No. 4869—WILLIAM MERCURIO Location of Property: 2305 Bay Avenue, Mattituck 1000-144-4-4 Date of Public Hearing: January 4, 2001 Findings of Fact PROPERTY FACTS: Applicant's property contains 1.408 acres with 148.32 ft. frontage along Bay Avenue and 144.79 ft. along the edge of meadow of James Creek in Mattituck. The property is improved with a single-family dwelling, swimming pool, and three accessory buildings (two of which are referred to in Certificate of Occupancy No. Z-9376 as two seasonal cottages (Buildings #1 and #4), and a storage building (Building #3). BASIS OF APPEAL: Building Inspector's Notice of Disapproval, dated July 28, 2000 and amended November 8, 2000, denying a permit for renovation and alteration of a nonconforming cottage, for the reason that Code section 100-241A prohibits enlargement, alteration, extension, reconstruction or restoration of a nonconforming use. The cottage is nonconforming because it is an additional dwelling on the property. The amended Notice of Disapproval takes note of the applicants' plan to add a roof dormer and upstairs storage space. RELIEF REQUESTED: Applicants request a ruling authorizing the proposed renovation, as work permitted under Code section 100-245, and dormer addition, to a nonconforming seasonal cottage. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) Certificate of Occupancy Z9376, dated March 14, 1979, describes the subject building as a seasonal cottage erected prior to the enactment of zoning. Under the current Zoning Code, the cottage is a nonconforming use. Applicants stated that the cottage needs foundation work and extensive repairs. They cite Code section 100-245, which authorizes "normal maintenance and repair" of a nonconforming use and "major structural alterations or demolitions necessary in the interest of public safety." (2) Applicants' architect testified that part of the foundation "presents an unstable condition," that framing and rafters are unstable, floors are out of level and electrical installation is substandard. t Page 2-April 5, 2001 . Appl. No. 4869-W. Mercurio 1000-144-4-4 at Mattituck (3) At the hearing on January 4, 2001, applicants' architect stated that applicants contemplate demolishing the cottage and building it anew. Article XXIV of the Zoning Code-"Nonconforming Uses and Buildings"- permits pre-existing nonconforming uses to continue and to be kept in repair. However, nothing in Article XXIV or elsewhere in the Code authorizes new construction of a nonconforming use, even in its existing footprint. The Board concludes that Code section 100-245 authorizes repairs to the cottage, including foundation repairs, sufficient to maintain its usability. Code section 100-245 does not authorize demolition and reconstruction of the cottage. (4) The Board concurs that the cottage foundation is deteriorated, but believes the building has structural integrity. RESOLUTION/ACTION: On motion by Member Collins, seconded by Member Tortora, it was RESOLVED, that this Board, pursuant to its authority under section 267-b(1) of New York Town Law, authorizes repair of the subject cottage as permitted by Code section 100-245, subject to the following CONDITIONS: (1) A building permit shall be obtained before any construction is undertaken. (2) The footprint, height and roofline of the cottage shall not be enlarged or altered; the proposed dormer addition is not authorized. (3) A full basement may be constructed under the entire cottage as part of the foundation repair. (4) Windows and doors may be replaced but may not be enlarged, increased in number or relocated except to the extent required for compliance with New York State Construction Code as administered by the Town Building Department. (5) The electrical service may be upgraded to meet applicable codes. (6) The cottage shall continue to be an accessory to the main dwelling and may not be rented except in a single transaction involving the rental of all structures on the property. Mercurio 1000-144-4-4 at Mattituck (7) In compliance with the language of the Certificate of Occupancy and the applicant's building permit application, both of which refer to a "seasonal cottage," the cottage may not be used for sleeping between November 15 and April 15 each year. (8) The variance granted by the Board of Appeals on March 12, 1981 under Appeal No. 2729, authorizing insufficient area of two lots in a proposed division of the property, is null and void. MOORE Attorney at Law 51020 Main Road Southold,New York 11971 Tel: (631)765-4330 Fax: (631)765-4643 MEMORANDUM OF LAW MERCURIO COTTAGE FACTS The applicants, William and Linda Mercurio,have submitted an application to the Southold Town Zoning Board to repair and renovate a preexisting nonconforming cottage on their property located at 2304 Bay Avenue,Mattituck. The cottage contains an enclosed porch, basement, attic space used for storage, two bedrooms, living room, dining room,kitchen and full bathroom. The Town has previously issued a Certificate of Occupancy for a pre-existing seasonal cottage. The cottage is presently occupied but is