No. 5114 - RIVERHEAD BUILDING SUPPLY Property Location: 74500 Main Road, Greenport; 46.-1-2.1 and 1 Date of Public Hearing: May 16, 2002 BASIS OF APPEAL: Building Inspector's Notice of Disapproval dated February 20, 2002, denying a permit to (a) construct and locate a new building (No.1) with more than 60 linear feet of frontage on one street, (b) construct and locate a new building (No.2) with more than 60 linear feet of frontage on one street, ref. Section 100-133C, and (c)to construct and locate off street parking at less than the required 50 foot minimum to the street and lot lines pursuant to Section 100-131C (9). AREA VARIANCE REQUESTED:, Applicant is requesting the board to reverse the building inspector's determination that a variance is required for the proposed 115-foot width of building No. 1 because under prior Appeal No. 4547, dated June 23, 1998, the board granted a variance to construct a 115-foot wide building in almost the identical location. Applicant is requesting the board to reverse the building inspector's determination that a variance is required for the proposed 91-foot width of building No. 2 because the building does not have frontage on a street, and is located behind building No. 1 more than 300 feet from the Main Road. Applicant is also requesting the board the lift the condition imposed under prior Appeal No 4527, dated June 23, 1998 with respect to off street parking and loading, or the reverse the building inspector's determination. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 16, 2002 at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: 1. (PROPERTY FACTS) The subject property consists of a total of 5.9 acres and is located on the south side of Main Road in Greenport. The property is zoned LIO (Light Industrial Office) and is located in a neighborhood that is commercially developed. The site plan, prepared by Donald Alan Denis, Architect, dated August 21, 2001, last amended December 18, 2001, shows plans to demolish the existing building and construct a 14,100 sq. ft. retail/office warehouse with a width of 115 feet facing the Main Road. This building, No. 1 would be set back 110 feet from the Main Road, with customer parking in front of the building and a 25-foot buffer zone between the parking area and the Main Road. Building No. 2 is proposed for the drive-through operation of the lumber yard. It is 23,660 sq. ft. with a proposed width of 91 feet. Building No. 2 is located 70 feet behind building No 1 and more than 300 feet from the Main Road. The site plan also shows a 5,000 sq. ft. warehouse building. is Page 2—May 16, 2002 ZB Appl. In reviewing the revised plan, the board finds that it is not substantially different than the plan which was reviewed by the board and granted variances under Appeal No. 4547. Instead of one large building of 53,425 sq. ft., the applicant has reduced the size of the principal building to 14,100 sq. ft., and created a separate 23,660 sq. ft. building in the rear of the principal building for the drive-through operation of the business, and a 5,000 sq. ft. warehouse building. 3. The 115-foot proposed width of building No.1 is identical to the width variance granted by the board under Appeal No. 4547. The board notes that the prior variance was granted on condition that the applicant maintain a minimum 110 foot set back from Main Road in order to provide additional landscape buffer, which the applicant's have complied with. Since neither the 115 foot width of the building nor the minimum 110 foot conditioned set back to the Main Road have changed, no further variance is required for building No. 1. 4. With respect to building No.2, the building inspector states that the proposed construction is not permitted pursuant to Article XIII, Section 100-133C on the grounds that the building has "linear frontage of 91 feet." The code provision specifically states that, "a project shall be divided into separate structures so that no single structure shall more than sixty (60) linear feet of frontage on one (1) street." The building (No. 2) in question does not have frontage on one street. It is to be located 70 feet behind building No. 1 and more than 300 feet from the Main Road. The board believes a clear reading of the provision indicates that it was intended to prevent the strip mall effect of one or many excessively wide structures facing the street. In this instance, the code provision is not applicable because the building does not have linear frontage on a street. 5. With respect to off-street parking and loading requirements pursuant to Article XIII, Section 100-131, C (9). The board notes that the location of the parking and loading areas were worked out with the Planning Board during its site plan review of the project after the Board of Appeals granted its approval under Appeal No. 4547, which included a condition #3, that off-street parking areas comply with 100-131. In reviewing the amended site plan, the board finds that compliance with this condition is neither practical, nor would it in any way improve the layout or design of the plan, or serve any useful purpose. BOARD RESOLUTION: For the reasons stated above and, on the basis of testimony presented, materials submitted, the board makes the following determinations: Now, on motion by Member Tortora, seconded by Chairman Goehringer, it was RESOLVED, to REVERSE the Building Inspector's February 20, 2002 determination that Building No. 1 requires a variance pursuant to Article XIII, Section 100-133C because such variance was granted under prior Appeal No 4527, dated June 23, 1998. BE IT FURTHER RESOLVED to REVERSE the Building Inspector's February 20, 2002 determination that Building No 2 requires a variance pursuant to Article XIII, Section 100-133C because such building does not have frontage on a street and the provision is not applicable to this structure. No. 4547 Dear Chairman and Board members : Riverhead Building is before the Planning Board for approval of the amended site plan. The , public hearing was opened on January 