No. 5023- NORTH FORK COUNTRY CLUB 1000-109-3-8.1 STREET & LOCATION': 300 Linden Avenue (a/k/a Moore's Lane), Cutchogue DATE OF PUBLIC HEARING: November 15, 2001; November 29, 2001; December 13, 2001. PROPERTY FACTS: The subject parcel is an irregularly shaped lot of 38,067 sq. ft in Cutchogue with 297 feet of frontage on Linden Avenue (a/k/a Moore's Lane) and about 46 feet on Main Road. It is improved with a one-story masonry building used for equipment storage and support services. Pursuant to Building Permit 27135, issued March 8, 2001, an one-story addition to the west side of that building, measuring 90 feet long and 28 feet deep, has been built and is near completion. The remainder of applicant's land, comprising about 100 acres,lies east of the subject parcel across Linden Avenue (Moore's Lane). BASIS OF APPEAL: Building Department Notice of Disapproval, dated September 7, 2001, denying the Building Permit for the as-built structure because: (1) it is 22.7 feet from the rear (westerly) lot line whereas 50 feet are required; (2) it is 96 feet from Main Road whereas 100 feet are required; (3) it brings lot coverage to 21% whereas 20% is permitted; (4) the lot comprises less than the required 3 acres. AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance authorizing the as-built structure. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. Applicant has owned the existing building for many years and has used it as well as the open space to its west for storage of grounds-keeping equipment The addition in question is intended to provide additional indoor storage. It is nearly complete and requiring its removal would place a substantial burden on applicant. 2. Only a narrow arm of the subject property reaches to Main Road, and that arm is abutted on the east by a real estate office and on the west by residential property. The shortfall of four feet from the required 100-foot setback from Main Road has essentially no,visual effect. ' Page 2—December 13, 20eyr" Appl. The proposed lot coverage of 20.8% is only very slightly greater than the allowed 20%, and the excess coverage has essentially no visual effect. 4. The subject;,property, while less than an acre, is part of a country club whose total land covers about 100 acres. In this context, the structure in question is effectively located on a parcel of much more than 3 acres. 5. The property immediately to the west is improved with a one-family house that is only 3 feet from its border with the applicant's property, and thus only about 25 feet from the structure in question. At present there is no shrubbery or fencing along this line to buffer the neighbor's exposure to the applicant's building and related activity. The Board believes that in this case, such buffering is an important element in protecting the well-being of the neighborhood: 6. The addition under construction has 4'large'doors along its west wall, facing the neighboring property to the west. The Board agrees with the neighbor that limiting such doors to the southerly portion of applicant's building will benefit the neighbor by substantially reducing the volume of equipment traffic on applicant's land closest to the neighbor's house. 7. For the reasons discussed above, the action set forth below will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. There is no evidence that the action set forth below will have an adverse effect or impact on physical or environmental conditions. 8. Grant of the relief set forth below is the minimum action necessary to enable applicant to enjoy the benefit of an expanded storage structure while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION: On motion by Member Dinizio, seconded by Member Collins, it was RESOLVED, to GRANT a variance authorizing the 90x28-foot addition in question, as originally permitted by Building Permit 27135, in the as-built location, subject to the following CONDITIONS: 1. The northerly two garage doors on the west side of the subject addition shall be permanently closed and not used. The southerly two doors may be used. trTh Page 3—December 13, 26\7,r1 Appl. Grounds-keeping equipment and the like shall not be parked on the open ground west of the subject building except for short periods while equipment is being moved. 