 1998 survey prepared by John T. Metzger, L.S. BASIS OF APPEAL: Article III, Section 100-33C, as noted in the Building Inspector's Notice of Disapproval dated January 3, 2001, denying an application dated October 27, 2000 for a permit to build an accessory storage building (one-car garage) with a setback at less than the code requirement of 40 feet from the front property line. RELIEF REQUESTED: Applicant requests a variance to locate a 300 sq. ft. accessory storage building (garage) at a minimum of 34 feet from the front property line. (No other variance relief is requested for the accessory building.) REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or be a detriment to nearby properties. Location of the proposed accessory garage is severely limited because the property is within an environmentally sensitive area, constrained by FEMA regulations on the waterfront, northwest part of the property, and within the Coastal Erosion Hazard area on the most southeast part of the property. Grant of a variance will permit the garage to be outside of the Coastal Erosion Hazard line and in compliance with FEMA regulations. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance because construction within the Coastal Erosion Hazard Area is prohibited, and without the variance, the owner would not be able to build the garage. 3. The area variance is not substantial and relates to the environmental limitations of the property and subsequent regulations restricting placement of structures on the property. 4. The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because the variance will permit the - • 'Page 2—April 5, 2001 ZBA Appl. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The house is located on Long Island Sound and the garage is to be located in the front yard. The Coastal Erosion Hazard Line is located on the property south of the proposed garage. The garage must be located outside of the Coastal Erosion Hazard area. 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance . If the variance is not granted then the owner can not build a garage on the property because the garage can not be constructed within the Coastal Erosion Hazard Area. 3 . The area variance is not substantial the application of the balancing test weighs in favor of the grant of the variance. The houses fronting Long Island Sound are severely limited in the degree of improvements due to the FEMA regulations, garages are permitted outside the Coastal Erosion Hazard line . The original plan was to place the garage without variances, however, the building department advised that this was not possible. 4 .. The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The proposed location of the garage is due to the physical and environmental conditions on the subject property and in order to comply with the Federal Flood Plain regulations . 5 . The alleged difficulty was not self-created. The conditions of the property, the location of the Coastal Erosion Hazard Line, create the difficulty. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . The building department believes that the Board approved the setback for 34 ' . When you review your file you will see that the board requested that we provided a properly revised survey (done by the surveyor) and architectural plans . On January 23 , 2001 I forwarded to the board a new survey and plans showing 33 ' front yard setback. The notice to neighbors and final survey showed 33 ' . The board, hearing no opposition and finding the request reasonable, granted the applicant what he requested and had shown on the final survey, however, it appears that when the decision was written the board did not refer to the surveyor' s final survey which had located the architectural plans, but to an older hand drawn survey. A building permit was obtained using the final survey, the surveyor staked his final survey at 33 ' . The foundation was installed at 33 ' , the building department noted the discrepancy and has stopped us from proceeding with the building permit . The building department has requested that we direct a letter to you for clarification or apply for a new variance . A new application will result in extreme hardship and delay to the owner. We would respectfully request that the board review the file. We would ask that you forward a letter to the building inspector which will permit us to continue the construction of the garage at 33 ' . Thank you for your assistance in this matter.
