No. 4921 - DORIS ANDERSON (owner) and JOHN HURTADO STREET & LOCATION: 3400 Lighthouse Road, Southold; 1000-50-2-2. DATE OF PUBLIC HEARING: April 5, 2001; April 19, 2001; June 7, 2001. FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's property is a vacant 23,260 sq. ft. lot, located on the corner of Sound View Avenue and Lighthouse Road, Southold. The property has a frontage of 100 feet on Lighthouse Road and 50 feet on Soundview Avenue. Roughly 40 percent of the property is located below the top of the bluff and extends to the L.I. Sound. BASIS OF APPLICATION: Building Department's December 20, 2000 Notice of Disapproval denying a permit for a new dwelling with setbacks at less than 100 feet from the top of the bluff in violation of Section 100-239.4A.1, and less than 35 feet for combined side yard setbacks and less than 40 feet from the front property line on Lighthouse Road, in violation of Section 100-244. AREA VARIANCE RELIEF REQUESTED: Applicant John Hurtado requests variances authorizing the location of a house measuring 40 feet wide by 49 feet deep at the deepest point, set back 50 feet from the bluff and 36 feet from Lighthouse Road, and angled on the property in such a way that the minimum side yard on each side is 15 feet. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. The shape of the lot is such that a house complying with the 100-foot bluff setback would be possible only if it were built with virtually no setback from Lighthouse Road and Soundview Avenue. Some variance from the bluff setback requirement is necessary for any house to be built. 2. Applicant's request for side yard variances is based on his proposed siting of the house at a slight angle to the side property lines. If the house is sited with its side walls parallel to the property lines, no side yard variance is needed. The Board concludes that such siting is a feasible alternative to the grant of side yard variances. 3. Applicant originally proposed a house 40 feet wide, 49 feet deep, and 50 feet from the bluff, with its southwest corner set back 36 feet from Lighthouse Road. Following • Page 2 —July 12, 2001 Appl. Anderson) 1000-50-2-2 at Southold hearings, applicant amended his plan to propose a house 40 feet wide by 40 feet deep at its deepest point, a reduction of the footprint from 1860 sq. ft. to 1500 sq. ft. Possible locations for the proposed house were outlined in correspondence from applicant's attorney dated June 25, 2001. 4. Applicant testified that at the request of the Town Trustees, a retaining wall will be built landward of the top of the bluff. A report from Suffolk County Soil and Water Conservation District emphasized the importance of leading all drainage from the house away from the bluff. The Board will place a condition on the variance with the intent of preventing adverse effects on physical or environmental conditions. 5. The action set forth below will enable applicant to construct a house of approximately the size set forth in his amended proposal dated June 25, 2001, in a location that complies with the Code's side yard requirements and deviates minimally (at the southwest corner)from the front yard requirement, while set back 60 feet from the bluff. The Board concludes that this action will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. 6. The action set forth below is the minimum necessary to enable applicant to build a house on the subject lot while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION/ACTION: On motion by Chairman Goehringer, seconded by Member Tortora, it was RESOLVED, to DENY the variances applied for, and ALTERNATIVELY to GRANT a variance authorizing construction of a house with setbacks of (1) no less than 60 feet from the top of the bluff at the closest point, and (2) no less than 38 feet from the property line facing Lighthouse Road at the closest point, subject to the CONDITION that the house shall be equipped with gutters and leaders adequate to collect all water runoff and to direct such runoff to drywells located well away from the bluff. Kindly accept this letter as a timely response to your June 29, 2001 letter to me . • At the June 7, 2001 hearing, at least the following points were raised or circumstances occurred: 7 . There should be a cross sectional drawing of the retaining wall and fill so as to permit an analysis of the water runoff and erosion risks . The applicant's engineer acknowledged the criticism was fair and assured such a drawing would be supplied. There has been no drawing supplied; 2 . There should be a single and separate search. There has been no single and separate search supplied; 3. The hearing was closed on June 7 , 2001 ; 4 . Since June 7 , 2001, the applicant submitted an alternate design showing a 40 foot by 45 foot house but reoriented on the sideyards so as to maintain 20 foot and 15 foot sideyards . This proposal is unacceptable to the Prials because the house is so large that its construction will have a detrimental effect on the Prial premises . As an alternative, the applicant submitted a drawing on June 2B, 2001 with red ink showing a reduction in the size of the house by 9 feet measured front to back and a corresponding increase in the bluff setback to 59 feet. Of the alternatives submitted this is the superior plan because the setback from the bluff is greater, but the Prials respectfully request that the setback be increased from 59 feet to 65 feet, as a result of which the Prials may retain some western light on their living area. Starting at the coastal zone line we have an existing contour of 66 feet running west to east. The next topo line is 25 to 30 feet parallel to the 66-foot contour and is 68 feet elevation. The next contour line is slightly skewed from 25 to 40 feet and is at 70 feet elevation. The remaining area of the site goes down to 68.5 elevation in the south/east corner and 71.4 elevation in the south west corner. The grade