4. No later than June 30, 2002, applicant shall deliver to this Board, for its records, a plan of landscaping and fencing agreed to by the owner of the property immediately west of the subject building (SCTM7000-109-3-3). Such plan shall be created and carried out at the expense of applicant, and applicant shall continuously maintain any shrubbery and fencing described in the plan. This Board reserves the right to reopen this case if such plan is not filed by the specified date(or a later date agreed to by the Board). No. 5023*North Fork Country Club Dear Mr. Chairman and Members of the Board: I had the opportunity to review the landscaping proposal, which has been submitted to you by the North Fork Country Club,and have discussed the same with my clients and with the applicant's attorney. • While Wa appreciate the effort by the applicant to address some of our concerns,the proposed landscaping plan does not solve the problem.As the building addition is presently constituted, it has four large overhead garage doors along Its westerly wall.'This wall is located approxdr'nately 22 feet from my clients'property line despite the Town Code requirement of a 50 foot setback.When the country dub uses these overhead doors for ingress and egress to the building,the equipment has to be operated virtually along the said property line in order to get in or out. My clients understand the position of the country dub that sealing off all four doors along the westerly side of the addition would make it difficult to move the equipment around inside the building. In an effort to compromise and resolve this matter, my clients would be willing to allow the two most southerly overhead doors along the westerly wall of the addition to remain,if the applicant would agree to permanently seal off the two most northerly overhead doors.This should allow adequate access to and from the addition,while shielding my clients'property from the adverse effects of having the active use of the other two doors located so very near to their house.This will mitigate the noise,odor,dust and visual problems associated with the building addition,while providing the applicant with three overhead garage doors for ingress and egress to the building addition(the two most southerly doors in the west wall and the door in the south wall of the addition). This proposal is made in a good faith attempt to address both parties'concerns and the difficulties arising from a building permit that was obviously issued in error. It is respectfully submitted that each side should be either willing to voluntarily compromise their position,or a decision by this Board should reach the same result. In order to be granted the requested very substantial variance,the burden is on the applicant to minimize the adverse effects that the building addition,which is in clear violation of the Southold Town Code, has upon neighboring properties.The applicant should not be heard to complain that the permanent sealing of the two most northerly overt- ;d garage doors would cause some degree of inconvenience in the use of 1112912001 13:56 6317651856 KEVIN MCLAUGHLIN PAGE 02 y- said addition and the movement of equipment and machinery within the building. The North Fork Country Club opted to locate the addition In such a position extremely neer the house located on my clients' property.The applicant could easily have located the building addition in the southerly portion of their property,and in fact apparently considered doing just that,as is dearly shown on the enclosed survey of John C. Ehlers dated August 12, 1999,which was submitted by the country dub to obtain the building permit herein. That survey shows the proposed building being located in the southerly portion of the applicant's property, but has been crossed out and the present location of the addition has been hand drawn thereon.The country dub must bear some responsibility for effectively lessening the impact on the Surozenskis' property of their very substantial building addition located within 22 feet of the property line and in extreme proximity to the Surozenakis'existing residence.The proposal of the Surozenakis is a fair balancing of the needs of the applicant to the use of an existing addition built in violation of the Southold Town Zoning Ordinance with the adverse impacts of said addition, end the use thereof,on their neighbors. In addition, my clients would like to see the plantings along the property line,together with any fencing,located entirely within the property of the North Fork Country Club.-Particularly by the house located on my clients' property, any plantings or fence on the property line would be virtually on top of said house A requirement that any fencing or planting should be located entirely on the applicant's property should be imposed.The location of any such planting should consider the future growth thereof,and be setback from the property line accordingly. Finally, my clients are very concerned about the continuing outside storage of machinery and equipment on the North Fork Country Club property in,violation of Southold Town Code Section 236.The country club routinely stores machinery and equipment on their premises,and often very dose to the Surozenakis'property line.Any variance granted to the applicant should be conditioned upon the applicant's compliance with this setback requirement. While my clients are interested in amicably resolving the problems associated with the present location of the 90 foot by 28 foot addition,they are adamant that the impact of said addition on the use and enjoyment of their adjoining property be minimized,The mere planting of a few trees and a fence along the parties'mutual property lin= does not accomplish that result,and leaves my clients