No. 499o- NORTH BAY PROPERTIES 1000-83-1-33 STREET & LOCATION: 8869 Oregon Road, Cutchogue DATE OF PUBLIC HEARING: September 20, 2001; October 4, 2001 FINDINGS OF FACT PROPERTY FACTS: The subject property is a parcel of 84,880 sq. ft. in Cutchogue, reached by a right of way off Oregon Road, with frontage of 153 feet on Long Island Sound and depth of 604 feet on the west side and 562 feet on the east side. It is improved with a newly constructed house and in-ground swimming pool. BASIS OF APPEAL: Building Department Notice of Disapproval, dated May 29, 2001, stating that the swimming pool is not permitted because it is less than 100 feet from the top of the Long Island Sound bluff, in violation of Code section 100-239.4A. AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance authorizing the swimming pool as built. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) A survey by Stanley J. Isaksen, Jr. shows the northerly side of the pool intruding 9.5 feet into the 100-foot bluff setback at the east end of the pool, and intruding 2.8 feet at the west end. (2)Although the intrusion into the 100-foot bluff setback area is relatively modest, the Board notes that the bluff face on the property is seriously eroded, at least in part as a result of the construction of the house and pool. The Board is concerned about the condition of the bluff, especially in light of the fact that the pool and surrounding patio are a large structure. A letter to the applicant from the Suffolk County Soil and Water Conservation District, dated September 19, 2001, states that, since a prior inspection in June, substantial improvements had been made for protection against surface water running over the bluff, but that the bluff face was still in need of repair. (3) At the hearing on October 4, 2001, Charles Bowman of The Land Use Company stated that he has developed a plan, in conjunction with Joseph Fischetti, PE, for protecting the bluff. He testified that drainage problems on the upland portion of the property have been resolved by drywells. The plan for the bluff will be submitted to the Page 2—October 18, 2001 Appl. No. 4900—North Bay Properties 1000-83-1-33 at Cutchogue Department of Environmental Conservation and the Town Trustees, with the work planned for the spring of 2002. (4) A swimming pool is a reasonable accessory on a property of this type, and grant of the requested variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (5) Provided that the conditions set forth below are satisfied, grant of the requested variance should not have an adverse effect or impact on physical or environmental conditions. (6) The action set forth below is the minimum necessary to enable applicant to enjoy the benefit of the as built swimming pool while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION: On motion by Member Collins, seconded by Chairman Goehringer, it was RESOLVED, to GRANT the variance as applied for, subject to the following CONDITIONS: (1) Stormwater runoff shall be directed into drywells that prevent it from running over the bluff. (2) Pool drain water shall be led away from the bluff and into drywells. (3) The berm constructed to protect the bluff from water runoff shall remain in place permanently. (4) A copy of the bluff stabilization plan described by Mr. Bowman at the hearing on October 4, 2001, shall be submitted to this Board after approval by the Department of Environmental Conservation and the Town Trustees. Prior to the issuance of a Certificate of Occupancy for the swimming pool, this Board shall be satisfied that such plan has been carried out in full, including necessary reshaping of the bluff, appropriate planting, and installation of a layer of protective boulders to dissipate wave energy at the bluff toe. (5) This Board reserves the right to inspect the property up to the time of issuance of a Certificate of Occupancy for the swimming pool. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, Page 3—October 18, 2001 Appl. An undesirable change will NOT be produced in the character of the neighborhood or a det- riment to nearby properties,if granted BECAUSE: The in-ground pool is at grade level and therefore is hardly visible from surrounding prop- erties. The area of the pool which intrudes into the 100-foot setback from the bluff as re- quired by the Town Code is minimal, amounting to only about 220 square feet. 2. The benefit sought by the applicant CANNOT be achieved by some method,feasible for the applicant to pursue,,other than an area variance BECAUSE: The pool was inadvertently constructed in such a way that one side extends slightly over the setback line; it exists in the location shown on the survey.If the variance is not granted,the owner will have to demolish the existing pool and rebuild it in a location only slightly dif- ferent from that which exists,and this would result in a significant financial hardship, espe- cially considering that the error resulting the pool being in the present location was that of a contractor. 3. I met with James Fitzgerald at 11:00 am,.on Monday, June 11, 2001 at the site We were able to view some of the bluff face from above and see all of it from below The blowouts that occurred recently are directly caused by the clearing for the new construction of the houses.There are three spots along the top of the bluff where the surface water runoff has caused severe erosion. Two of these have been addressed by the creation of the berm and the installation of drainage rings The last one, in the center of the two new homes appears to still allow runoff to flow over the bluff face. The berm had not been continued far enough along the bluff top. Rebuilding or raising the height of the berm across the bluff top should keep the runoff from flowing over the face. You may consider tying the berm into the fence line toward higher ground to keep the runoff from entering the neighboring lot. However, you snould have a Professional Engineer calculate the amount of surface water runoff that needs to be addressed and contained by these two