STREET & LOCATION: 2155 Cedar Avenue, Southold DATE OF PUBLIC HEARING: July 12, 2001; August 16, 2001; August 28, 2001 FINDINGS OF FACT PROPERTY FACTS: The applicant's property is referred to as Nos. 208 through Lot 215 on the Map of Goose Bay Estates, Southold, filed in 1934. The property is a triangular vacant lot of 12,639 sq. ft., with frontage of 164.45 feet on Birch Avenue (west line), 173.07 feet on Cedar Avenue (east line), and 120 feet on the southerly line. The elevation rises from 38 feet at the southwest corner to 54.5 feet at the southeast corner, all as shown on a survey by John T. Metzger, L.S. dated December 6, 2000, updated January 19, 2001. BASIS OF APPEAL: Building Inspector's Notice of Disapproval, dated March 18, 2001, denying a permit to build a house because the proposed setback of 22 feet from Birch Ave. was less than the 35-foot front yard required under Code section 100-244B, and the proposed setback of 10 feet from the southerly lot line was less than the 35-foot rear yard required under Code section 100-244B. The Building Inspector determined that, pursuant to section 100-232A, the southerly yard is a rear yard. AREA VARIANCE RELIEF REQUESTED: Applicant initially requested a variance authorizing the location of a new house as proposed in the building permit application. Following the hearing of July 12th, applicant submitted a new site plan dated August 16, 2001, and drawn on the survey of December 6, 2000, showing the house moved to the north with resulting setbacks of 25 feet on both Birch and Cedar Avenues and 20 feet on the south. Applicant requests a variance authorizing these front yard setbacks. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. This is a small triangular lot with two front yards and a rear yard. It is essentially impossible to build on the lot without setback variances of some sort. Construction on the lot is further constrained by the steep slope down from Cedar to Birch Avenue. 2. Neighbors expressed concern that construction will cause flooding and erosion. In the revised site plan dated August 16, 2001, applicant responded with plans for drywells and drains, and a proposal that the northerly part of the property remain permanently undisturbed. At the hearing on August 28, 2001, applicant submitted a landscaping plan by Derek Bosson, dated August 2001, showing the undisturbed area mentioned in paragraph 2 as well as the planting of 6-foot Leyland spruces on 5-foot centers along the southerly lot line. The plan also shows retaining walls, drains connected to the drywells shown in the site plan dated August 16, 2001, and hay bales and silt fences to be in place during construction. 4. The Board believes there could be runoff problems resulting from the clearing of the property. The action set forth below includes conditions intended to mitigate such problems, and the Board believes that for this reason the action set forth below will not have an adverse effect or impact on physical or environmental conditions. 5. The proposed setbacks of 25 feet in the two front yards and 20 feet in the rear yard are significantly less than the required 35 feet. However, the size and shape of the property make substantial variances necessary for virtually any construction. The neighborhood is characterized by relatively small lots and modest setbacks, and the action set forth below will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. 6. The action set forth below is the minimum necessary to enable applicant to construct a house on the subject property while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION: On motion by Member Collins, seconded by Member Homing, it was RESOLVED, to DENY the initial request for a variance authorizing setbacks of 22 feet from Birch Avenue and 10 feet from the southerly lot line, and ALTERNATIVELY to GRANT a variance authorizing construction of a dwelling with minimum setbacks equal to those set forth in the revised site plan dated August 16, 2001, to wit, 25 feet from each of Cedar and Birch Avenues and 20 feet from the southerly lot line, subject to the CONDITIONS set forth below. For purposes of setting forth CONDITIONS, the following documents are attached to and made part of this decision: (1) the site plan dated August 16, 2001, drawn on a survey by John T. Metzger dated December 6, 2000, and submitted by applicant at the hearing on August 16, 2001; (2) the two-page landscape plan drawn by Derek Bosson, dated August 2001, submitted by applicant at the hearing on August 28, 2001. 1. The provisions for drywells and for drains leading thereto, set forth in the aforementioned plans, shall be implemented. Prior to the issuance of a Certificate of Page 3—.September 20, 2001 Appl. Dempsey) 1000-77-1-25 at Southold Occupancy for any house erected on the subject property, the Southold Town Engineer, or a Professional Engineer designated by him, shall confirm the adequacy of the drywells and drains, based on his professional assessment of the provisions necessary to contain runoff water on the site. Any costs associated with such confirmation shall be borne by applicant. 2. The provisions for hay bales and silt fences proposed in the aforementioned landscape plan shall be implemented, and applicant shall make every effort to minimize and control runoff and erosion during construction. 3. The buffer of evergreens on the southerly property line, proposed in the aforementioned landscape plan, shall be installed and continuously maintained. 