bearing the entire burden of a large addition being constructed in violation of the clear setback requirements of the Southold Town Zo ,mAx. No. 5023 — NORTH FORK COUNTRY CLUB 1000-109-3-8.1 STREET & LOCATION: 300 Linden Avenue (a/k/a Moore's Lane), Cutchogue DATE OF PUBLIC HEARING: November 15, 2001; November 29, 2001; December 13, 2001. PROPERTY FACTS: The subject parcel is an irregularly shaped lot of 38,067 sq. ft. in Cutchogue with 297 feet of frontage on Linden Avenue (a/k/a Moore's Lane) and about 46 feet on Main Road. It is improved with a one-story masonry building used for equipment storage and support services. Pursuant to Building Permit 27135, issued March 8, 2001, an one-story addition to the west side of that building, measuring 90 feet long and 28 feet deep,' has been built and is near completion. The remainder of applicant's land, comprising about 100 acres, lies east of the subject parcel across Linden Avenue (Moore's Lane). BASIS OF APPEAL: Building Department Notice of Disapproval, dated September 7, 2001, denying the Building Permit for the as-built structure because: (1) it is 22.7 feet from the rear (westerly) lot line whereas 50 feet are required; (2) it is 96 feet from Main Road whereas 100 feet are required; (3) it brings lot coverage to 21% whereas 20% is permitted; (4) the lot comprises less than the required 3 acres. AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance authorizing the as-built structure. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: _ 1. Applicant has owned the existing building for many years and has used it as well as the open space to its west for storage of grounds-keeping equipment. The addition in question is intended to provide additional indoor storage. It is nearly complete and requiring its removal would place a substantial burden on applicant. 2. Only a narrow arm of the subject property reaches to Main Road, and that arm is abutted on the east by a real estate office and on the west by residential property. The shortfall of four feet from the required 100-foot setback from Main Road has essentially no visual effect. Page 2—December 13, ?u01 Appl. The proposed lot coverage of 20.8% is only very slightly greater than the allowed 20%, and the excess coverage has essentially no visual effect. 4. The subject property, while less than an acre, is part of a country club whose total land covers about 100 acres. In this context, the structure in question is effectively located on a parcel of much more than 3 acres. 5. The property immediately to the west is improved with a one-family house that is only 3 feet from its border with the applicant's property, and thus only about 25 feet from the structure in question. At present there is no shrubbery or fencing along this line to buffer the neighbor's exposure to the applicant's building and related activity. The Board believes that in this case, such buffering is an important element in protecting the well-being of the neighborhood. 6. The addition under construction has 4 large doors along its west wall, facing the neighboring property to the west. The Board agrees with the neighbor that limiting such doors to the southerly portion of applicant's building will benefit the neighbor by substantially reducing the volume of equipment traffic on applicant's land closest to the neighbor's house. 7. For the reasons discussed above, the action set forth below will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. There is no evidence that the action set forth below will have an adverse effect or impact on physical or environmental conditions. 8. Grant of the relief set forth below is the minimum action necessary to enable applicant to enjoy the benefit of an expanded storage structure while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION: On motion by Member Dinizio, seconded by Member Collins, it was RESOLVED, to GRANT a variance authorizing the 90x28-foot addition in question, as originally permitted by Building Permit 27135, in the as-built location, subject to the following CONDITIONS: 1. This Board reserves the right to reopen this case if such plan is not filed by the specified date (or a later date agreed to by the Board). No. 5023—North Fork Country Club Dear Chairman Goehringer and Members of the Board: Please be advised that I represent Richie and Sharon Surozenski, the owners of premises immediately to the west of the subject parcel owned by the North Fork Country Club. The applicant comes before you seeking three (3)separate variances, as follows:,1)a variance because the"as-built" building is located less than 50 feet from the rear lot line in violation of Article III, Section 100-31B(7)(a) of the Southold Town Code; 2)a variance because the building is located less than 100 feet from the Main Road in violation of Article II, Section 100-31 B(7)(a); and 3) a variance because the building addition exceeds 20% lot coverage limitation in violation of Article XXIV, Section 100-244B. Of particular impact to my clients is the location