No. 5095 — WARREN CORAZZINI Location of Property: 67575 Main Road, Greenport Parcel 52.-5-58.3 Date of Public Hearing: May 16, 2002 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The subject property is a 1.0413-acre lot with 324.37 ft. along the north (northwest) side the Main Road (S.R 25), 260 feet west of Albertson's Lane, Greenport. The lot is vacant and is located in the LI Light Industrial Zone District. BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated December 17, 2001, denying an application dated December 17, 2001 for a permit to build a commercial building, for the following reasons: (1) Article XIV, Section 100-142 requires (a) a 70 ft. minimum rear yard setback, and (b) a 100 ft. front yard setback. � .V San E:4 ('J • t . t sr. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or a detriment to nearby properties because, when considering the nature of -' applicant's business and the size of the trucks and equipment that the applicant intends to store and work on within the proposed building, a 60 x 50 ft. building is the minimum size to allow adequate room. The building is proposed near the center of the lot and will be screened from the road. The immediate neighboring properties are other industrial zoned uses. 2. The benefit sought cannot be achieved by some method, feasible for the applicant to pursue other than an area variance. If applicant were to build a longer, more narrow building were placed, other variances may become necessary when considering screening along the road and the light industrial uses permitted in the area. The applicant wishes to construct this building to house vehicles and equipment from outside elements and related uses. 3. The area variance is not the minimum necessary, but is acceptable for the size and dimensions of the lot. 1 Page 2—May 16, 2002 _ v \\ ZBA Appl. No evidence has been submitted to indicate an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The action set forth below is the minimum necessary and at the same time preserves and protects the character of the neighborhood and the health, safety and welfare of the community. RESOLUTION: On motion by Member Horning, seconded by Chairman Goehringer, it was RESOLVED, to GRANT the setback variances, as applied for, SUBJECT TO approval by the Planning Board under the site plan regulations pertaining to this area. Vote of the Board: Ayes: Members Goehringer(Chairman), Horning, and Orlando. Member Tortora abstained. (Member Oliva was absent due to illness.) This Resolution was duly adopted (3-0).
