FINDINGS OF FACT
PROPERTY FACTS: The subject property contains 20,070 sq. ft. and is located on the south side of Theresa
Drive in Mattituck and is improved with applicant's single story residence, according to the survey prepared
by Stanley J. Isaken Jr. dated July, 1999.
BASIS OF APPEAL: Building Department Notice of Disapproval dated November 30, 2001, denying a
permit to construct a porch addition to an existing single family dwelling because the proposed construction
indicates a front yard setback of 38.7+- ft., instead of the code-required 40-foot minimum front yard setback,
pursuant to Article XXIV Section 244B.
AREA VARIANCE REQUESTED: Applicant wishes to construct a 41ft. 11 in. long by 6 ft. 6 in. (on the
north side) and 4 ft. 6 in (on the south side) wide covered front porch addition to the existing house. The
porch addition would leave a front yard setback of 38 3'(+-) on the northeast side and 39.5' (+-) on the
southeast side from the front yard property.line.
REASONS FOR BOARD ACTION. In accordance with the review standards set forth in Town Law 267-b3
"Area Variances", the Board has considered the benefit to the applicant if the variance is granted, as weighed
against the detriment to the health, safety and welfare of the neighborhood and community by such grant, and
determines that:
1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or
a detriment to nearby properties. The porch addition is modest in size and the 1 ft to 2 ft. variance granted
herein will not appear out-of-keeping with the front yard setbacks of nearby residences.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to
pursue, other than an area variance The applicant's house has an existing front yard setback of 45.3' on the
north side and 44'1' on the south side. Without a variance, the applicant would be unable to construct any
sort of covered porch addition to the front of the house.
3. The variance granted herein is not substantial and represents a one to two foot reduction in the code's 40-
foot minimum front yard set back.
4. The alleged difficulty has been self-created and is due to the applicant's reasonable desire to enjoy the
benefits of a covered porch.

5. The variance granted will not have an adverse effect or impact on the physical or environmental conditions
in the neighborhood or district No evidence has been submitted to suggest that this minor variance will have
an adverse impact on physical or environmental conditions in the neighborhood.
6. Grant of the requested variance is the minimum action necessary and adequate to enable the applicant to
enjoy the benefit of a covered from porch while preserving and protecting the character of the neighborhood
and the health, safety and welfare of the community.
RESOLUTION/ACTION OF THE BOARD: In considering all of the above factors, and applying the
balancing test under New York Town Law, motion was offered by Member Tortora, seconded by , and duly
carried,to
RESOLVED to GRANT a variance authorizing a 44 ft. 11 in. long covered front porch addition with
a minimum front yard setback of 38.3' +-on the northeast side, and 39.5'(+-) on the southeast side.
Vote of the Board. Ayes. Members Goehringer (Chairman), Tortora, Oliva and Orlando. (Member Horning
of Fishers Island was absent.) This Resolution was duly adopted(4-0).

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and Chapter 100
(Zoning), Code of the Town of Southold, the following application will be heard at a public
hearing by the SOUTHOLD TOWN BOARD OF APPEALS at the Town Hall, 53095 Main Road,
Southold, New York 11971, on THURSDAY, FEBRUARY 21, 2002, at the time noted below (or as
soon thereafter as possible):
6:30 p.m. Appl. No. 5063 VICTOR RUTKOWSKI. This is a request for a Variance under
Zoning Code Section 100-244B based on the Building Inspector's November 30, 2001 Notice of
Disapproval. The applicant proposes an addition to the existing dwelling with a front yard
setback of less than 40 feet. Location of Property: 340 Theresa Drive, Mattituck; Parcel 1000-
115-13-22.
The Board of Appeals will hear all persons, or their representative, desiring to be heard
at the hearing, or desiring to submit written statements before the conclusion of this hearing.