in need of repair and maintenance. APPLICABLE SECTIONS OF TOWN CODE The building inspector has sited 100-241 (A) of the Southold Town Code in his denial of a building permit to "repair and'alter" existing seasonal cottage. However, the Building Inspector should have considered 100-245 in his determination and permitted the repairs and alterations which are necessary to maintain the structure. Southold Town Code § 100-245. Repairs and maintenance. Notwithstanding any of the foregoing regulations, nothing in this Article shall be deemed to prevent normal maintenance and repair of any building or the carrying out upon the issuance of a building permit of major structural alterations or demolitions necessary in the interest of public safety. The existing cottage requires structural repairs which must conform to New York State Fire Prevention and Building Code. The repairs are proposed within the existing footprint. The structure is not being expanded or enlarged. Only the dormer changes the architectural design and roof line of the existing structure, the dormer provides additional dry storage which is a permitted use. LAW The nature and extent of a preexisting nonconforming use generally will determine the amount of protection accorded that use under a zoning ordinance. 4 Rathkopf, Zoning and r Planning Section 51.02, at 51-15 to 51-16 [4h ed.]. The subject cottage is a preexisting nonconforming residential use which has a Certificate of Occupancy. The cottage is recognized by the Town,protected as a pre-existing use, and there is no dispute that it may continue. Moreover,the proposed improvements to the existing cottage enhance the neighborhood,prevent a fire hazard to the owners main house and nearby properties. It is mandatory and in the interest of public safety that the improvements comply with current NY State Fire Prevention and Building Code standards. While the law generally views nonconforming uses as detrimental to a zoning scheme, and the overriding public policy of zoning in New York State is aimed at their reasonable , restriction and eventual elimination,nonconforming uses are generally permitted to continue. Despite this general policy of reasonable restriction and eventual elimination,the Court of Appeals in Syracuse Aggregate has stated that there are certain nonconforming uses of land that "in the light of the character and adaptability to such use of the entire parcel,manifestly imply an appropriation of the entirety to such use prior to the adoption of the restrictive ordinance" (In Matter of Syracuse Aggregate Corp. v. Weise, 72 A.D.2d 254,424 N.Y.S.2d 556, affd. 51 N.Y.2d 278, 434 N.Y.S.2d 150 ). As with Syracuse Aggregate the cottage remains a residential use. The cottage will continue to be occupied,the issue is whether notwithstanding the general zoning principle to eliminate nonconforming uses, the Town's overriding policy is to maintain safe structures. The Zoning Ordinance determines what changes are permitted in pre-existing, nonconforming uses. Calvi v. Zoning Board of Appeals of the City of Yonkers, 238 A. D.2d 417, 656 N.Y.S.2d 313 (2nd Dept., 1997) The Southold Town Code clearly states at § 100-245 that Repairs and maintenance are specifically permitted. "Notwithstanding any of the foregoing regulations, nothing in this Article shall be deemed to prevent normal maintenance and repair of any building or the carrying out upon the issuance of a building permit of major structural alterations or demolitions necessary in the interest of public safety. The repair and maintenance of residential uses, even major structural alterations, are in the interest of public safety. The Town of Southold has reasonably limited the expansion of pre-existing seasonal cottages,nevertheless, the owner has a legal right to maintain the cottageand make the necessary repairs which will prevent an unsafe condition to the inhabitants. The architect, Donald G. Feiler,has provided an affidavit with respect to the repairs which are necessary to maintain the Mercurio cottage. (Attached) The repairs begin with the Foundation which is presently a 8"concrete block foundation which is over only 23% (235sq.ft.) of the first floor area. The existing foundation appears to the Architect from visual observations of the exposed walls to be in satisfactory condition. However the remaining foundation includes locust post and sheet metal skirt,with crawl space area,which presents an unstable condition. With regard to framing: the floor structure comprises of 2x4 floor joists, spaced 19'-24' on center, with 2x4 girders, and are randomly spaced. The joists and girders are bearing on wood posts and built up supports on a dirt crawl space area. This condition is undersized, does not meet state code, and is unstable. The roof rafters and ceiling joists are 2x4, spaced 24" on center,which are undersized and do not meet NY State Code. The floors have excessive deflection and are out of level and window frames are racked as a result of the undersized structural framing and the unstable,foundation. The exterior wood siding and