No. 4973 — DONALD and LOUISE MOYLE 1000-87-3-63.1 (or 63). Location of Property: 1920 Minnehaha Boulevard, Southold Date of Public Hearing: July 12, 2001 Findings of Fact PROPERTY FACTS: Applicant's property is a corner lot with 80+- ft. frontage along Minnehaha Boulevard facing west and 167+- ft. frontage facing north along Minnehaha Boulevard, and consists of 16,787 sq. ft. in area. Existing is a single-family two-story frame dwelling with 2nd story deck area and garage as shown on the survey prepared by Peconic Surveyors, P.C. last dated May 2, 2001. The dwelling is set back 30+- feet from the wood bulkhead along Corey Creek at its closest point. BASIS OF REQUEST: Building Department's May 30, 2001 Notice of Disapproval stating that the proposed deck addition is 25 feet from the bulkhead at the closest point, in violation of the 75 ft. requirement of Code Section 100-239.4. AREA VARIANCE RELIEF: Applicants request a variance authorizing an addition of a deck along the entire width of the house, 78 feet wide and 6 feet deep. According to applicants' survey, the house is set back 30 feet from the bulkhead and the deck will be+/- 24 feet from the bulkhead at the closest point. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. Applicant's house has existed for many years. The westerly portion is set back 30 feet from the bulkhead. The easterly portion is set back further because the bulkhead angles away from the house. The Coastal Erosion Hazard Line is approximately parallel to the northerly property line, and the southwest comer of the proposed deck crosses that line. 2 The 6-foot proposed deck would reduce the setback from the bulkhead at the westerly end of the house to only 24 feet, less than one-third of the setback required by Code section 100-239.4. Part of the proposed deck would also cross the Coastal Erosion Hazard Line. The Board concludes that these encroachments would be excessive, and by the action set forth below authorizes a smaller reduction from the existing setback. Page 2—July 19, 2001 Appl. There is no evidence that the action set forth below will produce an undesirable change in the character of the neighborhood or detriment to nearby properties. 4. The action set forth below is the minimum necessary to enable applicant to have a deck while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION: On motion by Member Collins, seconded by Member Dinizio, it was RESOLVED, to DENY the variance applied for and ALTERNATIVELY to GRANT a variance authorizing an open deck no less than 28 feet from the bulkhead at any point and extending no more than 6 feet from the rear of the house at any point. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Mr. Moyle hired me to assist him in the design of the proposed expansion of his elderly mother's home at 1920 Minnehaha Boulevard. As an architect, and former member of the Board of Historic Preservation and Architectural Review�in Sag Harbor, New York, I encourage clients to give careful consideration to a building addition's impact on its site and surroundings. Mr. Moyle has always had this in mind. Mr. Moyle's proposed deck runs across the length of the back of the house, which allows the new bedroom addition to be connected to the rest of the house from the outside as well as the inside. The proposed deck will also afford the Moyles an additional means of escape in the event of a fire. The deck addition is only 6-0" wide off the back of the house. It is essentially a walkway and is by no means substantial. There is only one neighbor who has a view of the back of the Moyle's house, and it is a distant view/*. Therefore, the deck will not have an undesirable affect on the neighborhood, as most people will not realize it even exists. Since the construction of the house predates the zoning, this can,not be considered a self- created hardship, as it is a pre-existing non-conforming structure. It is only logical that the Moyles would want to enjoy their beautiful view from outside their new room as well as from within, while also affording themselves an extra measure of safety. Mr. Moyle has carefully thought out his ideas and intentions to satisfy not only his needs, but also to satisfy his neighbors, the town of Southold and the natural habitat and surroundings that originally attracted his family to live here. By July Td, please submit to our office your Affidavit of Mailing (copy enclosed)with parcel numbers noted for,each, and return it with the white receipts postmarked by the Post Office. Later, when the green signature cards are returned to you by the Post Office, please mail or deliver them to us (but not later than the date of the hearing). If any signature card is not returned, please advise the Board at the hearing. On or about July 10th, 2001, and after the signs have been in place for seven (7) days, please submit your Affidavit of Posting to our office. These will kept in the permanent record as proof of all Notices. (Please feel free to return the metal stands to our office for a return of your deposit.)
