FINDINGS OF FACT
PROPERTY FACTS: The subject lots are identified on the Suffolk County Tax Map as 1000-
10-1-9 ("Lot 9") and 1000-10-1-10 ("Lot 10"). They have narrow frontages on West Creek
Avenue, Cutchogue, and share a common boundary of more than 300 feet from the street to
Wickham Creek. The application states that each lot is 0.75 acre. Lot 9 is improved with a
small house. Lot 10 is vacant.
BASIS OF APPLICANT'S REQUEST: Building Inspector's Notice of Disapproval dated
September 22, 2000 denying a permit to build a house on Lot 10 for the reason that it has
merged with Lot 9 pursuant to Code section 100-25A.
REQUEST BY APPLICANT: Applicant requests waiver of merger of Lot 10 with Lot 9
pursuant to Code Section 100-26.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony
presented, materials submitted and personal inspection, the Board makes the following
findings:
(1) Lots 9 and 10, and other properties, were acquired by John Pollock in 1926. in
1952, he conveyed Lots 9 and 10 to his wife, Eleanor. In 1962, Eleanor conveyed Lot 9 to
her stepson, Millard Pollock, and his wife, Jean. Eleanor died in 1991 and her will left Lot 10
to Millard and Jean. As a result of this bequest, Lots 9 and 10, both of which are
nonconforming, came into common ownership and merged in accordance with Code
section 100-25A. The two lots are now held by a Pollock family trust.
(2) Applicant's representative testified that Millard and Jean Pollock have never been
other than summer residents of Southold Town and that Eleanor Pollock's estate was
handled by an attorney unfamiliar with the Town Code's merger provisions. Applicant has
received separate tax bills for Lots 9 and 10 and was unaware of the merger. Applicant now
wishes to convey Lots 9 and 10 to separate family members, and wishes to ensure that Lot
10 will be legally buildable in the future.
(3) Lots 9 and 10 are among the larger lots on the nearby portion of West Creek
Avenue, and waiver of merger will recognize lots that are consistent in size with properties
in the neighborhood.

(4) Waiver of merger will not result in a significant increase in the density of the
neighborhood because it will, at most, allow the construction of one additional house.
Construction on Lot 10 would not require significant change in the natural details of the
land.
(5) Waiver of merger will allow applicant to carry out an agreed family plan of asset
distribution, including transfer of Lots 9 and 10 to separate family members. Inability to
make these transfers would constitute an economic hardship for the paries involved.
RESOLUTION/ACTION: On motion by Member Collins, seconded by Member Dinizio, it was
RESOLVED, to GRANT the requested waiver of merger of Lot 10 with Lot 9.
VOTE OF THE BOARD: AYES: Members Goehringer (Chairman), Dinizio, Tortora, Collins.
(Member Horning of Fishers Island was absent.) This Resolution was duly adopted(4-0).

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and Chapter 100 (Zoning),
Code of the Town of Southold, the following application will be heard at a public hearing by the
SOUTHOLD TOWN BOARD OF APPEALS at the Town Hall, 53095 Main Road, Southold, New York
11971, on THURSDAY, JANUARY 4, 2001, at the time noted below(or as soon thereafter as possible):
8:15 p.m. Appl. No. 4899—M. and J. POLLOCK. This is a request under Article ll, Section 100-
26 for a Lot Waiver of property referred to as District 1000, Section 110, Block 1, Lot 10,which property is merged
with an adjacent parcel known as 1000-110-1-9. A Notice of Disapproval (merger determination) was issued
September 22, 2000 by the Building Department for the reason that the lots have been held in common
ownership after July 1, 1983. Location of Property: 2700 and 2600 West Creek Avenue, Cutchogue, NY. Each
lot contains less than 40,000 sq. ft. of land area.
The Board of Appeals will at the above time and place hear all persons or their representative
desiring to be heard or to submit written statements (before the hearing is concluded). This hearing will

