No. 4984—SAM and PHYLLIS CONSTAN Parcel No. 1000-98-5-17.5 STREET & LOCATION: 6002 Indian Neck Lane, Peconic DATE OF PUBLIC HEARING: August 16, 2001 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's property is an improved lot located off the south side of Indian Neck Lane in Peconic, with access along a 16' right-of-way. The applicants' property contains 3.324 acres with 221.31 feet on Hog Neck Bay. BASIS OF APPLICATION: Building Inspector's May 30, 2001 Notice of Disapproval, denying a permit to build alterations to the existing one-family dwelling with a height above 2-1/2 stories as provided under Section 100-32 of the Zoning Code because the existing upper area referred to as a "third level" by the Building Department will be altered with a bathroom area. AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance authorizing alterations within the interior of the existing single-family house by adding a bathroom to the upper bedroom area, which upper area has existed for many years for use as two bedrooms. The proposed bathroom will be using the upper-most floor area, which has been used as a bedroom/closet area, not newly finished space. ADDITIONAL INFORMATION: The applicant acquired the property with single-family dwelling on August 1, 2000 by deed recorded at Liber 12064 cp 806 (Cost: $1.86M without new renovations/alterations). REASONS FOR BOARD ACTION. DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. The architectural plans dated 3-17-01 show an existing third-floor bedroom area and attic areas. 2. The existing house has various roof lines and angles. As read from the plans, the average height is within the 35-foot limit of the Code. The square footage of the third-floor bedroom suite is less than 25 percent of the ground floor footprint, and the presence of the third floor does not affect the compliance of the roofline with the 35-foot limit. Page 2—September 20, 2001 ZBA Appl. No. 4984—S. and P. Constan Parcel 1000-98-5-17.5 at Peconic 3. The elevation drawing shows that there will be no height change to the exterior. The height of the new bathroom area is within the roof lines of the existing dwelling as well as adjacent loft and additional living area. 4. The house is set back about 900 feet from Indian Neck Lane, a public street. 5. Based on the information provided and the foregoing factors, the Board concludes that applicant/agent failed to prove sufficient reason as to why a comprehensive fire suppression sprinkler system cannot be installed in this home built in the 1920's which is undergoing a total renovation with most internal walls removed at time of Board Member inspection. 6. The nature of the application was to construct habitable additions to the third story of this large dwelling within existing Tudor-style roof. 7. After physical inspection by the Board, the following was found on the third story: a) Two preexisting seasonal bedrooms; b) Open unfinished areas adjacent and contiguous to these rooms; c) Large vaulted loft over the (lower) living room/family room areas; d) Proposed third-story bathroom facility. 8. Testimony from the applicant's architect indicated that large vaulted area over the first story was in fact the second story of the new addition. The vaulted area above living area is to be used as living area and is accessible from third story level. These areas are therefore deemed to be third-story living area. In summary, the action of the Board is the minimum necessary to construct the alteration and installation of a new bathroom facility and vaulted living area as mentioned within the confines of existing roof lines of the Tudor-style steep roof, while preserving and protecting the individual occupants and residents of the dwelling, as per Code, to include all new and existing construction, on all floors. RESOLUTION/ACTION: On motion by Chairman Goehringer, seconded by Member Tortora, it was RESOLVED, to require a comprehensive fire-suppression sprinkler system in all habitable rooms of said dwelling as per Code to include all new construction areas, on all floors; and BE IT FURTHER Page 3—September 20, 2001 ZBA Appl. The residence is a 1928 Tudor style two-and-one-half story brick and half-timber house with a slate roof. In this Appeal we seek permission to add a new Bathroom to the "third floor" to serve the existing two bedrooms. STRICT APPLICATION OF THE ORDINANCE would produce practical difficulties or unnecessary HARDSHIP because it would limit the usefulness of existing "third floor' Bedrooms, by prohibiting the addition of a bathroom to serve them. Mr. and Mrs. Constan and I share your concern for the safety of their family and future occupants in the house in Peconic, and intend to satisfy those concerns as part of this process. As you know, the third floor of the house has been used as bedrooms since the house was built in 1928, and was recently given a Certficate of Occupancy by the Building Department (enclosed)_ The proposed bathroom actually reduces the size of one of these rooms, thereby reducing the "non-conformity". Whether of not a bathroom is built, this use will continue, but we intend to take several measures to improve the safety of these occupants, in any case. Enclosed you will find a letter from the owner, Sam Constan, who has worked in the building materials industry for many years. He details the fire safety measures intended, which