No. 5054 -JOHN AND PATRICIA STACK SITE LOCATION: 7650 NASSAU POINT ROAD, CUTCHOGUE 118-3-4.1 BASIS OF APPEAL: Building Department Notice of Disapproval dated August 14, 2000 denying a permit for accessory sheds because one is located in a front yard and the other in a side yard of the property rather than the code-required rear yard pursuant to Article III, Section 100.33. AREA VARIANCE REQUESTED: Applicant wants to relocate a 8' by 10' existing shed, approximately 1 feet from the side yard of the north property line to a minimum side yard set back of 10 feet. Applicant originally requested a variance to relocate the second 10' by 14' accessory shed, now located approximately 2' from the north side yard property line to a minimum a 8.3 feet. FINDINGS OF FACT • The Zoning Board of Appeals held a public hearing on this application on February 21, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: PROPERTY FACTS: The subject property contains 48,724 sq. ft. and is located on the west side of Nassau Point Road and 'on the east side of Goldfish Pond Road. The property is improved with applicant's single and two-story residence, detached garage, in-ground swimming pool and two accessory sheds, according to the survey prepared by John C. Ehlers, Land Surveyor, dated January 26, 200, last amended June 15, 2001. ADDITIONAL INFORMATION: The property has two front yards with frontage on Nassau Point Road and Goldfish Pond Road. Board members personally inspected the property and found that the existing location of the 10' by 14' shed is preferable to moving it 6'+- in from the north property line because it is now well-screened from view by mature evergreens, and if it is moved further off side yard property line, it would be too close to the stone driveway to permit clear access to the garage, or for that matter for emergency access to the interior property. REASONS FOR BOARD ACTION: In accordance with the review standards set forth in Town law 267-b 3 "Area Variances", the board has considered the benefit to the applicant if the variance is granted, as weighed against the detriment to the health, safety and welfare of the neighborhood and community by such grant, and determines that: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties . A variance to permit the "as built" 10' by 14' accessory shed to remain in its side yard location will have no effect on neighboring properties R Page 2—February 28, 2002 Appl. No. 5054—J. Stack 1000-118-3-4.1 at Cutchogue because it is well-screened and barely visible from view on Nassau Point Road. The second accessory shed is located in the middle of the property approximately 150' from Nassau Point Road and 150' from Goldfish Pond Road and will not visible to neighboring properties when relocated to a minimum setback of 10 feet from the north property line. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Because the applicant has two front yards, there is no other area to locate the accessory sheds that would be conforming. 3. The variance granted herein is not substantial and represents permission to relocate one accessory shed in what would normally be considered a rear yard area, and authorization for the side yard/front yard location of the second shed. 4. The alleged difficulty has been self-created. 5. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to suggest that the variance will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit accessory sheds while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. BOARD RESOLUTION: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Tortora, seconded by Chairman Goehringer, and duly carried, to GRANT a Variance as applied for authorizing the 10' by 14' accessory shed in the as- built location, and authorizing the relocation of the 8' by 10' as-built shed to a minimum set back of 10' from the north property line, as shown on the survey prepared by John Ehlers, dated January 26, 2001, last amended, June 15, 2001, with the CONDITION that the accessory shed building be used only for storage purposes. No. 5054 -JOHN AND PATRICIA STACK SITE LOCATION: 7650 NASSAU POINT ROAD, CUTCHOGUE 118-3-4.1 BASIS OF APPEAL: Building Department Notice of Disapproval dated August 14, 2000 denying a permit for accessory sheds because one is located in a front yard and the other in a side yard of the property rather than the code-required rear yard pursuant to Article III, Section 100.33. AREA VARIANCE REQUESTED: Applicant wants to relocate a 8' by 10' existing shed, approximately 1 feet from the side yard of the north property line to a minimum side yard set back of 10 feet. Applicant originally requested a variance to relocate the second 10' by 14' accessory shed, now located approximately 2' from the north side yard property line to a minimum a 8.3 feet. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 21, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: PROPERTY FACTS: The subject property contains 48,724 sq. ft. and is located on the west side of Nassau Point Road and on the east side of Goldfish Pond Road. The property is improved with applicant's single and two-story residence, detached garage, in-ground swimming pool and two accessory sheds, according to the survey prepared by John C. Ehlers, Land Surveyor, dated January 26, 200, last amended June 15, 2001. ADDITIONAL INFORMATION: The property has two front yards with frontage on Nassau Point Road and Goldfish Pond Road. Board members personally inspected the property and found that the existing location of the 10' by 14' shed is preferable to moving it 6'+- in from the north property line because it is now well-screened from view by mature evergreens, and if it is moved further off side yard property line, it would be too close to the stone driveway to permit clear access to the garage, or for that matter for emergency access to the interior property. REASONS FOR BOARD ACTION: In accordance with the review standards set forth in Town law 267-b 3 "Area Variances", the board has considered the benefit to the applicant if the variance is granted, as weighed against the detriment to the health, safety and welfare of the neighborhood and community by such grant, and determines that: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties . A variance to permit the "as built" 10' by 14' accessory shed to remain in its side yard location will have no effect on neighboring properties .41 Page 2—February 28, 200_ , - Appl. No. 5054—J. Stack 1000-118-3-4.1 at Cutchogue because it is well-screened and barely visible from view on Nassau Point Road. The second accessory shed is located in the middle of the property approximately 150' from Nassau Point Road and 150' from Goldfish Pond Road and will not visible to neighboring properties when relocated to a minimum setback of 10 feet from the north property line. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Because the applicant has two front yards, there is no other area to locate the accessory sheds that would be conforming. 3. The variance granted herein is not substantial and represents permission to relocate one accessory shed in what would normally be considered a rear yard area, and authorization for the side yard/front yard location of the second shed. 4. The alleged difficulty has been self-created. 5. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. No evidence has been submitted to suggest that the variance will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to enjoy the benefit accessory sheds while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. BOARD RESOLUTION: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Tortora, seconded by Chairman Goehringer, and duly carried, to GRANT a Variance as applied for authorizing the 10' by 14' accessory shed in the as- built location, and authorizing the relocation of the 8' by 10' as-built shed to a minimum set back of 10' from the north property line, as shown on the survey prepared by John Ehlers, dated January 26, 2001, last amended, June 15, 2001, with the CONDITION that the accessory shed building be used only for storage purposes.
