No. 4888 — RICHARD GOODALE, Applicant-Owner Parcel Nos. 1000-117-10- 13 with 14 combined STREET & LOCALITY: 8755 Fifth Street, New Suffolk DATE OF PUBLIC HEARING: November 16, 2000; December 7, 2000 REQUEST MADE BY APPLICANT: This is a request under Article III, Section 100-30A.2B and 100-31B, sub-sections 14a-d of the Southold Town Zoning Code (amended 2-7-9). Applicant- owner is requesting an Accessory Bed and Breakfast, accessory to the owner's (Richard Goodale's) residence in this single-family dwelling, with up to four (4) bedrooms (maximum) for lodging and serving of breakfast to not more than eight (8) casual, transient roomers. PROPERTY DESCRIPTION: This property contains approximately 40,000 sq. ft. in total land area and fronts along two streets: 100+- ft. along the south side of Jackson Street and 470+- ft. along the east side of Fifth Street, in New Suffolk. The property is improved with dwelling which is maintained and used as a single-family dwelling. The former use of the building areas as a two- family dwelling has been abandoned, as confirmed by the owner in this application for an Accessory Bed and Breakfast in a One-Family dwelling. REASONS FOR BOARD ACTION, DESCRIBED BELOW: 1) This use as requested is reasonable in relation to the District in which is located, adjacent use districts, and nearby and adjacent residential uses. 2) The Special Exception is for approval of the Bed and Breakfast as an accessory use incidental to the applicant-owner's residence in this dwelling and will not prevent the orderly and reasonable use of adjacent properties and the use has adequate parking and available open space. 3) This accessory use will not prevent orderly and reasonable uses proposed or existing in adjacent use districts. 4) No evidence has been submitted to show that the safety, health, welfare, comfort, convenience, order of the town would be adversely affected by this accessory use. This accessory use is subject to further review by the Building Department under the New York State Fire and Building Codes (which is not in the jurisdiction of the Board of Appeals). 5) This accessory use is an authorized zoning use subject to a Special Exception review and • • Page�2—B & B Appl. BOARD ACTION/RESOLUTION: On motion by Member Tortora, seconded by Member Collins, it was RESOLVED, to GRANT the application for an Accessory Bed and Breakfast Use as described above, SUBJECT TO THE FOLLOWING CONDITIONS: 1) A minimum of six (6) parking spaces (four for the Bed and Breakfast Use and two for the single-family dwelling) shall be on-site (on applicant's property). 2) There shall be no entry or driveway to the dwelling from Jackson Street. 3) Applicant-Owner shall occupy the dwelling as his principal residence, and shall obtain a Certificate (of Occupancy or Compliance) from the Building Department for occupancy for the new Accessory Bed and Breakfast. 4) The subject property contains lot numbers 13 and 14 which are merged as one lot, and in no event shall be considered as two separate lots. 5) This Authorization by the Board of Appeals is solely for an Accessory Bed and Breakfast and does not include use of the property and buildings for any other use or purpose. I am in my 76th year and I practice law in the community. I represented the New Suffolk community after it voted 166 to 10, 27 years ago, to oppose rezoning of the North Fork Shipyard 'site, and I have a personal and professional interest in maiu- tairiing the character of this community. In this instance I speak only for myself and my family. I ask that the board satisfy itself that this application is not an in- direct attempt to create a rooming house, rather than the applied for pubic house catering only to transient visitors; probing for prior advertisements or other evidence of this :intent. I ask that the board consider, in its wisdom, requiring, as .a condition of approval, if in fact it so coueiders, that the owner enter into an appropriate covenant running with the property, that no application to rezone the property for future motel or similar use, will be made by the owner itseV, or in conjunction with an application by the owner or owners of the adjoining property to the east, present- ly owned by parties related to the applicant. The combined parcel would consist of more than one and a half acres, 205 feet of beachfront on Peconic Bay, with access on three. sides, Jackson Street, 4th Street, and Fifth Street. I ask that the board recegnize that once a public use is granted, it may be only a hop, skip and a jump to request such zoning on "hardship grounds" etc, the argument then being that motel use would be only an extension of existing bed and breakfast use. I asic that the board consider requiring a detailed environment impact statement. I ask that the board inspect the premises, keeping in mind its condition,, facilities, fire safety and appropriateness for a bed and breakfast. -2. I ask that the board inquire as to whether the owner, in fact, makes hia residence at the site and will represent that he will continue to maintain it there. Providing notice of public hearings. Whenever the Code calls for a public hearing, this section shall apply. Upon determining that an application is complete, the board or commission reviewing the same shall fix a. time and place for a public hearing thereon.The board or commission reviewing an application shall provide for the giving of notice: A. By causing a notice giving the time, date, place and • nature of the hearing to be published in the official newspaper within the period prescribed by law. B. By requiring the applicant to erect the sign provided by the town, which shall be prominently displayed on the premises facing each public or private street which the property involved in the application abuts, giving notice of the application, the nature of the approval sought thereby and the time and place of the public hearing thereon. The sign shall be set back not more than ten (10) feet from the property line. The sign shall be displayed for a period of not less than seven (7) days immediately preceding the date of the public hearing. The applicant or his/her agent shall fate an affidavit that s/he has complied with this provision. C. The Notice will be published in the next issue of the Suffolk Times. Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your application and hearing must be mailed and shall include a map or sketch showing the new ' location with the setbacks and use noted. Send this Notice CERTIFIED MAIL, RETURN RECEIPT REQUESTED, within five (5) days of this letter, including a copy of the plot map of this project, to all owners of land (vacant or improved) surrounding yours, including land across any street or right-of-way that borders your property. Use the current addresses shown on the assessment rolls maintained by the Town Assessors' Office (765-1937) or the County Real Property Office in Riverhead. If you know of another address for a neighbor, you may want to send the notice to that address as well. Please submit your Affidavit of Mailing to us after the receipts have been postmarked by the post office. Later, when the green signature cards are returned to you by the Post Office, please mail or deliver them to us. If any signature card is not returned, please advise the Board at the hearing. A town poster is available for posting (by 11/7). When picking up the sign, a $15 check will be requested as a deposit. When posting the sign, please place it no more than 10 feet from your front property line bordering the street or main access to your property. (If you border more than one street or roadway, an extra sign is enclosed for the front yard facing each additional street.) 3 The sign(s) must remain in place for at least seven (7) days, and if possible, should remain posted through the day of the hearing.