include detection (as per Code), separation (increased fire-ratings and doors), suppression (limited sprinklers and extinguishers), and egress (ladders and training). Together these measures would vastly improve the fire safety of the occupants, not only on the third floor, but in the entire house. We hope to avoid the need to sprinkler the entire structure for a few reasons. For one, the cost is significant (we received a bid of$70,000). Additionally, though small, sprinkler heads are unsightly, and will intrude on the aesthetic purity of our interiors. Goehringer, Chairman Town Hall Southold, NY 11971 Dear Members of the Southold Town Zooing Board of Appeals: Thank you for including our request for a bathroom installation variance (in our home at 6002 Indian Neck Lane) on your agenda the night of August 16, 2001. Although dwelling use of the third floor appears to remain our perogative and not being able to use the existing space for other purposes was confusing, your concerns for our safety, however, were clear and well received. I spent nearly my entire working career in the employ of the United States Gypsum Co. We manufactured quality products with particular concern for fire safety. USG may have more UL fire and smoke penetration tested partitions and ceiling assembly systems than any other manufacturer. With a thorough appreciation of the benefits of taking fire and smoke safety precautions, we intend to do the following: 1. Sprinkler the third floor and the nearly continuous stairwell to the first floor. The result would be to extinguish any fire originating in the third floor and provide the third floor occupants with equal access to exit as those on the second floor. 2. Install smoke and heat detectors throughout the house and integrate with the sprinkler system 3. Surface all walls and ceilings with USG 5/8 Sheetrock Firecode (Type X) which will provide roughly 27 minutes (UL fire tests) of additional ceiling assembly and partition protection as compared to conventional 1/2 wallboard surfaces. 4. Install fire extinguishers &/or ready to use valved fire hoses strategically to insure protection for all dwellers and those on the third floor in particular. 5. Install a fire rated door leading from the second to the third floor to provide additional protection to third floor occupants. 6. Provide window safety ladders to enable third floor occupants to exit the house without corning down through the house. The ladders would allow a one story descent to the roof of the screened porch and then another ladder to the ground. 7. Train occupants of the third floor, in fact all dwellers, on fire and smoke escape practices by conducting regular fire drills. Post the basics on a board in the third floor 8. If there are smoke protection masks and fire protective gowns to assist in successful escape,purchase them and make them readily available on the third floor. • 08/27/2001 5167346407 SAMUELSSTEELMAN PAGE 05 These are the measures we intend to take anyway We hope that you will agree with us that the fire safety concerns have been addressed effectively and that converting some of the existing space to a bathroom is acceptable. In fact, providing a bathroom on the third floor would meet the sanitary and comfort needs of those availing themselves of the facility. It also would satisfy health and safety considerations. Finally, no one is more concerned with the health and well being of our grandchildren, children and friends than we are. We hope that they will come to stay with us often. I took him that sketch about a week ago or 10 days ago and they have no objections at all to what they want to do. They just were hoping that he'd be 150 ' back from the beach. MRS. ROSENBERG: We are. THE CHAIRMAN: I think that the sketch here shows the location of the southerly . . . the southerly side -of the building will be, I don't know whether it's 150 ' or 180 ' , I can 't read this here. It' s 150 '? MRS. ROSENBERG: At least if not more. THE CHAIRMAN: And that the building will be 30 ' in width and of considerable length. Deducting the 30' from the 65 ' width of the property would indicate that there are 35' remaining for what are technically the front and rear yards. I think it would be my suggestion that the rear yard be at least, no portion of the rear of the building to be constructed should be closer than 15 ' to the westerly side line. MRS. ROSENBERG: In other words, there should be a separation of at least 15 ' from the borderline of the Seagyan Club. THE CHAIRMAN: I think that is approximately the same distance the greenhouse is from the borderline now. Access to this, I believe, is . . . you don't need access to this, do you? You haven't applied for it. You're coming in over the regular road that' s been used for years. MRS. ROSENBERG: Right, a driveway which goes approximately down the center to the property. THE CHAIRMAN: Is there anyone who would like to look at this plot plan? (There was no response. ) After investigation and inspection, the Board finds that the applicant requests permission to construct dwelling on lot l Southold Town Board of Appeals -9- January 12 , 1978 with insufficient width, south side Indian Neck Lane, Peconic, New York. The findings of the Board are that this division of the property provides Dr. Rosenberg with a plot of 1.42 acres. The total area of the Rosenberg property is 7.9.