of the building addition in relation to their property,which adjoins the subject premises immediately to the west. My clients said property has been in Mrs. Surozenski's family for many years. The one-family residence located thereon has been in existence for'many years and was the residence of Mrs. Surozenski's mother until her death.The house is, and has always been, located very close to its easterly property line, since it was built; prior to the enactment of a zoning ordinance in the Town of Southold in 1957. As a result, the current location of the building addition is extremely detrimental to the use and enjoyment of the Surozenski parcel. Instead of being set back the minimum of 50 feet, as required by the Southold Town Zoning Ordinance, the structure as built is located only 22.7 feet from my clients' property. The applicant is now seeking a variance of approximately 58%. The addition is approximately 28 feet wide and 90 feet long. It is readily apparent to anyone who visits these premises that the large building addition being constructed by the North Fork Country Club will have an extremely damaging effect on the peaceful use and possession of my clients' property and the market value thereof. The addition virtually blocks the entire easterly view from the residence located on my clients' property and the immense size of said addition, and its proximity to said residence, cannot be fully appreciated without physically viewing the site. Of even greater concern, is the manner in which this situation arose. In 1999, my clients were approached by North Fork Country Club regarding the possibility of a property line change between the two parcels,whereby the North Fork Country Club would transfer the northerly half of lot 1000-109.00-03.00-004.000 in exchange for the southerly half of my clients property. The purpose of this transfer was to provide the country club with viable parcel on which to erect a storage barn for their equipment.When my clients hesitated, the North Fork Country Club sent them a letter dated February 19, 1999, a copy of which is enclosed herewith. In this letter, the applicant sets forth its vision of the uses of the two properties, and the eventual construction of a storage barn on their premises. In a thinly veiled threat, the letter stated: "Should we fail to achieve our objective detailed above, it is our intention to utilize the entire property we now own as storage and/or parking for club employees with a driveway entrance from Main Road.' (underlining added). From the very beginning, it was obvious that the North Fork Country Club intended to make use of its property in any manner it chose, without any regard to my clients' wishes if they did not accede to its demands. The Surozenskis consulted with me regarding the country club's demands, and I spoke with their attorney. I personally spoke with an attorney-member of the country club, and told him that my clients were offended by the tone of the letter and would not be bullied into complying with the demands of the country club. I also told him that what the country club was threatening to do, in the event,that my clients did not agree to the property line change, would be in violation of the Southold Town Zoning Ordinance. I indicated to him that whatever the country club intended to do with its property must be in compliance with the zoning ordinance. We discussed open storage of equipment and the requirements to comply with setbacks for any building erected thereon. Everyone was clear regarding the setback requirement of the zoning code in relation to buildings used in conjunction with a country club. After careful consideration, my clients decided not to agree to the property line change at that time. Approximately one year later, my clients changed their minds and contacted the country club to proceed with the property line change. They were told that the plans of the country club had changed, and it was no longer interested in the property line change. My clients live on Shelter Island, and have maintained the subject premises as rental property since the death of Mrs. Zurozenski's mother. In the spring of this year, on a visit to the premises, Mr. Zurozenski noticed the construction of a new building on the property of the country club. It was very apparent that this new building was being constructed in close proximity to his property. My client reviewed the relevant portion of the zoning ordinance; namely, Article III, Section 100-31 B(7)(a), and was immediately struck by the obvious fact that the new building was no where near the 50 foot set back requirement from the property line. He notified the Southold Town Building Department, which upon information and belief issued a stop work order, and the instant Notice of Disapproval. It is obvious that the applicant does not come before this Board with clean hands. When my clients initially declined to go along with the proposed lot line change, the North Fork Country Club, despite its agents being fully aware