14, 2002 and left open pending your communication. Enclosed is a print of the proposed site plan which shows the Planning Board reviewed and recommended improvements . The Building Inspector raised two . issues prior to certification of the site plan: First : Appeal No 4547 granted relief for the width of the building to 115, provided that the building was set back an additional 10 ' (110 total) . In appeal No 4547 the front building (along Route 25) _was connected to the rear building. Due to fire code issues the new amended site plan provides for a detached building (building 2) . Pursuant to Section 100-133 (C) "A project shall be divided into separate structures so that no single structure shall have more than 60 linear feet of frontage on one street. The setbacks of multiple structures on a parcel may vary, provided that the average setback of the structures meets the setback required above and all buildings are at least 75 feet from the right-of-way. " Please note that only Building 1 has frontage on the road. The rear building is in the "rear yard" , behind the front building, more than 300 ' back from Route 25 . It was my belief, as well as the former building inspector' s, that the variance ran with the land, the relief requested was the same (applicable to Building 1) therefore Riverhead Building Supply could proceed to obtain amended site plan without another variance from 100-133 . Issue 2 : Parking setback has been questioned by Mike Verity. RBS has complied with 100-132 Bulk, area, and parking regulations of 100-191 and 100-192 , incorporated by reference. Mike Verity saw your reference to 100-131 in your decision. We believed you intended to refer us to our obligation to comply with whatever provisions of 100-131 were applicable. We and the Planning Board believed that we had complied with all parking requirements, and 100-131 (9) is not applicable. Moreover, the relocation of parking in order to conform to a 50 setback would result in insufficient parking at the retail building, and placement of parking in areas that the Planning board wishes to keep open for vehicle and truck access . The Planning board needs to determine the most suitable placement of parking. Site plan issues are correctly before the Planning board, 100-131 (9) if applied as Mike Verity suggests will interfere with good site plan review. The Planning Board and staff did not apply this section of the code with either the present or the previously approved site plan. To my knowledge, 100-131 has not been applied to the parking for a "principle use" , in this case a wholesale business, warehouse and building material storage and sale (i . e. lumberyard) . Section 100-131 (C) is intended to apply to accessory uses Moreover, Riverhead Building Supply is a preexisting nonconforming building (with existing parking, loading, storage etc. ) and a legally permitted use . The amended site plan is more conforming in all respects . The parking, landscaping and location of the buildings is much more conforming than the existing conditions . We have certainly complied with the intent of the zoning code . The Building Inspector has asked that I refer this request to your board prior to his certification and in order to proceed with the site plan approval . I do not believe he wishes to send us to your board for variances, he asks that your board clarify the decision granting the variance, and respond to him accordingly. If your communication is favorable, Mike Verity will be comfortable with this, the Planning board is ready to approve the site plan. Moor-e_., Reason for Appeal Continued Zoning Board of Appeals re: Riverhead Building Supply Corp. Pursuant to Town Law section 267b-3 the Southold Town Zoning Board of Appeals is to analyze and assess the personal benefits anticipated by the applicant against the potentially deleterious effects that a grant of the relief requested would have on the health, safety and welfare of the effected neighborhood or community. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons: 1. No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. A. Riverhead Building Supply Corp acquired the 3 .5 acre parcel, and obtained a change of zone from the Southold Town Board to LIO zoning use district. The purposes of the change of zone and acquisition were to develop the existing 2 .2 acre Riverhead Building Supply Corp parcel with preexisting nonconforming structures and adjacent 3 .5 acre parcel into a full service facility. The Planning Board reviewed the proposal and proposed site plan and recommended the change of zone with the following comments : "1. The proposed change of zone is to permit better use and design of the existing Riverhead Supply site. The Company proposed a state of the- art operation that will include a pick up and pay, drive thru lumber building." 2. "The HD designated property (3.5 acres) is less than ideal for residential housing as it is located behind the 7-li store and next to the tracks and the LIO zone. Further, its small size and poor location prohibits adequate buffering of a dense residential use from commercial uses to the north and west." B. The Planning Board' s review of the proposal considered the character of the neighborhood and impact on nearby properties. The change of zone was considered and granted with the proposed plan as is before the Zoning Board. The new site plan was submitted to the Planning Board and Architectural Review Committee and was ready to be approved when the building inspector advised that we required re-submission to the ZBA. C. The proposed structures will be in conformity with the New York State Fire Prevention and Building Code, and Handicap Accessibility laws. The proposed structures will enhance the character of the commercial area. D. The proposed structure will be a significant investment in the Town of Southold, and any impact on the character of the neighborhood by the proposed width of the building will be mitigated by the site plan compliance. E. The front of the building will contain the