No. 4953 — HENRY L. FERGUSON MUSEUM PARCEL 1000-9-4-11.1 STREET & LOCALITY: Corner of Equestrian Avenue, West St. and Bell Hill Ave, Fishers Island DATE OF PUBLIC HEARING: June 7, 2001. FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The above identified property is preexisting and contains a nonconforming use in this R-80 Residential Zone District on Fishers Island, and consists of an areo of 3.21+- acres with 186+- ft. frontage along Equestrian Avenue. This property adjoins properties in a quaintly developed Hamlet Business (HB) Zone District occupied by the commercial buildings of the village center. The parcel is improved with one museum building which is owned and occupied by the H. Lee Ferguson Museum, Inc., a not-for profit private foundation. The original one-story building was constructed in 1972, with an additional expansion in 1990. The remaining portion of the property is occupied by a rustic wetlands-wildlife sanctuary which is freely open for public access from any of the three public roads around the property. BASIS OF APPEAL: Building Inspector's April 11, 2001 Notice of Disapproval for the reasons that (a) under Article III, Section 100-32, the proposed addition to the existing museum building is proposed with a front yard setback of 41.5 feet instead of the required 60 feet on this lot, and (b) under Article XXIV, Section 100-243A.1 a for the reason that the proposed addition will increase the size of this nonconforming nonresidential building, resulting in an overall building footprint of more than 15 percent. AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The request made by applicant is for proposed additions as shown on the March 6, 2001 site plan prepared by Chandler, Palmer & King. The front yard setback for a porch at its closest point is proposed at 29 feet. All other areas of the proposed addition are proposed at 40 feet. REASONS FOR BOARD ACTION BELOW: (1) Granting of an area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because the presence of the Museum and its adjacent wetlands wildlife sanctuary, situate upon a 3.21+- acre parcel, actually enhances the character of the neighborhood, and also the value of surrounding and nearby properties. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because—the overall topography of the parcel, which contains a small museum building and a scenic wetlands wildlife sanctuary, places severe limitations upon the location and direction suitable for what the applicant presents as a desired, as well as necessary, expansion of this building. This setback distance for the porch is proposed at 29 feet, and as.noted on the Building Department Notice of Disapproval dated April 11, 2001, as 41.5 +- feet from the road for the building addition, is actually slightly more of a setback than the 38 ft. that was approved in former ZBA Appl. No. 4671 dated March 25, 1999. (4) There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district, and the adjoining Hamlet Business zoned neighborhood contains commercial buildings that are set much closer to the street. (5) The difficulty has not been self-created and relates to the topography of the parcel. In considering this application, the Board deems this action to be the minimum necessary and adequate for the applicants to enjoy the benefit of an addition, and that the grant of this variance will preserve the character of the neighborhood, and the health, safety, welfare of the community. I have taken the liberty of jotting down a few thoughts on why the Ferguson Museum Board chose to make changes in the plans. I hope this assists you in answering the Town's questions. After the variance was granted the Ferguson Museum hired a museum consultant and a professional objects conservator to assist with the project. These individuals identified several issues in the then current plans which were at odds with the museum carrying out its mission. Museums, by nature of their not-for-profit status have a legal public trust responsibility to care for the collections they hold. Some aspects of the plan did not address this public trust responsibility. For example, the original plans proposed a building with too many windows and the wrong type of windows needed in spaces where artifacts and museum collections would be displayed. Thus, artifacts would be exposed to unacceptable levels of W light. Windows which could be opened would subvert the climate control system needed to preserve the collections. In addition, the former plans contained no collection storage areas. Given the size and scope of the Ferguson Museum's collections, lack of appropriately sized collection storage would lead to improperly stored collections and potential damage. Visitor and collection safety was also a concern in considering changes to the design. As the structure had been designed there were too many parts of the building which could not be seen by centrally located museum personnel. There were several galleries and hallways that the docent stationed at the entrance could not see. The new plan provides almost unobstructed viewing of the entire museum from the docent's desk. In adding the deck and viewing station to the Museum's plans several objectives were met. Some exhibits, such as geology specimens and live bug exhibits, are best kept physically separated from paintings, photographs, and documents. Therefore, the need to have outdoor space connected with the museum building was critical to preserving the collections while executing the museum's mission to interpret these aspects of our community. Involving the structure of the museum building with the nature sanctuary behind the museum provides increased handicapped accessibility to the nature sanctuary by way of the viewing station. I have taken the liberty of jotting down a few thoughts on why the Ferguson Museum Board chose to make changes in the plans. I hope this assists you in answering the Town's questions. After the variance was granted the Ferguson Museum hired a museum consultant and a professional objects conservator to assist with the project. These individuals identified several issues in the then current plans which were at odds with the museum carrying out its mission. Museums, by nature of their not-for-profit status have a legal public trust responsibility to care for the collections they