STREET & LOCATION: Diachun Road (a private right-of-way) extending off the northerly side of Peconic Bay Boulevard, Laurel DATE OF PUBLIC HEARING: January 4, 2001 FINDINGS OF FACT Property Facts/Description: The Applicant, Rose Diachun, is the owner of lands identified on the County Tax Maps as 1000-127-3-9.1 and 10, located approximately 1680 feet north from Peconic Bay Boulevard. The applicant is requesting a determination by the Board of Appeals to establish by variance, minimum construction standards for safe and sufficient access for emergency and other vehicles to travel over the above-identified land, as required by New York Town Law, Section 280-A. New York Town Law, Section 280-A states that no building permit may be issued until minimum standards have been determined. Applicant is proposing a single- family dwelling use at an undetermined future date on Lot 10 with access over lands of Eleanor Diachun from Peconic Bay Boulevard. The remaining lands, are identified as Block/Lots, part of 08-17.3, 08-17.4, 03-10, 03-9.1, 03-9.2, and 03-8, all as shown on a December 7, 1999 survey map, amended January 24, 2000, prepared by John C. Ehlers, L.S. Basis of Application: The Building Inspector's Notice of Disapproval dated October 26, 2000 in the filing of a building permit application for review, Southold Town Zoning Code Article XXIII, Section 100-235-A, and New York Town Law, Section 280-A. Relief Requested: Applicant requests a Variance under New York Town Law, Section 280-A establishing the minimum improvements and standards necessary for access by fire and other emergency vehicles to a future single-family dwelling and possible accessory buildings. Applicant does not meet the minimum access requirements of Section 100-235A of the Southold Town Zoning Code. Board Resolution: On motion by Chairman Goehringer, seconded by Member Dinizio, it was RESOLVED, to GRANT approval under New York Town Law, Section 280-A for access over a private-of-way, subject to the following CONDITIONS and IMPROVEMENTS: l Page 2 -January 18, 2001 ZBA Appl. No. 4902—Rose Diachun 1000-127-3-8, 10, 9.1 and 9.2; 08-17.3 and 17.4 1) the applicant's right-of-way must remain open and unobstructed for a minimum width of 15 feet for its entire length; 2) Improvements, with continuous maintenance in good condition at all times: a) from Town road (Peconic Bay Boulevard) to E. Diachun house on Lot 17.4; b) from E. Diachun house on Lot 17.4 to beginning of wooded vacant Lot #17.3, the right-of-way must be widened to a minimum width of 15 feet and be unobstructed to a minimum height clearance of 15 feet. c)from start of wooded area, part of Lot 17.3, straighten right-of-way as much as possible by removing trees that impede travel. In order to accomplish this the Southold Town Building Department requires the access to her property have New York Town Law §280-a approval . The legal right-of-way to Petitioner, Rose Diachun's property has existed for many years . However, this right-of-way was recently confirmed and physically defined by metes and bounds in a certain Judgment of Partition rendered in New York Supreme Court in the matter of "Rose Diachun v. Eleanor Diachun, Index No. 99-14237, granted on February 9, 2000 and filed in the Suffolk County Clerk' s Office on February 23 , 20-00, a copy of which is attached hereto as Exhibit 1 . The right-of-way is shown on the Southold Town Zoning Map as "PVT #4 Diachun" and is further shown on the survey of John C. Ehlers Land Surveyor amended Jan. 24, 2000 which is attached hereto as Exhibit 2 . This Exhibit also shows all of the properties adjacent to the right-of-way- with the names of the owners and the tax map designations. At the time of granting the 280A improvements, Richard Lark,Esq.hired for his client,a contractor to redefine the ROW and place some crushed concrete on most of the ROW. The purpose of this minor improvement was to create an access to the site so that both the family(Rose Diachtm)and real estate people could show the property. Since that time the ROW has not been improved and no further work has been done. As you know over the years T have inspected these ROW'S and come up with comprehensive improvements to satisfy the 280A requiremeats throughout the Town of Southold, I believe that the decision of 2001 by this Board should stand, however,a few things could be obviated,to address environmental concerns. They are the following: Remove all trees within 5' of east side of ROW,grind stumps rather than excavate, provide drainage in low areas,toward east side away from creek area. Pitch angle for drainage and improvements to east side of ROW and provide an environmental curb on creek side,either by use of RR ties or like so as to stabilize the area adjacent to the wetland. Upon physical inspection of the premises on Saturday November 16th, I found that the right of way is moderately passable to a specific point and impassable from the point on, past your client's lot. Based upon the fact that the owner/owners of the property (not your client necessarily) did some minor improvements with some crushed concrete in the year 2001. This does not meet the specifications of ZBA's 280A standards. The Board in the past has suggested that approximately 50 —60% of the improvement