retail sales and business office which is designed in character with the new development in this district. The back building will be warehouse (covered storage of building materials) . The separate structures were designed after ironing out the operations problems experienced in the Riverhead and East Hampton sites. The site plan hearing was held and ready for approval. F. The original variance granted approved one building being 50,425 SF, the present appeal separates the buildings and reduces the total size of all the structures to 43,010 SF (a reduction of Square Footage of 7,415 SF) : Bldg 1: 14,350 SF Bldg 2 : 23,660 SF Bldg 3 : 5, 000 SF G. The location of off street parking and loading has been fully reviewed and site planned, it is adjacent to other commercial uses which have the parking and loading areas up to the property line. This provision is applicable to "accessory uses", the lumberyard (lumber storage and warehouse) is a principal use in LIO District. The location of property was reviewed by the Planning Board and after several revisions to make room for truck access was placed on the plan, as proposed. The location of parking and loading areas should be left to the Planning Board, and the applicant' s Professional Engineers and Architects. 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The developing technology for building supply facilities make this investment economically necessary. The existing facility is less economically viable in its present condition, it is anticipated that the proposed modern facility will continue the prosperity of the business on the east end and continue to provide jobs in the community. With regard to the arbitrary 60 foot width requirement in the Southold Town Code, the code disregards the setback requirements in the LIO district, does not distinguish between a two acre parcel and the subject 5.7 acre parcel, and does not address the different uses in the applicable zoning districts . The property has over 325 feet along the main road, the building is 115 feet in width, therefore, the only 35% runs along the Main Road. The building is well proportioned on the property. The front lumberyard building containing the retail & warehouse use is identical to previous approvals. The ZBA approved the front structure on condition that the building be set back an additional 10 ' beyond the required 100 ' . The rear drive-through warehouse will provide for covered storage of building materials and a state-of-the-art building supply center. A vehicle drives through the warehouse, loads the first quality material from the stacks to the contractor's vehicles and then payment is made at the exit. Such a use can not be accomplished in a 60 foot wide structure. The structure is also behind the front building, is landscaped and the site plan has been reviewed with anticipated approval. ' With regard to the location of the parking and loading areas, the existing structures, parking and loading areas run up to the property line (as to the neighboring uses) . The proposed plan is professionally reviewed and engineered, the location of the parking and loading areas have been suitably screened and are placed on the property to keep a clear access for truck and car traffic. The previous variance granted the requested fence height. 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. A 325 foot wide parcel in a LIO district requires 30 foot side yards (60 ' total) therefore the building could be as much as 265 feet in width given the side yard setbacks in the Bulk Schedule. A 60 foot wide building is unreasonable, the property should be developed through the site plan process not with arbitrary widths which have no relation to the use or size of the parcel. The 60 foot width was created to address strip centers- not an individual use. The proposed use, a building supply complex can not be achieved without the proper width of the building. The two existing structures are set back approximately 28 feet from the Main Road. The easterly structure is 72 feet wide and 1 foot off the side property line, the westerly structure is 45 feet wide and set off 5 feet off the side property line. Both ctr>>ctures- are a combined width of 117 feet (. the proposed structure is @ 115) In addition the structures are only 30 feet apart and therefore occupy the entire parcel without required screening or parking. The proposed structure will be a significant improvement to the existing conditions of the site. 4. The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district. The use is permitted in the LIO district, the property will be properly vegetated through an extensive site plan process, the new structures will enhance the property and will replace several structures which are nonconforming and do not provide adequate screening. 5. The alleged difficulty was not self-created. 6. The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant. The proposed structure is designed by persons in the building supply trade. The applicants have spent countless hours with the design professionals and suppliers to design a state-of-the art complex. The warehouse is customized for the use, the retail and office portion were designed by Don Denis, architect, with the changing and improving business character of the district. The "re-zoning plan" site layout map RZ-1 dated July 18, 1996 prepared by Donald A. Denis, Architect, has been submitted to show the land area and footprints of the two existing buildings. Also submitted are drawings dated June 11, 1997 for a proposed principal building, with retail area at the northerly front portion, and remaining areas consisting of vestibule, design center, receiving and office areas, inside storage areas, accessory lunchroom and mechanical room. Buffer areas are shown around the perimeter of the property, and an outside uncovered storage area of 15,000 sq. ft. located in the easterly side yard. • Also shown on the plan is an outside storage area which is proposed to conform to the current accessory use regulations for