No. 4959 — DENNIS and DESIREE O'CLAIRE PARCEL 1000-97-3-11.8 STREET & LOCALITY: 1492 Skunk Lane, Cutchogue DATE OF PUBLIC HEARING: June 7, 2001. FINDINGS OF FACT PROPERTY FACTS: Applicants' property consists of 2.445 acres reached by a right-of- way off Skunk Lane in Cutchogue. Construction of a single-family dwelling is nearing completion under Building Permit#26098. BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated April 30, 2001, denying an amendment to Building Permit #26098 because the proposed construction shows a third-story habitable space in violation of the 2-1/2 story limit set forth in the Code. AREA VARIANCE RELIEF REQUESTED: Applicants request a variance authorizing the configuration of the house, as built, with a 3rd floor"mezzanine" giving access to the attic and enabling roof skylights to give light down the stairwell to the first floor. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Applicants state that the house has been built in accordance with the plans submitted with the application for Building Permit #26098. The Building Permit authorizes a "2nd floor mezzanine," but at the time of the framing inspection the Building Inspector objected to the mezzanine. Applicants state that the Building Inspector considers the mezzanine to be 3rd story habitable space in violation of the Code. (2) The house has two full floors of living space and an attic under the peaked roof. At the center of the house, a staircase runs to the second floor and then to a landing at the attic level. This landing, containing 166 sq. ft., is the"mezzanine"at issue. Access to the attic is through a door on the mezzanine. The staircase and mezzanine are centered under the peak of the roof. Skylights in the roof provide light down the stairs to the first floor. (3) The Code authorizes 2-1/2 stories in residences. A half story is defined as a space within the roof framing, no more than 50% of which has a ceiling height of more than 7'6"; the minimum ceiling height is 5 feet. 4 •Page 2—June 7, 2001 Appl. No. 4959—D. O'Clair 1000-97-3-11.8 at Cutchogue (4) The mezzanine has a maximum ceiling height of 11 feet under the peak of the roof. The ceiling height declines in both directions from the peak, to a minimum of 4'8" at the easterly wall of the mezzanine and 8'5" at the westerly wall. The average ceiling height is 7'10". It appears from the plans that approximately 59% of the mezzanine space has a ceiling height of more than 7'6" whereas the Code allows no more than 50%. (5) The mezzanine could be brought largely into compliance with the Code by construction of a ceiling to reduce the percentage of the space having a ceiling height over 7'6". This would be purely technical compliance that would not change the nature of the mezzanine but would seriously compromise the architectural plan. The minimum height at the easterly wall, at 4'8", would still be less than the required 5 feet. The deviation of the mezzanine from the Code's parameters for a half story are not substantial. (6) Grant of the requested variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties because it will have no effect on the appearance or use of the dwelling and will authorize only a small landing that is not suited to habitation. (7) There is no evidence that grant of the requested variance will have an adverse effect or impact on physical or environmental conditions. (8) The action set forth below is the minimum necessary and adequate to enable applicants to complete their house as planned while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION: On motion by Member Collins, seconded by Member Dinizio, it was RESOLVED, to GRANT the variance applied for, subject to the CONDITION that the mezzanine space shall under no circumstances be used for sleeping. (7) There is no evidence that grant of the requested variance will have an adverse effect or impact on physical or environmental conditions. (8) The action set forth below is the minimum necessary and adequate to enable applicants to' complete their forth, as planned while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. The mezzanine in question was designed to allow light into the stair well and the second floor landing. It also allows us to access the attic. Since this variance only concerns the interior of the house, it will not adversely effect the neighborhood or the community in any way. We have been trying for months to resolve this issue with the building department. The house is near completion but we cannot be granted a CO until this issue is resolved. This delay has caused enormous stress, financial difficulties and major inconveniences. If we are denied the variance and forced to conform we will endure additional delays and financial difficulties.` We would also be destroying the architectural and design aesthetics of the 2nd and 3rd floor interiors. For these reasons, we respectfully request the minimum variance that would enable us to keep the mezzanine as it has been constructed. Following is a chronological summary of our project as it relates to the mezzanine: At the framing inspection, the building inspector objected to the size of the mezzanine. It was at this point that I first became aware that there was a problem with the mezzanine. After further discussion with the building department and with the NYS Codes Division Regional Architect, Richard Smith, my GC, Mr. David McClure and I developed a proposal which would bring the mezzanine into code without affecting the aesthetics of the 2nd and 3rd floors. On March 9, 2001 we presented this proposal to Mr. Michael Verity of the building Department. Mr. Verity suggested that instead of executing our proposal to conform, we should schedule an on site visit with Richard Smith and seek a variance from NYS. On March 30 Mr. Smith and Mr. Verity visited the site. Also, present was Mr. McClure, my wife Desiree and Craig Arms, the design professional who drew the plans. At that visit there was discussion about various aspects of the space, including egress, fire & smoke detection and intended use. All of Mr. Smith's concerns were addressed and he stated 7. that he could approve a routine variance after checking with Albany. At this point Mr. Verity also stated that he did not have any problems with the space as it was constructed. On March 17, Mr. Smith told me in a telephone conversation that everything was fine and that he was filing a routine variance for us. That variance has been filed with the state (petition #:2001-0018). On March 18, Mr. Verity, spoke to Mr. Smith about the variance that had been filed on our behalf. Later that same day, Mr. Verity informed me that although the state was granting us a variance, the Town of Southold did not allow 3rd story habitable space and that we would probably have to apply for a variance with the Town of Southold. Eventually, I was told that I would be receiving a Notice of Disapproval and that I would have to apply for a variance before the Board of Appeals. Thank you for your time and consideration. The Notice will be published in the next issue of the Suffolk Times. Pursuant to Chapter 58 of the Southold Town Code (copy enclosed , formal notice of your application and hearing must be now mailed with a map or sketch showing the construction area or variance being considered. Send the enclosed Notice CERTIFIED MAIL, RETURN RECEIPT REQUESTED, on Tuesday, May 29th, or sooner, including a copy of a map showing your project • area, to all owners of land (vacant or improved) surrounding yours, includi h g land across any street or right-of-way that borders your property. Use the current addresses shown on the assessment rolls maintained by the Town Assessors' Office (765-1937) or the County Real Property Office in Riverhead. If you know of another address for a neighbor, you may want o send the notice to that address as well. When picking up the sign, a $15 check will be requested for each metal stand as a deposit. If you already have a sign and stand and only need the laminated printout for the face of the sign, an additional deposit is not necessary and we can mail or fax it to you. Please post the Town's official poster/sign no later than May 31, 2001. Securely place the signlon your property facing the street, no more than 10 feet from the front property line bordering the street. (If you border more than one street or roadway, an extra sign is furnished for each front yard.) The sign(s) must remain in place for at least seven (7) days, and should remain posted through the day of the hearing. If you need a replacement sign, please contact us.
