No. 4914 —OWEN MORREL Location of Property: 3495 Soundview Avenue, Peconic; Parcel 1000-68-1-15.1 Date of Public Hearing: February 27, 2001 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The subject property is a 12.02-acre parcel located on the northerly side of Sound View Avenue in Peconic. The lot has 252.59 ft. road frontage; the property widens to a width of approximately 400 ft. at the building setback line. The property is improved with a concrete foundation for a new dwelling, as depicted on the survey map amended March 5, 2001 prepared by John C. Ehlers, L.S. This building will replace the former dwelling construction. BASIS OF APPEAL Building Inspector's Notice of Disapproval dated December 14, 2000, denying an application dated October 27, 2000 for a permit to build an accessory swimming pool because the structure is proposed within the side yard area. RELIEF REQUESTED: Applicant requests a variance to locate an 18x36 ft. accessory swimming pool structure in the easterly side yard, at 14.5 feet from the side line. ADDITIONAL INFORMATION AND EVIDENCE CONSIDERED BY THE BOARD: 1. Although the property is a large, 12.5 acre lot, the ground elevations drop sharply between 20 and 30 feet near the proposed single-family dwelling, as indicated on the March 5, 2001 survey map prepared by John C. Ehlers, L.S. The only feasible area to place the accessory pool, which is level, is on the easterly side yard of the property. 2. In discussing the proposed 14.5' setback with the applicant at the February 27, 2001 hearing, the Board requested that the applicant increase the side yard set back as much as possible. The applicant agreed, and submitted an amended map, which places the accessory swimming pool in the easterly side yard, at 30 feet from the property line at its closest point. 3. The Board accepted the amended relief requested by the applicant to locate the accessory swimming pool in the easterly side yard at a minimum distance of 30 feet from the easterly property line, and therefore determine that; REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties. The proposed accessory swimming pool will be located approximately 1000 feet from the nearest dwelling on the east, and approximately 400 "Page 2'-March 15, 2001 ZBA Appl. No. 4914—0. Morrel fie: 1000-68-1-15.1 at Peconic feet on the west. No evidence was presented to suggest that the variance will adversely impact nearby properties. 2. The benefit sought cannot be achieved by some method, feasible for the applicant to pursue other than an area variance. The steep elevations on the property limit the only level area to place the pool to a nonconforming side yard location. 3. The area variance is not substantial because the accessory pool will meet the minimum side yard setback required for a principal structure. 4. The proposed variance will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. 5. The action set forth below is the minimum necessary and at the same time preserves and protects the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION: On motion by Member Collins, seconded by Member Tortora, it was RESOLVED, to GRANT the variance as requested and shown on the survey map amended March 5, 2001 prepared by John C. This letter shall confim that you have granted approval for this placement with the understanding that this mechanical equipment shall be approximately 8 to 12 feet from the east side property line. Ehlers, and four copies of property surveys. • Owen Morrel Town of Southold Zoning Board of Appeals 12-15-00 We are requesting this variance to construct an accessory swimming pool on The proposed site because it is the only site anywhere on our 12.5 acre property That is not wooded with 150 year old Oak and Hickory Trees or part of the Fragile ecosystem of sand dunes and Pine trees that protects some 50% of the Total property area in question. The contours of the land surrounding the house under construction are glacial and extremely severe in variation. . There are 20 - 30 foot drops in elevation on three of the four sides Surrounding the house. The only relatively level ,clear site anywhere near this House is on the east side of the property, where there are no houses within approx. 1,000 feet on the East and approx. 400 feet on the West. The proposed pool will not be visible from any adjacent dwelling or from any access road as the site is deep in a mature forest. By this application , appellant requests approval of: (a ) insufficient lot area of proposed parcel #2 of 76 ,000± sq . ft . ; (b ) insufficient lot area of proposed parcel #1 of not less than 65 ,000 sq . ft. ; (c ) insufficient lot width of both parcels of • 117 .88 feet; (d ) access over a 307foot private right-of-way along ,- the easterly side of the applicants premises and over lands presently of Gloria Fultz extending from Soundview Avenue to proposed Lot #1 •• a length of approximately 850 feet [see survey amended November 5 , 1985 prepared for the applicant by Roderick VanTuyl , P. C. #1539-6] . 4 . Upon inspection by the board members and pursuant to Road Report #492 from the town road engineer , it is found that there is an 8± ft . wide traveled road in the right-of-way 920± feet in length from the monuments along Soundview Avenue to the entrance of the existing Heigl house , and the remaining length has been cleared for a walkway to the Long Island Sound. The present roadway is passable but not in good condition. Some gravel was found at variable depths ; however , additional improvements are necessary to allow sufficient ingress and egress of fire trucks and other emergency vehicles . - 5 . Although the area consists of lots substantially larger than the subject premises varying in size from four acres to 12 . 5 acres , it is the opinion of the board that the size , shape and character of this parcel lends to the practical difficulties in this situation since there is no alternative method of planning the layout or configuration for a set-off division without a variance .