this LIO Zone District. No building or canopy area is proposed over this storage area and there was no basis addressed in the Building Inspector's Notice of Disapproval with respect to this part of the plan. AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The applicant is requesting variances regarding: 1) an increased width of principal building from code limitation Of 60 feet to 115 feet wide facing Route 25 (a/k/a Main Road) in this Light-Industrial-Office (LIO) District; and (2) Fencing up to 8-ft. in height along side and rear property lines. Applicant proposes to construct a metal drive-thru warehouse with a showroom/building supply store at the front. The total square footage is approximately 50,424 sf. The 115-foot width is proposed to allow vehicles to enter to east side of the building to pick up drywall, roofing, lumber and similar supplies, and then pay at the exit on the west side. The smaller store in the front would contain a showroom and smaller supplies. 2. The applicant has submitted an extensive landscaping plan for the entire property and has agreed to help mitigate the visual impact of the width of the building by moving it back to a distance of 110 feet from the Main Road in order to provide an additional 10-foot landscape buffer. 3. The property contains a total of 5.9 acres and has 325 feet of frontage on Main Road. The adjacent properties are commercially zoned and developed property, with the exception of a residential condominium complex to the east. FOR THESE REASONS, the Board determines as follows: In considering this application, the Board finds that a variance for an 8-foot high fence, and a variance for a building width of 115 feet are the minimum necessary and adequate and at the same time will preserve and protect the character of the neighborhood, and the health, safety and welfare of the community. 1. Grant of an area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The proposed lumber yard supply building is a permitted use in the LIO District. the use is compatible with adjacent commercial uses, and the large size of the property and extensive landscape plan will provide a sufficient buffer from the residential/condominium complex. The 8-foot high fence will provide security and protection of the public as well. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the 60-foot code limitation would not permit room for storage of material and for vehicles to have sufficient clearance to maneuver safety in the drive-thru operation proposed. (3) The requested area variance is substantial and represents a 95+- percent reduction in the code required 60 ft. minimum width. However the specific location, large size of the property and .extensive landscaping proposed help mitigate the degree of the variance. The applicant has submitted extensive landscaping plan for the entire property and has agreed to help mitigate the visual impact of the width of the building by moving it back to a distance of 110 feet from the Main Road in order to provide an additional 10-ft. landscape buffer. PARCEL 1000-46-1-1 and 2.1 STREET & LOCALITY: Buildings #74610 and 74500, Main Road (State Route 25), Greenport, NY DATE OF PUBLIC HEARING: March 23, 1998, May 14, 1998 and June 11, 1998 PROPERTY FACTS/DESCRIPTION: The above-identified property is located on the south side of Main Road, -Greenport, and contains a total combined lot area of 5.938 acres. The "re-zoning plan" site layout map RZ-1 dated July 18, 1996 prepared by Donald A. Denis, Architect, has been submitted to show the land area and footprints of the two existing buildings. Applicant proposes to construct a metal drive-thru warehouse with a showroom/building supply store at the front. The total square footage is approximately 50,424 sf. The 115-foot width is proposed to allow vehicles to enter to east side of the building to pick up drywall, roofing, lumber and similar supplies, and then pay at the exit on the west side. The smaller store in the front would contain a showroom and smaller supplies. 2. The applicant has submitted an extensive landscaping plan for the entire property and has agreed to help mitigate the visual impact of the width of the building by moving it back to a distance of 110 feet from the Main Road in order to provide an additional 10-foot landscape buffer. 3. The property contains a total of 5.9 acres and has 325 feet of frontage on Main Road. The adjacent properties are commercially zoned and developed property, with the exception of a residential condominium complex to the east. FOR THESE REASONS, the Board determines as follows: In considering this application, the Board finds that a variance for an 8-foot high fence, and a variance for a building width of 115 feet are the minimum necessary and adequate and at the same time will preserve and protect the character of the neighborhood, and the health, safety and welfare of the community. 1. Grant of an area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The proposed lumber yard supply building is a permitted use in the LIO District. the use is compatible with adjacent commercial uses, and the large size of the property and extensive landscape plan will provide a sufficient buffer from the residential/condominium complex. The 8-foot high fence will provide security and protection of the public as well. (2) The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance because the 60-foot code limitation would not permit room for storage of material and for vehicles to have sufficient clearance to maneuver safety in the drive-thru operation proposed. (3) The requested area variance is substantial and represents a 95+- percent reduction in the code required 60 ft. minimum width. However the specific location, large size of the property and extensive landscaping proposed help mitigate the degree of the variance. (4) The difficulty situation has been self-created and relates to the applicant's desire to establish a drive-thru type of lumber business that requires a large-width structure in order to operate. • .