4. Prior to the issuance of a Certificate of Occupancy for the proposed dwelling, the owner of the subject property shall execute and file with the Suffolk County Clerk a covenant imposing the following constraints on the property: A. There shall be no disturbance, now or at any future time, on the triangular segment of the property bordered by Birch Avenue, Cedar Avenue, and a line drawn perpendicular to Birch Avenue, beginning on Birch Avenue at a point 135 feet from the southeast corner of the property and running to Cedar Avenue, as shown on the site plan dated August 16, 2001, and marked "limit of clearing." B. There shall be no more than one driveway on the property, and any such driveway shall be of water-pervious construction. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. I have had two brief phone conversations with Paula Quintieri who advised me to send these questions to you in writing. I have attached a copy of the site plan by John T. Metzger dated 8/16/01 and referenced in the Resolution/Action. Paragraph 4.B. of the Resolution states that there shall be no more than one driveway on the property. Would I be able to substitue the horseshoe shaped driveway shown on the attachment for the proposed rear driveway, and would it have to be of water pervious construction? Would I be able to add a triangular shaped area of deck (shown cross-hatched on the attachment), as long as it is beyond the 25' setback from Birch Avenue? Goehringer / Chairman, Afp �iP n �� � —September 9, 2001 �ti �� -I' RE: Application #4974 Richard Hammel , Owner John Demp§ey, Contract Vendee Southold Town Board of Appeals (in relation to non-cleared drainage buffer Southold, New York 11971 triangular area at the corner of Cedar Ave. Dear Member of the Board, and Birch Avenue) Our Cedar Avenue property is directly across Cedar Avenue from the Hammel/Dempsey lot's proposed drainage buffer non-cleared area. Since Cedar Avenue is only 15 feet wide at present, there are only 15 feet separating our two properties, giv- ing us similar soil and topography with the non-cleared drainage buffer area. We, therefore, find ourselves in ,position to strongly advise the Board that, for this uncleared area to act as a buffer, it must remain undisturbed and that the provisions set forth by Mr. Cardinale to protect it as such, be made per- manently secure by C.O. and covenant . This is not typical Southold soil . For example, for fruit trees, we had to plant beach plums which flourish in this very sandy soil . According to the Hammel/Demp- sey survey map, on the flat of the lot, topsoil has been measured only 2 inches deep, followed by sand. It is probably less on this sloped drainage buffer area. This is a very unforgiving soil : one good rainfall and it is gone, leaving sand. We have had this experience on our land. Sand on a slope does not hold, but runs down with the runoff rain water. This erosion would render useless this area as a drainage buffer. The only way to ensure the value of this land as a drainage buffer, is to leave it exactly as it is, a proven ecological drainage system. Moreover, if there is no buffer, some of this sand/runoff will likely continue down Cedar Avenue to the flat of the intersection of Cedar Avenue and Oak Avenue. ( Oak Avenue is not shown on the Hammel/Dempsey survey map. See our attached map. ) The Cedar/Oak intersection is used by approximately 35 families. This Hammel/Demp- sey property runoff sand would be a driving hazard at Cedar and Oak, add to drain clog at the foot of Cedar, and cause more `runoff/pollution into Goose Creek. Planting grass in this buffer area is not an option.due to the dense shade of the area. Grass planted on this slope would require constant maffl tenance forever, something no one could guarantee. .Planting grass in this area, as we were told by Mr. Coffey's representative who attended the August 28th Board meeting and who drew up the proposed landscaping plan for the Hammel/Dempsey property, would serve no-drainage.pur.pdse; water wouldrjust slide down:.the Removing ground cover is not an option, as it will disturb the soil 's protection. Since Cedar Avenue is only 15 feet wide at present, there are only 15 'feet separating our two properties, giv- ing us similar soil and topography with the non-cleared drainage buffer area . We, therefore, find ourselves in a.position to strongly advise the Board that, for this uncleared area to act as a buffer, it must remain undisturbed and that the provisions set forth by Mr. Cardinale to protect it as such, be made per- manently secure by C.O. and covenant . This is not typical Southold soil . For example, for fruit trees, we had to plant beach plums:which flourish in this very sandy soil . According to the Hammel/Demp- sey survey map, on the flat of the lot, topsoil has been measured only 2 inches _deep, followed by-sand. It is probably less on this sloped drainage buffer area. This is a very unforgiving soil : one good rainfall and it is gone, leaving and. We have had this experience on our land. Sand on a slope does not hold, but runs down with the runoff rain water. This erosion would render useless this area as a drainage buffer. The only way to ensure the value of this land as a drainage buffer, is to leave it exactly as it is, a proven ecological drainage system. Moreover, if there is no buffer, some of this sand/runoff will likely continue down Cedar Avenue to the flat of the intersection of Cedar Avenue and Oak Avenue. ( Oak Avenue is not shown on the Hammel/Dempsey survey map. See our attached map. ) The Cedar/Oak intersection is used by approximately 35 families. This Hammel/Demp- sey property runoff sand would be a driving hazard at Cedar and Oak, add to drain clog at the foot of Cedar, and cause more "runoff/pollution into Goose Creek. Planting grass in this buffer area is not an option.due to the dense shade of the area. Grass planted on this slope would require constant ma+N tenance forever, something no one could guarantee. .Planting grass in this area, as we were told by Mr. Coffey's representative who attended the August 28th Board meeting and who drew up the proposed landscaping plan for the Hammel/Dempsey property, would serve ' no. drainage_purpdse; water..wOuld.