No. 4876 —Gordon and Madeleine Schlaefer Location of Property: 47025 C.R. 48 (a/k/a Middle Road), Southold 1000-55-2-23 Date of Public Hearing: November 16, 2000; December 7, 2000; February 27, 2001. Findings of Fact PROPERTY FACTS: The subject property is a parcel of 22,940 sq. ft. with about 160 feet of frontage on CR 48 in Southold, and a depth of 150 feet. It is improved with a frame building used as a furniture and home furnishings shop. BASIS OF APPEAL: Building Inspector's Notice of Disapproval, dated September 14, 2000, denying a permit to build an addition because the addition would increase the building frontage on CR 48 from 49 feet to 103 feet, in violation of Code section 100-103C, which limits building frontage in the General Business zone to 60 feet on one street. AREA VARIANCE RELIEF REQUESTED: Applicants request a variance authorizing the addition as proposed, which would extend the building by 54 feet to the East, for a total width of 103 feet. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Applicants, who own the furniture shop, stated that the current space is very crowded and that the future of the business requires expansion. They stated that the nature of their business mandates that operations be under one roof in order that customers may move easily among the merchandise displays, and that breaking the facility up into separate buildings would be not only impractical but also uneconomical in terms of staffing requirements. (2) The shape of the property is such that an addition to the East is the only feasible way to expand. (3) The subject property is located on a busy segment of CR 48, with several large business structures nearby. Applicants' proposed addition constitutes the expansion of a single business under one roof and not the establishment of a multi-business facility, and grant of the requested variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (4) The Board expressed concern about the flow of traffic, particularly emergency vehicles, onto and within the property. In response, applicants' attorney on March 5, 2001, submitted a site plan dated February 28 that shows an emergency vehicle access lane on the East side of the property from the rear of the property to CR 48. Schlaefer 1006-55-2-23 at Southold (5) There is no evidence that grant of the requested variance will have an adverse effect or impact on physical or environmental conditions. (6) The action set forth below is the minimum necessary and adequate to enable applicants to build an addition to accommodate their business while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION: On motion by Member Collins, seconded by Member Dinizio, it was RESOLVED, to GRANT a variance authorizing a 54-foot Eastward expansion of the existing building, subject to the following CONDITIONS: (1) An emergency vehicle access lane of a minimum 15-foot width shall be provided as set forth in the site plan dated February 28, 2001; and (2) Applicants shall ensure to the best of their ability that vehicles do not back out from the property onto CR 48. SEQR Negative Declaration - Page Two The applicant has secured a width variance from the Board of Appeals. An Environmental Assessment Form has been submitted and reviewed, and it was determined that no significant adverse effects to the environment were likely to occur should the project be implemented as planned. There has not been any correspondence received from the Department of Health Service in the allotted time. Therefore, it is assumed that there are no comments or objections from that agency. There has not been any correspondence received from the New York State Department of Environmental Conservation in the allotted time. Therefore, it is assumed that there are no comments or objections from that agency. The applicant will have to comply with the requirements of the Suffolk County Sanitary Code (SCSC) and all relevant standards of water supply and sewage disposal systems. Design and flow specification, subsurface soil conditions and site plan details will have to be approved by the Suffolk County Department of Health Services (SCDHS). This impact is not considered significant due to the anticipated project compliance with established requirements of the SCSC and the SCDHS and the required relevant permits. The 1670 House frontage now occupies 82 %of the maximum allowed width of 60'. This appeal to widen it to 103' or 72 %over the maximum width of 60' goes against the Southold Town Board's plan to keep the area along Route 48 with more open space. As a result of this plan our lot directly across Route 48 was up zoned from Business to Home Office. At the November 7th, 2000 hearing the 1670 House legal council announced to us that we could put up a building that was wider then 103'. This statement is irrelevant because our lot has a frontage of approximately 310' on Route 48 and the 1670 House has a frontage of only 157'. We stated at that time that we doubted a trailer truck could navigate into and out of the unloading area behind the building. The new site plan dated 1-10-01 shows a 2' to 4' wider driveway to the rear of the building. It also shows a loading area for an existing 8' x 23' box truck. We are strongly opposed to the approval of this variance! Last year our lot was up zoned from Business District to Residential Office District by the Southold Town Board to help keep more open space around the County Route 48 area. The 1670 House is now a very attractive place. The additions added by the former owner,Mrs. Doebler did not take away from the attractiveness of the house. With this addition it would no longer be a charming old house. Increasing the frontage of this house of 49' to a 103' building would go completely against the rural area the town is trying to keep. On a note of safety: Trailer trucks make most deliveries of furniture to 1670 House. They now come eastbound,pull off on the south side of C.R. 48,then back across 2 lanes of traffic into a large parking area. Looking at the new site plans we doubt if a trailer truck could navigate into the drive areas to unload. We wish to keep the area rural. The Board is not in favor of a variance for this proposed 54' wide addition. This addition plus the existing 49' wide building will result in a proposed building with a total width of 103'. The maximum width of 60' was placed in the General Business Zone to reduce the mass of the frontage facing the street and to prevent strip development from expanding along major traffic arteries. The Board recommended that a second building be considered with architecture that is compatible with the historic 1670 house. The applicant has not shown that a second building that would not destroy the historical integrity of the 1670 house could not meet their needs. A previous plan approved in 1986 was never built and has expired.
