FINDINGS OF FACT
PROPERTY FACTS: Applicants are proposing a new 26 x 60 ft. dwelling with a front yard setback
of 35 feet, north side yard at 20 feet, rear yard at 18 feet, and the remaining side yard greater than
the code requirement of 10 feet. This parcel is vacant and is shown as Lot #41 on the Map of
Marion Manor, a subdivision listed under Section 100-12 of the Town's Exceptions List until
January 1, 1997. The lot contains an area of 11,230 sq. ft. with 140.05 ft. frontage along Gillette
Drive and lot depth of 79.73 feet along the northerly property line.
BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated October 31, 2000 denying
an application for a building permit for a new dwelling for the reason that the rear yard is proposed
at less than the code requirement of 35 feet, Zoning Code Article XXIV, Section 100-244B.
RELIEF REQUESTED: Applicants request a Variance for location of a new dwelling at 18 feet at
its closest point to the rear property line instead of 35 feet. (Also see paragraphs below).
INFORMATION AND EVIDENCE CONSIDERED BY THE BOARD:
The Lot is small containing 11,222 square feet. The lot is similar in size to others in this
neighborhood that present special problems with meeting the code-required setbacks. The
adjoining rear yard neighbor, by way of letter, expressed strong opposition to the proposed
variance, which would locate the new dwelling 18 feet from the rear property line.
In discussing the neighbor's concerns, as well as the Board's concerns, the applicant agreed to
increase the setback request to a minimum of 20 feet. The Board agrees that the applicant can
reduce the depth of the house from 26 feet to 24 feet and increase the rear yard set back to a
minimum of 20 feet.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented,
materials submitted and personal inspection, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. Applicant proposes to construct a new dwelling
with a minimum rear yard setback of 20 feet. No evidence was presented to suggest that the
variance will adversely impact nearby properties, which have similar rear yard setbacks.

2. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to
pursue, other than an area variance. Because of the small size of the lot, if the applicant were to
locate the house at the required rear yard setback, it would encroach into the front yard area, and a
variance would then be required.
3. The requested area variance is substantial.
4. The proposed variance will not have an adverse effect or impact on the physical or
environmental conditions. No evidence was present to indicate that the proposed variance would
create adverse environmental impacts on the physical or environmental conditions in the
neighborhood or district.
The action set forth below is the minimum necessary and adequate to enable applicant to enjoy the
benefit of a new dwelling while preserving and protecting the character of the neighborhood and
the health, safety and welfare of the community.
RESOLUTION/ACTION: On motion by Member Tortora, seconded by Member Dinizio, it was
RESOLVED, to approve the request for a variance, as amended, by increasing the original
request from 18 feet to 20 feet from the foundation, to allow for a building depth of 24-feet instead
of 26 feet, and that a cantilever is permitted at 22 feet from the rear property line, at its closest
points.
Vote of the Board: Ayes: Members Tortora, Dinizio, Collins, and Horning. (Chairman Goehringer
was absent during this resolution.) This Resolution was duly ADOPTED (4-0).

AREA VARIANCE REASONS:
(1) An undesirable change will not be produced in the CHARACTER cf the neighborhood

to the immediate neighbor (Bertodatti ) with an 18 ' rear yard and
others established in the area .
(2) The benefit sought by the applicant CANNOT be achieved by some method feasible
for the applicant to pursue, other than an area variance, because: the lot does
not allow a house design to fit with a conforming rear yard; the
lot contains 11 ,230 sq. ft. in total land area.
(3) The amount of relief requested is not substantial because:
all other setbacks will be conforming to codes .
(4) The variance will NOT have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district because:
there are no wetlands or indicators of wetland plants in the vicinity
of this property-

Dear Mr. Olsen:
In response to your inquiry with MaryAnn yesterday, this will confirm
that the request for a 26-ft. deep foundation was denied with grant of a 24ft.
deep foundation, at 20 ft. from the rear yard property line. A two-ft.
cantilevered roof extension was allowed, provided it does not extend greater
than two feet, leaving an 18 ft. rear yard setback at its closest point - not 22
feet as worded in the Resolution.
Please accept this as clarification to correct the Board's March 15, 2001
determination.

