No. 4910 — Nicholas Bubany Street & Location: 160 Shipyard Lane, Southold 1000-64-2-51 Date of Public Hearing: February 28, 2001 Findings of Fact PROPERTY FACTS: The subject parcel contains 10,125 sq. ft. of land area and is improved with a frame single-family dwelling and frame garage, as detailed on the August 18, 2000 survey prepared by Peconic Surveyors, P.C. The garage is about eight (8) feet from the north side of the house and connected to the house by a trellis. The garage measures 12.2 x 22.2 feet and approximately eight (8) feet of the 22.2 ft. depth lies forward of the rear line of the house, and therefore in the side yard. BASIS OF APPLICATION: Article III, Section 100-33, based on the Building Department's October 30, 2000 Notice of Disapproval for the reason the accessory "garage is located within side yard." RELIEF REQUESTED: Applicant requests a variance authorizing the garage in the current side-yard location, so that a Certificate of Occupancy can be issued. BOARD REASONS: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: (1) The dwelling was built in 1960 by applicant's father. The garage was built in 1961. The Town issued a Certificate of Occupancy for house on July 20, 1960. (2) The Applicant, Mr. Bubany (former owner, appearing with authorization of new owner), testified his father understood that when the garage was built, his father understood that it was considered part of the house and that the Certificate of Occupancy (C.O.) for the house covered it. Since there is in fact no C.O. for the garage, and a building permit application was recently denied by the Building Department because of its side-yard location, Applicant needs a variance. (3) The Applicant submitted letters from three former building inspectors, stating that when the garage was built, attachment to the house by the trellis was sufficient for the garage to be considered part of the house. Page 2—February 28, 2001 Appl. No. 4910—N. Bubany (64-2-51) Southold Town Board of Appeals (4) The garage and house have been in place for 40 years, and are an established part of the neighborhood. The intrusion into the side yard is only eight (8) feet, and the garage setback from the property line is greater than the three (3) feet required for an accessory structure. For these reasons, grant of the requested variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. (5) There is no evidence that grant of the requested variance will have an adverse effect or impact on physical or environmental conditions. (6) The action set forth below is the minimum necessary and adequate to enable applicant to obtain a permit and Certificate of Occupancy for the 40-year-old garage while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. It has remained in this location to the present date. The garage is attached to the house by wooden lattice work and between the garage and the house is a concrete patio. The location of this house and garage has existed for 40 years and has not been and will not be a detriment to neighboring properties. (2) The benefit sought by the applicant CANNOT be achieved by some method feasible for the applicant to pursue, other than an area variance, because: Unless the garage is physically removed and some how attached to the house itself, a variance to allow it to continue in the side yard area is the only feasible method of relief. (3) The amount of relief requested is not substantial because: Considering the neighborhood, the sizes of the lots and the single family homes contained thereon, the fact the garage is not in the front area but is recessed in the side yard area set back from the neigiboring property by 4.9 feet, the granting of the side yard variance will not be substantial. (4) The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district because: Everything will remain exactly the same which to date has not caused any adverse affect in the neighborhood. BUBANY, being duly sworn, deposes and says : 1 . For alternative relief, the applicant is seeking an interpretation of the Building Inspector' s determination that a variance is required to obtain a Certificate of Occupancy for an accessory garage erected in the side yard in 1961, and was attached to the primary dwelling by wooden lattice work. 2 . My parents, John and Mary Bubany, bought a vacant lot at 160 Old Shipyard Lane on August 27, 1951 . In 1958, when I was 17 years old, my parents decided to build a house and garage on this lot . The builder was Joseph Raddich and he completed the house in the summer of 1960 . I remember when my family moved into the house in the summer of 1960 . This is also verified by the date of, the Certificate of Occupancy which is July 20, 1960 . I remember the family was informed by the builder we could not occupy the house until there was a Certificate of Occupancy for it . 3 . Shortly after we moved into the house, Mr. Raddich began the construction of the garage. I remember my father and Mr. Raddich discussing the exact location of the garage . My father wanted it set back from the front of the house but not completely in the rear yard area. Mr. Raddich informed my father in order to have the garage where he wanted it, it would have to be attached to the house, which was done by a lattice-type trellis which still exists today. Even though this lattice panel was sufficient at the time to be a legal garage in this side yard area, my father also built a grape arbor which went from the rear of the garage to the house. The steel brackets are still on the garage wall and the holes in the concrete vertical 2 x 4 support. posts exists today. After my father' s death in 1975, the grape arbor slowly rotted away and I removed it several years ago. 4 . My father understood the lattice panel connection made the garage a part of the house . He did not realize he had to get a separate Certificate of Occupancy for the garage, as the assessors inspected everything and placed the garage on the tax roll in 1961 . Knowing my father' s respect for the law, if he knew he had to get a separate Certificate of Occupancy for the garage he would have done so. 5 . My mother lived in the house until 1999 when she had to go to the hospital and then subsequently in San Simeon Nursing Home . She died on May 5, 2000, and I had to sell this house to pay for her expenses at the nursing home. 6 . After the house was under contract for the sale to Jay and Rosemarie Mansdorf, I was advised there was no Certificate of Occupancy for the garage . There was some urgency to close on the title to the house because (1) I needed the money to pay the nursing home and (2) the purchasers, Jay and Rosemarie Mansdorf, wanted occupancy. In order to do this, at the closing on September 28, 2000, I had to put a deposit of $10, 000 . 00 in escrow with their attorney until a Certificate of Occupancy was obtained for this garage . In preparation for the Zoning Board of Appeals review of this matter, I have included the following: 1 . Notice of Disapproval from Southold Building Department dated October 30, 2000 . 2 . Application for Building Permit for garage dated August 1, 2000 . 3 . Certificate of Occupancy for dwelling dated July 20, 1960 . 4 . Copy of Deed between Nicholas W. Bubany and John J. A letter from Don Feiler (Architect) stating that the house and garage were "attached". 3. For applications involving fences, accessory structures or accessory buildings, alterations or additions containing less than two hundred (200) square feet in floor area, the fee shall be one hundred fifty dollars ($150.).