of the existing site in essence,runs down to the bluff The only proposed re-grading will be the addition of the retaining wall requested by the Southold Trustees. This retaining wall will be placed on the 66-foot contour and will raise the grade 3 feet. The retaining wall will have an elevation of 69.2 to match the top of the existing retaining wall on the west side (Reininger). The wall will have a 20-foot return on the east side to not disturb the property to the east(Prial). The soil will slope from 69.2 south to the existing contour of 68. This will allow the runoff to be contained on the site and be picked up by the required 8-foot drywell in the north/west corner of the house. The only other new grading proposed for the property will be the standard grading around the new foundation. This usually consists of a 1/2 inch per foot pitch away from the foundation for 4 to 5 feet. I hope this clears up any questions the :.oard embers have. Your deponent respectfully draws to the Zoning Board's attention the elevations at the southeast corner ( 68 .5 feet) and the northeast corner (65 .2 feet ) of the upland portion of the Hurtado lot. The first floor elevation for the proposed house is 73.5 feet. This means that the proposed Hurtado house at its first floor will be eight feet higher (73 .5 minus 65 . 2 ) than the preexisting natural grade, essentially the height of a full basement above natural grade, emphasizing again the difference between the scale of the proposed Hurtado house and any other nearby residence. 8 . Unless the size of the proposed Hurtado house is reduced, if it is built at 50 feet from the top of the bluff, the effect will be to reduce the present value of the Reiniger house and the Prial house, particularly the latter, to a substantial degree. 9 . In short the Doris Anderson lot is not big enough to contain the proposed Hurtado house and its placement and size - 2 - Jun-05-01 11 _47A P_04 impact adversely the adjacent parcels because the lot is so small. 10 . Date of the visit was April 4, 2001. We found the area, to be developed, cleared and staked for the house corners. Slopes on the lot are toward the street from the front of the proposed house and toward the bluff face from the front of the proposed house and back. We noted that the plan calls for drainage of • the roof runoff for all four corners, this is highly recommended. There is another drain on the west rear side of the proposed house, which appears to be for yard drainage. This should be sized according to the minimum standards and specs allowed by the Town for the area to be drained. The proposed retaining wall will add excessive weight to the top of the bluff and should be located and designed by a Professional engineer. We suggest contacting Jay Tanski at New York Sea Grant Extension Service, phone 632-8730 for recommendations on any stabilization structures. The bluff face from above is very heavily vegetated by trees, briars, grasses and weeds. Not much could be seen from this vantage point. The Bluff Face could not be evaluated due to a lack of access to the toe of the bluff. The location of the house will put all surface water runoff toward the bluff face so it is very important that all of the runoff be directed into the ground and not allowed to flow over the bluff top. It appears that the plan takes this into account, however someone should review the retaining wall that has expertise, such as Jay Tanski. I followed up by contacting Mr. Jay Tanski at the Sea Grant Extension Service to go over my design for the retaining wall. A result of that discussion reveals that the attached design and the location on the site plan will have no detrimental effect on the bluff. The design has taken the following into consideration: 1. The normal angle of repose for a bluff consisting of sand would be 32' to 34'. Tighter materials such as clay would increase the angle, while heavier gravels would lower the angle. The existing bluff, from the test boring shows clayey sand with gravel in layers to 61 feet below the surface. We can assume that because of the clayey soil the stable bluff angle would be around this range. 2. The angle of the existing bluff is 33',which is basically its angle of repose and is generally in a stable condition. 3. The location of the retaining wall is below the extended bluff angle. This means that any additional fill required to complete the backfilling of the retaining would not de-stabilize the bluff. The design of the timber retaining wall as attached and its location as shown on the site plan in my opinion will have no negative effects on the bluff. K267(1) of Town Law. The new Statute no longer includes the term "practical difficulty" or any particular test, and now provides that ZBAs consider two basic things: 1.• the benefit to the applicant if the variance is granted; and 2. the detriment to the health, safety and general welfare of the neighborhood or community that would occur if the • variance were to be granted. BALANCING TEST: In balancing the interests above, ZBAs must also consider the following five factors for an AREA VARIANCE: 1. whether an undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if granted; 2. whether the benefit sought by the applicant can be achieved by some method, feasible for the applicant to pursue, other than an area variance; 3. whether the area variance is substantial; 4. whether the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district; and 5. whether the alleged difficulty was self-created, which consideration shall be relevant to the ZBA's decision but shall not preclude the granting of an area variance. Also, as part of the "balancing concept," the new Statute provides that the ZBA shall grant the minimum variance that it shall deem necessary and adequate, and at the same time preserve and protect the character of the neighborhood and the health, safety and welfare of the community.