Dear Mr. Goehringer:
I am the president of Cleaves Point Construction, the owner of the lot directly behind Mr. and
Mrs. Mott's property on Gillette Drive, East Marion. I am writing to note my strong opposition
to the above-referenced application for a variance to reduce the Mott's rear yard setback.
We strongly urge the board to deny this variance for the following reasons.
1. Our lot will be adversely effected by this change. The lots on the street are small, 1/4 acre
plots. Our backyard abuts the Mott's property. There is not enough room for their residence to
be placed only 18' from the property line, right on top of the proposed house that we intend to
build.
It does not even seem possible for a bulldozer to dig a hole for a foundation, which is always
larger than the actual foundation itself, without excavating beyond 18'. This would necessitate
the machine to go over the property line into our small lot which is treed with small plants and
cedars.
2. As a builder, I can see no need why the house cannot be centered on the lot, as mandated by
the code. Pushing the house back to the rear of the property does not allow for a bigger house.
The lot is perfectly square and the house would fit nicely in the center of the property.
3. The houses in the neighborhood that are all in the center lots, are all centered in the middle of
the property. This way all the homeowners have some privacy, even though they are only 1/4
acres. I am not aware of the house referred to by the applicant's, but there are houses that are on
the very west and extreme east side of Gillette Drive. Those lots face Gillette Drive but have
farm fields in their backyard, in which case a small rear setback makes sense.
SO
Unfortunately, I will not be able to personally attend the board meeting on Feb. 27. However, I
urge the board to deny the application and to require the minimum 35' rear yard setback. In
fairness to both my property rights and Mr. and Mrs. Mott's, the location of their residence
should be in the center of the property.

Please find enclosed a copy of the Legal Notice describing the recent application. The Notice will be
published in the next issue of the Suffolk Times.
Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your
application and hearing must be now mailed with a map or sketch showing the construction area or
variance being considered. Send the enclosed Notice CERTIFIED MAIL, RETURN RECEIPT
REQUESTED, on or before Friday, February 16th, or as soon as possible, including a copy of a
map showing your project area, to all owners of land (vacant or improved) surrounding yours,
including land across any street or right-of-way that borders your property. Use the current
addresses shown on the assessment rolls maintained by the Town Assessors' Office (765-1937) or
the County Real Property Office in Riverhead. If you know of another address for a neighbor, you
may want to send the notice to that address as well.
By Friday, February 23rd, please submit to our office your Affidavit of Mailing (copy enclosed) with
parcel numbers noted for each, and return it with the white receipts postmarked by the Post
Office. Later, when the green signature cards are returned to you by the Post Office, please mail or
deliver them to us (but not later than February 271h). If any signature card is not returned, please
advise the Board at the hearing.
When picking up the sign, a $15 check will be requested for each sign as a deposit. Please post the
Town's official poster/sign no later than 2/20/01. Securely place the sign on your property facing
the street, no more than 10 feet from the front property line bordering the street. (If you border more
than one street or roadway, an extra sign is furnished for each front yard.) The sign(s) must remain
in place for at least seven (7) days, and should remain posted through the day of the hearing. If you
need a replacement sign, please contact us. After the signs have been in place for seven (7) days,
please submit your Affidavit of Posting to us for the permanent file. Within 20 days after the hearing,
the sign and stand should be returned to us. The $15 deposit will then be returned to you. If the
sign and stand are not returned within this 20-day period, the deposit will be non-refundable.
If you do not meet the deadlines stated in this letter, please contact us promptly. Thank you for
your cooperation.