By deed dated July 2, 1926, J.M. Pollock(the father of Millard S. Pollock, one of the applicants herein)
purchased,approximately 3+ of waterfront property on West Creek Avenue in Cutchogue, NY. In 1952, the
property was deeded to Eleanor W. Pollock. In or about 1962, the 3+ acres was subdivided into three parcels:
(1) SCTM#1000-110-1-8 (Lot#8) comprising 1.6± acres with a one-story frame house and cabin,' (2) SCTM
#Jo00-110-1'-9�(Lot#9) comprising 0.75 acre with a "new bungalow," and(3) SCTM#1000-110-1-10 (Lot#10)
comprising 0.75 acre of vacant land. A copy of the 1962 survey and 1952 deed are annexed.
By deed dated January 27, 1962,Eleanor W. Pollock conveyed Lot#9 to her step-son Millard S.
Pollock and his wife Jean C. Pollock(the "Pollocks"). The "new bungalow" was and continues to be a seasonal
dwelling. In 1970, an addition was built to the "new bungalow." Certificates of Occupancy are on file for both
the "new bungalow" and the addition.
Lots#8 and#10 continued to be owned by Eleanor W. Pollock until her death on January 2, 1991.
Eleanor W. Pollock was a resident of Nassau County. An attorney in Williston Park handled the Probate
Proceeding and the conveyancing of the Southold real estate belonging to the decedent at her death.
By executor's deed dated August 31, 1994, Lot#10 was transferred to Millard S. Pollock and Jean C.
„ Pollock,
;By deed dated June 23, 1999, the Pollocks transferred Lots#9 and#10 to "THE POLLOCK FAMILY
TRUST, dated June 23, 1999, Millard S. Pollock and Jean C. Pollock, Trustees," Without the assistance of a
local attorney, Mr. Pollock prepared both deeds and caused them to be recorded in the Suffolk County Clerk's
Office.
Since 1994, the Pollocks have received two separate tax bills on the parcels.
When Lot#9 was transferred to the Pollocks in 1962,they were residents of Port Washington, NY. In
j or about 1989, the Pollocks retired to Salem, South Carolina. They have never resided in the Town of Southold.
Rather, they have always been summer residents. Prior to retirement, the Pollocks spent summer weekends at
the Cutchogue house; and, since retirement, they have spent only the months of July and August at the "new
bungalow" in Cutchogue:
For estate planning reasons, the Pollocks wish to transfer Lot#10 to his sister Karen L. Pollock pursuant
to a family agreement. Karen L. Pollock owns Lot#8 and does not intend to build on Lot#10. The Pollocks
also wish to transfer Lot#9 to their daughter.
MERGER ANALYSIS:
Both Lot#9 and Lot#10 are 0,75 of an acre and,therefore, nonconforming lots under the Town Code.
The southern boundary of Lot#9 abuts Lot#10 a course of 363.43 ± feet. Lot#9 is improved and Lot#10 is
vacant.
The Pollocks got title to Lot#9 in 1962. By reason of the death of Eleanor W. Pollock and the transfer
of Lot#10 to the Pollocks in 1994, Lot#9 and Lot#10 merged,
Pursuant to §100-25, the non-conforming Lot#9 merged with the adjacent(i.e., sharing a common
course of 50 feet or more)non-conforming vacant Lot#10 because:
1. both lots have an area of less than 40,000 square feet; or
2. there is no ZBA lot size variance; or
3, the lots were held in common ownership subsequent to August 31, 1994; or
4. the lots are not on the maps described in former §100-12; or
5. each lot is not currently developed(only Lot#9 is developed).
I APPLICANT'S REASONS
After the death of Eleanor W. Pollock in January 1991, Lot#8 was transferred by executor's deed
dated August 31, 1994 to Karen L. Pollock, who continues to own the parcel. Lot#8 is not the subject of this
application.

It appears that the above-referenced lots have merged under Town Code §100-25.
Accordingly, enclosed please find Application for Building Permit and check#1112 in the
amount of$25.00. Also enclosed are copies of(a) the property cards, (b) the current deeds to
the two parcels, (c) the tax snap, (d) the surveys, (e) my clients' authorization, and (f) a single
and separate search prepared by Commonwealth Land Title Insurance Company insuring the
Town in the amount of$25,000.00.
Pursuant to §100-25, the cion-conforming house lot merged with the adjacent (i.e.,
sharing a common course of 50 feet or more) non-conforming vacant lot because:
1. the both lots have an area 6f less than 40,000 square feet; or
2. there is no ZBA lot size variance; or
3. the lots were held in common ownership since August 31, 1994; or
4. the lots are not on the maps described in former §100-12; or
5. each lot is not currently developed (only the house lot is developed).
Because the owners wish to preserve the parcels as two separate lots, this is an
application for a Notice of Disapproval so that the owners may proceed to obtain a Waiver of
Merger from the Zoning Board of Appeals. If you have any questions, I will be liappy to talk
with you about this enclosed application.

West Creek Avenue between Midwood Road (a/k/a Lone Pine Road) and West Road is almost fully
developed with only three lots being vacant(that is, lots#7.12, #11 and the subject#10). Lots#9 and#10 as
individual lots are among the largest on the street. Only Lots#4,,#5, #7.3, #8 and#12 in Section 1 and Lots#4,
#7, and#8 in Section 2 are larger than 0.75 of an acre. Accordingly, a waiver would not result in a significant
increase in the density of the neighborhood and would recognize a lot that is consistent with the size of lots in the
neighborhood.
Inasmuch as the Pollock family does not intend to build on Lot#10, it is not envisioned that there will be
any significant change or alteration of the natural details and character of the contours and slopes of the lot.
There would be no substantial filling of land affecting nearby environmental or flood areas.
Even if Lot#10 were eventually improved, the existence of the house on the premises would not have a
detrimental impact on the neighborhood. The neighborhood is almost fully developed with mostly year-round
houses and only a few summer homes. Also,just 50' feet away on the south side of Lot#11 is Cutchogue
Harbor Marina with its parking lots, purported marine workshop/storage building, laundry/bathroom building,
garage with apartments, store, gasoline dock, docks and floats.
The merger was wholly inadvertent. The 1994 transfer of Lot#10 was handled by a Nassau County
attorney who presumably is not familiar with the Southold Town Code. The 1999 transfers of the two parcels
into THE POLLOCK FAMILY TRUST were handled by Mr. Pollock without the assistance of an attorney.
Although the Pollock family has owned property in the Town of Southold since 1926, they are not
versed in the complexities and implications of Southold's current merger law or its prior single-and-separate law.
Particularly in light of their annual receipt of two tax bills, it never occurred to them that the parcels could have
merged into one parcel. Now, they are unable to convey Lot#10 to Mr. Pollock's sister as had been agreed by
the family.

Code of the Town of Southold, the following application will be heard at a public hearing by the
SOUTHOLD TOWN BOARD OF APPEALS at the Town Hall, 53095 Main Road, Southold, New York