hold. Some aspects of the plan did not address this public trust responsibility. For example, the original plans proposed a building with too many windows and the wrong type of windows needed in spaces where artifacts and museum collections would be displayed. Thus, artifacts would be exposed to unacceptable levels of W light. Windows which could be opened would subvert the climate control system needed to preserve the collections. In addition, the former plans contained no collection storage areas. Given the size and scope of the Ferguson Museum's collections, lack of ' appropriately sized collection storage would lead to improperly stored collections and potential damage. Visitor and collection safety was also a concern in considering changes to the design. As the structure had been designed there were too many parts of the building which could not be seen by centrally located museum personnel. There were several galleries and hallways that the docent stationed at the entrance could not see. The new plan provides almost unobstructed viewing of the entire museum from the docent's desk. In adding the deck and viewing station to •the Museum's plans several objectives were met. Some exhibits, such as geology specimens and live bug exhibits, are best kept physically separated from paintings, photographs, and documents. Therefore, the need to have outdoor space connected with the museum building was critical to preserving the collections while executing the museum's mission to interpret these aspects of our community. Involving the structure of the museum building with the nature sanctuary behind the museum provides increased handicapped accessibility to the nature sanctuary by way of the viewing station. This property adjoins properties in a quaintly developed Hamlet Business (HB) Zone District occupied by the commercial buildings of the village center. The parcel is improved with one museum building which is owned and occupied by the H. Lee Ferguson Museum, Inc., a not-for profit private foundation. This 2,330+- sq. ft. one-story building was constructed in 1972,with an additional expansion in 1990. The current lot coverage is 1.7% and the new addition would increase lot coverage to 2.6% as proposed. The remaining portion of the property is occupied by a rustic wetlands-wildlife sanctuary which is freely open for public access from any of the three public roads around the property. BASIS OF APPEAL: The Building Inspector's February 2, 1999 Notice of Disapproval, under Article XXIV, Section 100-241-A in which a building permit was requested for an addition to an existing museum,a nonconforming use in this R-80 Zone District. VARIANCE RELIEF REQUESTED: Applicant is requesting an additional building area of 1,315 sq. ft. for the museum. The proposed addition would further reduce the existing setback from the nearest corner of the building to the Town right-of-way from 41.5 feet to 28.8 feet. The R-80 Residential Zone District requires a minimum front yard setback of 60 feet (or the average within 300 feet on the same block and same side of the street). Equestrian Avenue contains a side walk on the museum side of the road and the distance to the center of the sidewalk from the closest point of the proposed addition would be 38+- feet and the distance to the edge of the existing pavement of Equestrian Avenue would be 45+- feet. y... No. 4671 Re: 1000-9-4-11.1 (Ferguson) ZBA Decision - March 25, 1999 l REASONS FOR BOARD ACTION, DESCRIBED BELOW: With regard to Section 100-241A, the Board of Appeals is cognizant of the fact that this use (museum sanctuary) has existed on this property since 1972. This use is acknowledged as having a positive beneficial impact upon the surrounding more densely developed neighborhoods, both commercial and residential, because the museum occupies such a small percentage of the parcel which is otherwise designated to publicly accessible open space. The Museum provides a vital and beneficial service to Fishers Island. It is the repository of a wealth of knowledge which encompasses both local history and a realm of natural sciences. In order for the Museum to continue fulfilling its mission on Fishers Island in a positive and progressive manner, it is essential that it be allowed to expand its premises. Such expansion will be an enhancement rather than a detriment to the character of the neighborhood and nearby properties because the museum occupies a special niche in this small community and its mission is overwhelmingly supported by the residents. With regard to Section 100-32 (Bulk, Area and Parking Regulations) and while there is no other feasible way for the applicant to accomplish an increase in museum space for the purpose of creating additional exhibit display and storage facilities, the only , ) feasible method is for the requested encroachment into the front yard setback facing Equestrian Avenue. As a result and due to topographical constraints on the property, the Board concludes that a museum addition will not change or expand the existing use because it will be for exhibits and displays related to the Museum,which exists. 1) The granting of the variance will not produce an undesirable change in the character of the neighborhood or be a detriment to nearby properties because the presence of the Museum and its adjacent wetlands wildlife sanctuary, situate upon a 3.21+- acre parcel, enhances the character of the neighborhood and also the value of nearby properties. 2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the topography of the parcel, which contains a small museum building and a scenic wetlands-wildlife sanctuary, places severe limitations upon the location and direction suitable for expansion of the building. 3) The requested variance is substantial only in respect to the proposed front yard setback from the Town right-of-way known as Equestrian Avenue. The distance to the center of sidewalk from the closest point of proposed addition is 38+- feet and the distance to the edge of existing pavement is 45+- feet. 4) There is no evidence that the grant of the variance will have an adverse effect or i impact on the physical or environmental conditions in the neighborhood or district �� because the adjoining Hamlet Business zoned neighborhood contains commercial buildings that are much closer to the street.