FINDINGS OF FACT
PROPERTY FACTS: Applicants are proposing a new 26 x 60 ft. dwelling with a front yard setback
of 35 feet, north side yard at 20 feet, rear yard at 18 feet, and the remaining side yard greater than
the code requirement of 10 feet. This parcel is vacant and is shown as Lot #41 on the Map of
Marion Manor, a subdivision listed under Section 100-12 of the Town's Exceptions List until
January 1, 1997. The lot contains an area of 11,230 sq. ft. with 140.05 ft. frontage along Gillette
Drive and lot depth of 79.73 feet along the northerly property line
BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated October 31, 2000 denying
an application for a building permit for a new dwelling for the reason that the rear yard is proposed
at less than the code requirement of 35 feet, Zoning Code Article XXIV, Section 100-244B.
RELIEF REQUESTED. Applicants request a Variance for location of a new dwelling at 18 feet at
its closest point to the rear property line instead of 35 feet. (Also see paragraphs below).
INFORMATION AND EVIDENCE CONSIDERED BY THE BOARD:
The Lot is small containing 11,222 square feet. The lot is similar in size to others in this
neighborhood that present special problems with meeting the code-required setbacks. The
adjoining rear yard neighbor, by way of letter, expressed strong opposition to the proposed
variance, which would locate the new dwelling 18 feet from the rear property line.
In discussing the neighbor's concerns, as well as the Board's concerns, the applicant agreed to
increase the setback request to a minimum of 20 feet. The Board agrees that the applicant can
reduce the depth of the house from 26 feet to 24 feet and increase the rear yard set back to a
minimum of 20 feet.
REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented,
materials submitted and personal inspection, the Board makes the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. Applicant proposes to construct a new dwelling
with a minimum rear yard setback of 20 feet. No evidence was presented to suggest that the
variance will adversely impact nearby properties, which have similar rear yard setbacks.

2. The benefit sought by applicant cannot be achieved by some method, feasible for appellant to
pursue, other than an area variance. Because of the small size of the lot, if the applicant were to
locate the house at the required rear yard setback, it would encroach into the front yard area, and a
variance would then be required.
3. The requested area variance is substantial.
4. The proposed variance will not have an adverse effect or impact on the physical or
environmental conditions. No evidence was present to indicate that the proposed variance would
create adverse environmental impacts on the physical or environmental conditions in the
neighborhood or district.
The action set forth below is the minimum necessary and adequate to enable applicant to enjoy the
benefit of a new dwelling while preserving and protecting the character of the neighborhood and
the health, safety and welfare of the community.
RESOLUTION/ACTION: On motion by Member Tortora, seconded by Member Dinizio, it was
RESOLVED, to approve the request for a variance, as amended, by increasing the original
request from 18 feet to 20 feet from the foundation, to allow for a building depth of 24-feet instead
of 26 feet, and that a cantilever is permitted at 22 feet from the rear property line, at its closest
points.
Vote of the Board: Ayes: Members Tortora, Dinizio, Collins, and Homing. (Chairman Goehringer
was absent during this resolution.) This Resolution was duly ADOPTED (4-0).

FINDINGS OF FACT
PROPERTY FACTS/DESCRIPTION: The applicants' property is located at the west side of East
Gillette Drive in East Marion. The property is vacant and referred to as Lot #42 on the Map of
"Marion Manor" filed in the Office of the Suffolk County Clerk on March 18, 1953. This parcel
contains a lot area of 11,007+- sq. ft. and lot width (frontage) of 135.05 feet as shown on the
survey prepared for the applicants by Lisa McQuilkin, L.S. dated March 23, 2000.
BASIS OF APPLICATION: Building Inspector's May 12, 2000 Notice of Disapproval for the reason
that the dwelling will be located with a rear yard setback at 18 feet (from cantilever).
AREA VARIANCE RELIEF REQUESTED: Applicants are proposing a 24x60 ft. single-family dwelling
with a rear yard setback at 18 feet from a cantilevered extension (20 ft. from the foundation). All
other setbacks in this request are proposed to meet the code requirements.
REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and
personal inspection, the Board make the following findings:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or a detriment to nearby properties. Applicant proposes to construct a new dwelling
at 18 feet from the rear line while meeting all other code requirements. The proposed 18 ft. rear
yard setback is consistent with those existing generally in the area and is for a house only 24 feet
in depth.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the
applicant to pursue, other than an area variance. The dwelling is only 24 ft. deep and substantially
fits the lot.
3. The area variance is not substantial.
4. The proposed variance will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district. Applicants' proposed construction is
similar to other dwellings existing in the area on parcels of the same or similar substandard size.