drains to make sure they are adequately sized. The yard area must be covered with a sod or ground cover so the drains will function properly. It is important to not allow silts to enter the drainage ring, which will seal the Infiltration surface The rings on the East lot are pulling soil into it from around the edge of the cover. This should be sealed to stop further erosion. Due to the severe erosion on the bluff top you will need to cut back the slope to a natural angle of repose. First you must obtain the required Permits from the Local Authorities. Follow the enclosed Technical bulletin to reshape the bluff face. Once it is reshaped, you may plant the bare areas to 'Cape American Seachgrass'. Enclosed are also a Plant Sheet and a Directory of Sources. There is one major concern about cutting back the top of the bluff. Any dead trees along the top edge and on the bluff face should be cut off at the base. Trash, grass clippings, leaves and branches should be removed from the bluff face. Enclosed is also a copy of the report that I sent to David McElroy and James Fitzgerald at their request for assistance back in June of this year. I met with Mr. McElroy this morning at the site and he was kind enough to show me all the work that was done around the property since I had been there last. Since the time of my original report the property has been significantly improved for protection against surface water runoff from flowing over the bluff face. The lot is well vegetated in a permanent sod cover up to a — constructed berm that I had recommended along the top edge of the bluff. The drainage ring with a surface inlet has been repaired and any surface water that will flow into it will be protected from sediments by the sod cover. At this time the constructed berm is covered by mulch. Mr. McElroy stated that a permanent cover would be planted on it in the early spring. I was not able to measure the distance from the pool to the existing bluff top edge due to the existing heavy cover of vegetation. It appears that the lot is now well protected from any surface water runoff being able to reach the face of the bluff. The house has gutters and downspouts that presently exit onto the ground surface. Mr. McElroy stated that drywells would be installed to keep the runoff from flowing over the surface. He had also installed a French drain along the perimeter of the pool to aid in drainage. Mr. McElroy stated that if the pool needed to be drained, it would be done so that the water is piped around to the front of the house, away from the bluff. I also looked at the bluff face by way of the "Birch Hills" private community stairwell access. It does not appear to be damaged any further than it was when I last viewed it. Mr. McElroy stated that he is having a proposal prepared to get permits to repair the damage by filling and shaping of the gullied areas, installing toe stabilization and then planting the bare areas of the bluff face with 'Cape American B'eachgrass'. This would meet with our recommendations. I mentioned to him that it must be planted while its dormant before April. I met with James Fitzgerald at 11:00 a.m. on Monday, June 11, 2001 at the site. We were able to view some of the bluff face from above and see all of it from below. The blowouts that occurred recently are directly caused by the clearing for the new construction of the houses. There are three spots along the top of the bluff where the surface water runoff has caused severe erosion. Two of these have been addressed by the creation of the berm and the installation of drainage rings. The last one, in the center of the two new homes appears to still allow runoff to flow over the bluff face. The berm had not been continued far enough along the bluff top. Rebuilding or raising the height of the berm across the bluff top should keep the runoff from flowing over the face. You may consider tying the berm into the fence line toward higher ground to keep the runoff from entering the neighboring lot. However, you should have a Professional Engineer calculate the amount of surface water runoff that needs to be addressed and contained by these two drains to make sure they are adequately sized. The yard area must be covered with a sod or ground cover so the drains will function properly. It is important to not allow silts to enter the drainage ring, which will seal the infiltration surface. The rings on the East lot are pulling soil into it from around the edge of the cover. This should be sealed to stop further erosion. Due to the severe erosion on the bluff top you will need to cut back the slope to a natural angle of repose. First you must obtain the required Permits from the Local Authorities. Follow the enclosed Technical bulletin to reshape the bluff face. Once it is reshaped, you may plant the bare areas to 'Cape American Beachgrass'. Enclosed are also a Plant Sheet and a Directory of Sources. There is one major concern about cutting back the top of the bluff. There are Glacial Erratics (large boulders) in the face of the bluff at the top that are going to have to come down. We can't tell from looking at them how large they are and extreme caution should be taken when removing them, since they can cause severe damage to the RIVERHEAD COUNTY CENTER . 300 CENTER DRIVE, ROOM N-210 . RIVERHEAD, NY 11901 • neighboring bulkhead. There may also be other Glacial Erratics that are buried in the cut back area. Perhaps a Professional Engineer should be contacted for this also. The toe of the bluff does not appear to be reached by normal tide levels. Storm tides can however reach the toe of the slope. The neighboring lot to the east has an existing bulkhead recently installed. Erosion can become accelerated around the end of them causing damage to your bluff face. One of the blowouts from above, mentioned previously, is on this neighbor's bluff face along the property boundary where the existing bulkhead ties back into the slope. Although it was caused by surface runoff from above, erosion can be accelerated from storm level tides.