=just slide_down: the grass. : ' Removing ground cover is not an option, as it will disturb the soil 's protection. I want to thank you for the opportunity to present to you the concerns of my clients at last night ' s hearing. As discussed at that time, the purpose of this memo is to summarize the concerns and requests made at last night ' s hearing on behalf of my clients . 1 . Review of the Town file discloses that the threshold questions posed by Southold Town Code Sections 100-24 (lot recognition) and 100-25 (merger) have not been fully addressed and resolved. Applicants did obtain a single and separate search (attached) . The search did not, however, include those lots on the westerly side of Birch Avenue (a private road) to assure that the subject parcel has not merged with those lots . This is possible because Birch Avenue is a private road and the deeds for the subject parcel and those parcels on the westerly side of Birch Avenue opposite it will, I believe, show ownership to the middle of Birch Avenue (thus establishing those lots in the westerly side of Birch Avenue as abutting parcels to the subject lot) . 2 . Assuming arguendo that the threshold issues of lot recognition and merger are resolved and the subject parcel is recognized as an unmerged building lot under the Southold Town Code, we urge the Board to "grant the minimum necessary relief which is adequate and at the same time preserves and protects the character of the neighborhood and the health, safety and well being of the community" . We suggest that this can best be done by conditioning any variance on the recording of covenants to run with the land, enforceable by abutting owners (or, if this is not legally possible, by a designated agency of the town) . We also suggest that these covenants be made a pre-condition of issuance of any Certificate of Occupancy for the residence. / 7p9 ' • We ask that these recorded covenants include the following provisions : a) All runoff shall be contained on-site; b) Landscape and drainage plan, as attached, shall be installed and properly maintained; c) A natural undisturbed buffer area shall be maintained from the line of clearing as shown on the attached landscape and drainage plan to the northernmost portion of the lot (see more extensive proposed natural buffer language attached) ; d) No driveway shall be installed except in the location indicated on the attached landscape and drainage plan and such driveway shall be of a pervious substance only; e) There shall be no construction on the lot other than a single story residence with deck within the indicated 26 ' x 45 ' footprint as shown on attached landscape and drainage plan; f) Engineering, grading and re-surfacing of Birch Avenue as it abuts the subject premises (including installation of any necessary dry wells and drainage) and maintenance of same shall be the responsibility of the owner of the subject premises . g) The number, location and capacity of dry wells and drains to be placed pursuant to drainage plan attached shall be prepared by the owner and shall be subject to review and approval by the Southold Town engineer. Finally, I remind the Board of its indicated intention to discuss with counsel the legal issues raised by #1, #2 and (f) above. I also request the Board consider the possibility of : 1) modifying the driveway location or curving it to lessen the possibility of runoff onto the Beaton' s and Principato' s front yards by directing such runoff to the north; and 2) the advisability of an additional dry well just off the northwest edge of the proposed residence . Thank you again for your careful review of this matter. • Natural Buffer Area The triangular shaped natural buffer area containing all of the subject premises north of the clearing line as shown on the attached landscape and drainage plan shall extend at least 120 ' along Cedar Avenue from the northernmost part of the subject premises and at least ' along Birch Avenue with a total area of sq. ft . In such natural buffer area, trees, underbrush, ground cover and leaf cover shall not be disturbed. I have owned my house on Cedar Avenue since 1980. The character of this area, and particularly this neighborhood, therefore, is very important to me. I have no objection to a house being built at 2155 Cedar Avenue. I do, however, have strong objection to the unreasonable size of the proposed house and to its extremely close proximity to already existing houses. A house of this size does not fit the site. It would not only severely detract from the charm and character of our neighborhood, but would have a strong negative impact on surrounding houses and properties. Thank you.
