The lot contains 5.0 acres. The north end of the property is subject to a 50' right-of-way. The southerly 2/3± of the premises is subject to an Agricultural and Open Space Covenant and Restriction which requires that the area remain "generally undisturbed" and prohibits building within that area. As a result of the C&Rs, there is a sweeping view from the building envelope over the undisturbed 3+ acres, farmland, and beyond Narrow River Road to Long Beach Bay, Hallock Bay and Orient Point State Park. By Town Code, the front yard setback from the 50-foot right-of-way is 60 feet. That 110-foot setback combined with the 3+ acres dedicated to open space leaves an available building envelope of approximately 40,000 square feet in the northerly 1/3± of the parcel. The house is under construction, but not yet completed. To increase the rear yard available for landscaping and gardening, the house is sited toward the front of the building envelope and slightly to the west of the centerline of the envelope. The master bedroom, study and living room are located in the west side of the structure with the dining room, kitchen, pantry and mudroom being located on the east side of the building. There is a carport located off the kitchen to allow for entry into the house from a car in inclement weather. The dwelling is a bungalow style house with a large overhanging roof with exposed rafter tails. The overhang is larger than the overhang of most roofs and is a major architectural element of bungalow style houses. The large relatively shallow-pitched overhanging roof and the carport are architectural and design elements which preclude the attachment of a garage to the house at its eastern end. A 16' x 50' lap pool is near completion in the rear yard to the east and south of the house. A detached garage is proposed for construction to the north of and centered on the rear- yard lap pool. The garage will serve the following three purposes: (1) a shelter for the owners' car and small truck, (2) a storage area for bicycles and gardening equipment (the owners are avid skilled gardeners), and (3) a "pool house" incorporating a changing room, bathroom and outdoor shower. The proposed garage, thereby, eliminates the need for two additional accessory buildings. The garage comports with height and setback requirements of the town, and the lot coverage is less than 20%. The Town Code,'however, prohibits the location of the garage in the side yard and requires that it be located in the rear yard. 1. An undesirable change will NOT be produced in the character of the neighborhood or a detriment to nearby properties, if granted, BECAUSE: (a) The side-yard location preserves the expansive vista at the rear of the dwelling and furthers the intention underlying the C&Rs which are designed to preserve the open space and views to the south of the building envelopes within the subdivision. (b) There are other residences in Orient with accessory structures located in the front and/or side yards. In fact, although it is attached by decking, the garage belonging to the neighbor immediately to the west is located in the front yard. (c) If a garage were attached to the dwelling, the view of the neighbor to the north would be obstructed. By detaching the garage and placing it in the side yard, the neighbor to the north may continue to see the distant bay waters. (d) In this instance, the open-space easement, in essence, converts the front yard into the rear yard and the rear yard into the front yard. Any dwelling on the four lots will be directed so that it faces south toward the open spaces and distant view of the bays. As a result, these four lots are similar to waterfront lots where the desired orientation is not toward the road but toward the water. The Southold Town Code provides an exception permitting construction of accessory structures in the front yard of waterfront lots. 2. The benefit sought by the applicant CANNOT be achieved by some method, feasible for the applicant to pursue other than an area variance BECAUSE: (a) Attaching the garage to the eastern side of the house would result in a structure with a road frontage of approximately 80 feet. Detaching the garage creates a sense of openness. (b) The bungalow style house with its large overhanging roof does not lend itself architecturally or esthetically to an attached garage or an attachment by a breezeway. (c) The only available locations for the garage in the rear yard is in the southwestern' corner of the building envelope to the south of the master bedroom or to the south of the lap pool. Both those location would contravene the spirit and intent of the C&Rs and would thwart the parties' efforts to maximize the open space to the south of the structures. Moreover, those locations would adversely effect the view of the neighbor 41111 to the west and, when the lot is built upon, the owner of the vacant land to the east. 3. The amount of relief requested is not substantial BECAUSE, in light of the adverse impacts of locating the garage in the rear yard or of attaching it to the house, the requested side-yard location is both logical and minimal and, by including multiple uses, the proposed garage eliminates the need for two additional accessory structures. 4. The variance will NOT have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district BECAUSE the detached location in the side yard preserves the open vistas of not just the owners but also the neighbors to the north, west and, eventually, east. 5. Has the alleged difficulty been self-created? ( ) Yes. ( X ) No, because, since before March 2001, the owners, architect, builder and landscape architect spent many hours seeking to place the garage in a location which would comport with the Town Code. Among other things, the style of house, vistas, the terrain, and the C&Rs all point to a detached garage located in the eastern side yard. 6. This is the minimum that is necessary and adequate, and at the same time preserve and protect the character of the neighborhood and the health, safety and welfare of the community.
