No. 5070—ART SAFALOW Property Location: 737 Old Woods Path, Southold 87-1-23.4 BASIS OF APPLICATION: Building Inspector's December 21, 2001 Notice of Disapproval for the reason that applicants' proposed garage will be located in an area other than the code required rear yard, pursuant to Section 100-33. AREA VARIANCE REQUESTED: Applicant is requesting authorization to locate an accessory one-story, 35' x 25'three-car garage 20 feet from the easterly side property line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 21, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION: The applicant's property is a 123,318 sq. ft. located on the on the west side of Old Woods Path, a private right-of-way, near Nokomis Road, Southold. The property is improved with an existing dwelling, set back almost 200 ft. from Old Woods Path, and an accessory in-ground swimming pool. To the north of the dwelling is low-lying flood zone area. REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The property is a large wooded parcel. The location request for the garage will be non-visible from Old Woods Path. The board as a condition to this variance is requiring evergreen screening along the easterly side of the garage along or near the easterly property line, to reduce the impact to the neighbor to the east. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The rear yard area is confined by wetlands and a flood zone. The variance granted herein is not substantial. The accessory garage building will meet, or exceed, the minimum front and side yard setbacks required for principal buildings under the code provisions. 4. The alleged difficulty has not been self-created and is related to the physical conditions of the property. 5. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The Southold Town Trustees have reviewed applicant's request for a garage and issued a Letter of No jurisdiction dated December 19, 2001. No evidence has been submitted to suggest that this minor variance will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable applicant to enjoy the benefit of a detached garage while preserving and protecting the character of the neighborhood and the health, sarety, and welfare of the community. BOARD RESOLUTION ACTION OF THE BOARD: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Oliva, seconded by Member Tortora, and duly carried, to APPROVE the variance subject to the following conditions: 1. That the garage be located at a minimum of 20 feet from the side property line and in the area as applied for. 2. That the garage not be used for habitable or sleeping quarters. 3. That a row of 6' evergreen trees be planted along the easterly side of the garage, 5 to 6 ft. apart for the length of the garage. The evergreen trees shall be maintained in good condition at all times.
