STREET & LOCATION: 53800-A Main Road, Southold 1000-61-4-7.2 DATE OF PUBLIC HEARING: December 13, 2001 FINDINGS OF FACT PROPERTY FACTS: The subject property is a 10-foot-wide commercial building on Main Road in Southold. The ground floor is occupied by the applicant business, a gallery, and home furnishings store. BASIS OF APPEAL: Building Department's Notice of Disapproval, dated October 10, 2001, denying a permit for an as built wall sign because it is 43 inches in diameter, in violation of the 36 inch limit in Code section 100-205(N)(5). AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance authorizing the as built round wall sign, 43 inches in diameter. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. In preparation for opening his business early in 2001, Lynn Curlee, owner of the business, applied to the Building Department for a sign permit. He testified that a Building Department staff member assisted him in completing the application and advised that, because the building is 10 feet wide, the Code permitted a sign up to 10 sq. ft. in area. There is a notation to this effect on the application papers. Mr. Curlee understood that his application had been verbally approved. 2. The applicant testified that the sign was made 43 inches in diameter, which gives it an area of 10 sq. ft. It was attached to the building some months ago. In September, the Building Department advised that the permit application had not been processed, and on October 10 the Notice of Disapproval was issued. 3. Code section 100-205(N) sets forth the requirements for wall signs. Paragraph 3 states the size limitation of one sq. ft. per horizontal foot of exterior wall. Paragraph 5 states that the sign may not exceed three feet in height. When Mr. Curlee applied for a permit, he was advised of the provisions of paragraph 3 Page 2— December 13, 2001 Appl. No. 5036— Prime Gallery 1000-61-4-7.1 at Southold but not of paragraph 5. He believed in good faith that his sign complied with section 100-205(N). 4. The sign is unobtrusive and its presence will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. Requiring its replacement would impose an excessive burden on applicant. There is no evidence that grant of the requested variance will have an adverse effect or impact on physical or environmental conditions. 5. Grant of the requested variance is the minimum action necessary to enable applicant to enjoy the benefit of a business sign constructed and installed in good faith while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION: On motion by Member Collins, seconded by Member Homing, it was RESOLVED, to GRANT the requested variance. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. I consulted with the gentleman in charge of that activity in the Building Department. Unfortunately I do not remember his name. - He helped me with the application, which i filled out in front of him. - He told me that the circular sign which I designed could have a diameter of 44 inches, by applying a formula based on the total width of my storefront,which is 10 feet. He actually took out a calculator and did some figuring to come up with a diameter of 44 inches. On my sketch I had proposed a sign 46 inches in diameter, so together we changed the number to 44. (I actually made the sign 43 inches,to err on the side of caution.) - I wrote a check for$50 to the Town of Southold. - He told me that I had provided ail the information necessary,that my application would be approved, and that I could proceed with my sign. - In the excitement of opening a new business I never noticed that the actual permit document never arrived. I had been given a verbal go-ahead, and I genuinely thought that I had fulfilled my responsibility to the Building Department. - On September 25, EIGHT(!) months later, I was very surprised to hear from the Building Department that not only had my application never even been processed, but that my sign was 7 inches too tall ! I would like to request a variance for my sign. It is quite modest and tasteful, and my shop is a genuine asset to the shopping district of the hamlet. I tried to follow the rules, and I DID follow them as the representative of the Building Department explained them to me at the time. He told me what I could do and watched as I filled out the application. He told me to proceed. If he had told me that there was a 36 inch height limit,then that's how I would have made the sign. I also respectfully request that since the mistake was made on the part of the Building Department, my fee for this variance application be waived. The basis of the variance application is the August 26, 1994 Notice - of Disapproval, in which applicant applied for a building permit to renovate a nonconforming single-family dwelling structure, and which was disapproved on the following grounds: ...Under Article IX, Section 100-92, 60,000 sq. ft. of land area required for 3 uses in an HB District. Action required by the Zoning Board of Appeals.... The August 26, 1994 Notice of Disapproval showed corrections to the August 9, 1994 Notice of Disapproval which disapproved the same application on the following grounds: XXIV, Sections 100-241 and 100-243 A nonconforming building with a nonconforming use shall not be enlarged, altered, extended, reconstructed or restored. Action required by the Zoning Board of Appeals... . The August 26, 1994 Notice of Disapproval reflected the fact that a dwelling use is conforming in the HB Hamlet Business Zone District, however, 20,000 sq. ft. of land area was required for each principal use. The August 9, 1994 Notice of Disapproval' reflected that a dwelling was a nonconforming use in the HB Hamlet Business Zone, which was incorrect. CONCLUSION 9. Based on all of the above, the Board finds: a) it is personal knowledge of Board Members that the rear building had previously been occupied has a single-family dwelling unit, together with a retail store and a single practitioner's office area as noted in the Certificate of Occupancy for preexisting buildings; b) the same livable floor area will again be occupied as a dwelling unit without an increase in floor area or size, and that the owners are renovating and improving the building without removal or demolition; c) the property has several nonconformities: nonconforming and inadequate on-site parking although a municipal parking area is nearby, nonconforming setbacks, multiple-uses on a nonconforming lot, excessive lot coverage, all of which restricts any expansion, major alterations, conversions, etc. - Page 13 - Minutes Appeal No. 4266 - MICHAEL LIEGEY Decision Rendered September 7, 1994 10. In considering all the above, the Board also finds: • (a) that the essential character of the neighborhood will remain the same, without adverse change; (b) that the relief as requested is the minimum necessary to afford relief under the circumstances; (c) the difficulties claimed are uniquely related to the land in that the uses were preexisting, and the changes in ownership and unintentional abandonment of the residential unit triggered the requirement for an area variance; (d) that there is no alternative available which is feasible for appellants to pursue; (e)• in considering all of• 'the above factors, the interests Of justice will be served by granting alternative relief, as conditionally noted below. And Mr. Bussey lived in the house next to it which was also back, and that left him a little bit out in the sticks, so he had to add on to the front of his house, which now makes the brick front of the Bussey building which is owned by Andrew Krupski.