framing are closer to grade than both NY State Code and good practice would allow. The west wall siding and framing is completely imbedded into the grade. These conditions promote rotting of the wood post foundation and insect infestation. The electrical service and distribution is substandard and should be replaced. Consequently,the repairs and maintenance are sufficiently extensive that an Architect must prepare certified building plans which assure compliance with the NY State Building Code. Failure to grant the requested building pennit will merely promote habitation in an unsafe building which is contrary to public policy and the Southold Town Code. The repairs are in the interest of public safety. This is particularly the case in this instance where the cottage is in close proximity to the main residence, across from a motel, and in a neighborhood which contains multiple dwellings on each parcel. Section 100-245 strikes a balance between the eventual elimination of pre-existing nonconforming uses and the preservation of"safe" structures. The cottage repairs will protect the residents from risk of fire. The cottage could continue to be occupied in the existing condition but public policy favors compliance with the New York State Fire Prevention and Building Code. The building department requires building plans prepared by the Architect which certify repairs to be in compliance with current standards. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. The property contains three residential dwellings which pre-dates zoning. . The subject dwelling has been used continuously since prior to zoning. (Letter from Harriet Tabasko and Joan Halligan) The existing structure does not comply with the NYS Fire Prevention and Building Code . The owner must make repairs to the foundation which over time have experienced cracked cement, and termite damaged to the wood posts . The existing structure appears to have been added to at different times on different foundations all of which is structurally unsound and results in a difficult renovation to the existing structure. The existing wood frame structure is inadequate and is a "fire trap" . Repairs to an existing building must comply with the NYS Fire Prevention and Building Code, consequently the foundation and structure will need to be repaired or reconstructed (in the same footprint) meeting current safety standards . No undesirable change will be produced in the character of the neighborhood or detriment to nearby properties in that a hazardous structure will be improved to meet the current fire and safety standards . 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to ..- pursue, other than an area variance. All structures on the property have certificate of occupancies . The Building Inspector has required that the owners to obtain Zoning Board approval to repair or reconstruct' the subject structure. (In 1993 a building permits for renovation of another preexisting dwelling structures on the property had been granted without a variance however less foundation repairs were required) Since the owners do not know the degree of renovations this structure will require, the building department has advised that the owners obtain a variance to permit the renovation. 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance . The dwelling is occupied by the owner' s family but it is in need of repairs . In order to bring the structure into compliance with the NYS Fire Prevention and Building Code, the dwelling must be repaired and reconstructed within the current footprint on a new foundation. The Architect and builder do not know what they will find as the walls are brought into conformity with current Fire Code limits . 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The improvements will be a benefit to the neighborhood in that construction will meet current codes . 5 . The alleged difficulty was not self-created. The structures are preexisting. Normal repairs due to wear and tear, as well as, changes to the NYS fire codes make the repairs mandatory. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . The structure will be in the existing footprint . After investigation and personal inspection, the Board finds as follows : Appellants have appealed to this Board seeking a variance for approval of two proposed parcels which would have an insufficient road frontage of 72 feet and 76 feet, and insufficient area of 31, 200 square feet each, and located on the east side of Bay Avenue in Laurel. Existing on the premises are two small frame cabins, a one-story frame house, and a one-family dwelling which dwelling appellants propose to relocate on one of the two parcels if this variance were approved. Appellants have agreed to eliminate all the extraneous buildings existing prior to the issuance of a building permit in relocating the main one-family dwelling. It is the feeling of the Board that by granting this variance the area is improved in that a total of two dwellings would be per- mitted and the nonconforming uses of the existing structures would be eliminated.