standards be in place prior to the completion of a home being built and then complete right of way improvements prior to the C. O. being granted by the Town. I would be happy at any time to inspect the premises when your client decides to improve this right of way in the future, however, a new appeal procedure is not required for a future subdivision of two lots referred to in your October 23rd inquiry. Diachun. This letter is written not as a ,request to reopen the hearing but to obtain a clarification of some of the conditions as it has caused confusion with real estate brokers and Mrs . Diachun. (Notary Public) ZBA App 08/00 RIDER TO APPEAL FROM DECISION OF BUILDING INSPECTOR APPELLANT: Rose Diachun REASONS FOR APPEAL Petitioner, Rose Diachun, desires to sell her parcel of land (SCTM #1000-127-3-9 . 1 and 10) which contains five acres as one building parcel . In order to accomplish this the Southold Town Building Department requires the access to her property have New York Town Law §280-a approval . The legal right-of-way to Petitioner, Rose Diachun' s property has existed for many years . However, this right-of-way was recently confirmed and physically defined by metes and bounds in a certain Judgment of Partition rendered in New York Supreme Court in the matter of "Rose Diachun v. Eleanor Diachun, Index No. 99-14237, granted on February 9, 2000 and filed in the Suffolk County Clerk' s Office on February 23 , 2000, a copy of which is attached hereto as Exhibit 1 . The right-of-way is shown on the Southold Town Zoning Map as "PVT #4 Diachun" and is further shown on the survey of John C. Ehlers Land Surveyor amended Jan. 24, 2000 which is attached hereto as Exhibit 2 . This Exhibit also shows all of the properties adjacent to the right-of-way with the names of the owners and the tax map designations . The legal description of the right-of-way for which the New York Town Law §280-a approval is requested is attached hereto as Exhibit 3 . Petitioner agrees as a condition of approval that before a Certificate of Occupancy is granted for a residential dwelling on her property that the traveled portion of the right-of-way to her property will be 15 feet in width of suitable material for a traveled surface with a clearance of 15 feet for ingress and egress of fire trucks, ambulances and police cars as required by New York Town Law §280-a. The Department objects to the proposed increase in width of the roadway less than 75 feet from the tidal wetlands. The increase in the width of the roadway in close proximity to the tidal wetlands will result in a loss of the adjacent area/buffer vegetation thereby reducing the tidal wetlands function to absorb nutrients and runoff and diminishing the character, quality and value of the adjacent tidal wetlands. Therefore, the Department will not authorize the proposed widening of the roadway as proposed. Department staff met with you and the Southold Town Trustees at the project site earlier this year. At that time, it was agreed by all parties that the width of the roadway would not change. Additionally, it was agreed that the roadway could be shifted to the east away from the tidal wetlands in two (2) locations and the majority of work occurring within the existing road bed. Stone and clean fill could be placed in some locations that are very low or potholed. This is what was agreed to by all parties and the only work that can be approved by this Department. If you want to proceed with this application, then please provide four(4) copies of revised plans showing the proposed work that was agreed upon at the meeting. STREET & LOCATION: Diachun Road (a private right-of-way) extending off the northerly side of Peconic Bay Boulevard, Laurel DATE OF PUBLIC HEARING: January 4, 2001 FINDINGS OF FACT Property Facts/Description: The Applicant, Rose Diachun, is the owner of lands identified on the County Tax Maps as 1000-127-3-9.1 and 10, located approximately 1680 feet north from Peconic Bay Boulevard. The applicant is requesting a determination by .the Board of Appeals to establish by variance, minimum construction standards for safe and sufficient access for emergency and other vehicles to travel over the above-identified land, as required by New York Town 1. Law, Section 280-A. New York Town Law, Section 280-A states that no building permit may be issued until minimum standards have been determined. Applicant is proposing a single- family dwelling use at an undetermined future date on Lot 10 with access over lands of Eleanor Diachun from Peconic Bay Boulevard. The remaining lands, are identified as Block/Lots, part of 08-17.3, 08-17.4, 03-10, 03-9.1, 03-9.2, and 03-8, all as shown on a December 7, 1999 survey map, amended January 24, 2000, prepared by John C. Ehlers, L.S. Basis of Application: The Building Inspector's Notice of Disapproval dated October 26, 2000 in the filing of a building permit application for review, Southold Town Zoning Code Article XXIII, Section 100-235-A, and New York Town Law, Section 280-A. Relief Requested: Applicant requests a Variance under New York Town Law, Section 280-A establishing the minimum improvements and standards necessary for access by fire and other emergency vehicles to a future single-family dwelling and possible accessory buildings.