of the requirements of the Southold Town Zoning Ordinance, decided to build an addition to an existing storage building that would be virtually on top of the residence located on my clients property. To make matters even worse, they located the building in such a way that overhead doors faced west, directly toward my clients' property. In order to store large tractors and other equipment in the new storage building, the country club has to drive these vehicles virtually along the property line to gain access to the overhead doors. Moreover,the tractors and other machinery are often left running in the area between the new building and my clients' property line for long periods of time, resulting in loud, annoying noise and obnoxious odors permeating their property. It is interesting to note, that in its application for a building permit, North Fork Country Club submitted a survey dated August 12, 1999 from John C. Ehlers Land Surveyor showing a proposed concrete building located at the extreme southerly end of their property. A copy of said survey is enclosed herewith. This proposed building is crossed out and the proposed addition to the existing building, located virtually on top of the residence situate on my clients' property, was hand drawn onto the survey. Clearly, the country club thought about alternate locations for the subject building, but instead decided to construct the same in a location most detrimental to my clients' property, and in direct violation of the zoning ordinance. This was a deliberate and calculated decision in fulfillment of the threat contained in their letter to my client dated February 19, 1999 to"...utilize the entire property we now own as storage...." (underlining added). The country club not only did not take into consideration the concerns of my clients as adjoining property owners, they deliberately, illegally and immorally sited the building on their property, so as to maximize the deleterious impact on my clients' property. It is inconceivable to me how such a building application could possible have been approved for a building permit. The application, on its face, clearly did not comply with required minimum setbacks. The issuance of a building permit based upon the application of the country club is either a case of unbelievable negligence, or something worse. The applicant cannot rely on the issuance of an illegal building permit as a basis for the issuance of a variance. New York State case law is dear that the issuance of an illegal building permit does not give the holder of such a permit any vested right to complete the construction of the illegal structure,to obtain a certificate of occupancy for the building, or to obtain variances. This is particularly true in the instant case,where the country club was aware of the zoning requirements, yet chose to ignore the same,,and to construct their building in such a manner as to cause maximum detriment to my clients,who initially refused to go along with their plans. It is respectfully submitted,that the application of North Fork Country Club for variances herein should be denied in all respects, and that the applicant should be ordered to remove the building addition from its current location, and to comply with the zoning ordinance in all aspects in relocating the addition. In considering this application , the board has determined : (a ) the relief requested is unique ; (b) the relief requested is not substantial ; (c ) there will be no substantial adverse change to the character of this district; (d) the public health , welfare , comfort , convenience and safety of the town will be served by upholding this application; (e ) the spirit of the zoning ordinance will best be served by allowing the variances , as conditionally noted below. Accordingly , on motion by Mr . Goehringer , seconded by Mr . Sawicki , it was RESOLVED , that the relief requested under Appeal No . 3434 of the NORTH FORK COUNTRY CLUB for permission : (a ) to establish and continue existing and new parking area within 100 feet of . street line , and (b) to vary the number of parking spaces to 97 spaces plus the additional overlow parking area as shown by site plan dated November 14 , 1985 , BE AND HEREBY IS APPROVED SUBJECT TO THE FOLLOWING CONDITIONS : 1 . . That any division or separation of property from the . entire 34. 5± acres , which consists of parcels identified on the Suffolk County Tax Maps as District 1000 , Section 109 , Block 4 , Lots 1 , 3 , 4 , and 7 , will require application and approval by the Southold Town Planning Board , and well as an amended applica- tion for Special Exception approval by this Board ; 2 . There be no lighting obtrusive to neighboring properties ; 3. Screening shall be as shown on site plan dated November 14 , 1985 , and shall be continuously maintained at all times ; 4. The overflow parking area as shown on the site plan dated November 14 , 1985 shall always remain open and unobstructed for access by vehicles . Vote of the Board : Ayes : Messrs .
