RESOLVED that pursuant to Article 8 of the Environmental Conservation
Law, State Environmental Quality Review and 6NYCRR Part 617,
Section 617.10 and Chapter 44 of the Code of the Town of Southold,
notice is hereby given that the Southold Town Trustees, as Lead
Agency for the action described below, has determined that the
project will not have a significant effect on the environment.
Please take further notice that this declaration should not be
considered a determination made for any other department or agency
which may also have an application pending for the same or similar
project.
TYPE OF ACTION: Type: I
DESCRIPTION OF ACTION: Applicant requests permit to construct a
two-story building a minimum of 17' from the edge of the existing
fill. Parking will be located south of the building~and will be
bluestone, sanitary system will be as close to the easterly property
line as possible and a minimum of 100' from wetlands. The existing
upland to the wes= will be used only as a boat display area. Access
between the two sections of upland will be via a 4' X 85' pedestrian
bridge that will span the wetlands and the drain ditch. None of the
wetlands will be filled or otherwise developed. All in accordance
with revised plan dated December 21, 1993.

REASONS SUPPORTING THIS DETERMINATION:
1. An on site inspection has been conducted by the Board of
Trustees.
2. An environmental assessment, submitted by the applicant and
reviewed and completed by the Board of Trustees, has indicated that
no significant adverse effects to the envirornuent are likely to occur
should the following mitigation measures be implemented.

With respect to your Lead Agency Coordination request for
Willia/n and Vincent Geraghty for the Main Road Arshamomoque,
we have attached a copy of our recent field inspection and
comments dated July 6, 1993.
To date this office has received no application certain for this
proposal based on the current survey.
We question the accuracy of Mr. Haje's 1989 application
submitted to your agency when compared with the July 21, 1992
licensed survey of JosephA. Ingegno which proposes to fill
wetlands.
When this office receives an application we would like to assume
lead agency status for this action.
We are hopeful our suggestions to Mr. Haje of July 6, 1993
will be considered.

Dear Mr. Haje,
After a rather lengthy backlog in work due to this winters
storms, the Southold Town Trustees had an opportunity to visit
the site of Mr. Vincent Geraghty's recent development proposal
on June 17, 1993 for his commercial property at SCTM
$1000-56-4-133, & 13414 Main Road Southold NY.
The Trustees would like to make the following observations and
comments on this proposal:
t) The proposal to fill approx. 23,000 s.f. of wetlands in
order to donate a 20,024.24 s.f. parcel of questionable
conservation utility to the N.Y.S.D.E.C. or other not for profit
entity is viewed by this office as not practical and of
extremely questionable merit. Our past experience tells us
there would be few bona-fide conservation organizations willing
to take a~ donation under these circumstances. The Town Trustees
would not likely accept in their own name such a donation linked
to wetland destruction of greater size than preserved and would
not recommend same to the Town Board of Southold.
2) We do not entirely agree with your belief that the wetlands
on the property are diminished in value due to their isolation
from contiguous wetlands or waters sinCe this system is not
completely isolated from the wetlands of Mill Creek which is a
ma]or wetland system in the Town of considerable value to our
commercial shellfishing industry.
3) We do agree with permitting reasonable use of this property
and are suggesting an alternative layout which would include a
CCA bridge, no division of land or "donation" and minimal
wetland incursions linked to a 1:t wetland improvement program
for the existing degraded wetlands on the site.
4) Enclosed please find a sketch overlain on the licensed land
survey of Joseph Ingegno dated July 21, 1992 and January 16,
1993 which includes a graphic representation of a possible plan
we belieue could fly. This is given with the explicit warning
that there are many other agencies involved for such a proposal
and the potential Of a lengthy review pursuant t'o the state
Environmental Quality Review Act (including the need for an
impact statement) cannot be ruled out in any instance.
5) Since we have tried to leave your building plan intact we
would recommend you discuss it with representatives of the Town
Planning and Building Departments for their cu~muents and
ascertain whatadditional approvals you will need.
6) ~ne Trustees will endeavor to secure lead ageacy status for
this project given the potential for wetland disturbance
surrounding any project'on'~this site.
If we can be of additional assistance please do not hesitate to
call.

It is our belief that the quality and value of these
wetlands is diminished based upon their isolation from
contiguous wetlands and/or waters. The proximity of the
Long Island Railroad to the north; main road to the
south; filled property to the west on which boats are
stored; and developed property on the east limit the
potential envirQnmental value of this property. Indeed,
we feel its pra as a sump. The plan that we
have set forth will this value.

The waiver pertains only to cutting Phragmites communis winter
killed vegetative tops for the purpose of properly surveying the
property in connection with the pending wetland permit
application.
Respondent should not be permitted to have a dismissal as the
cutting requested will help the Board assess the already damaged
site and help us make a determination on the permit request.
The Board should have the option to not approve the permit on
request court imposed remediation should it be justified.

that the proposed action may have a significant effect on the environment

NAME OF ACTION: Application of William and Vincent Geraghty, Main Road,
Southold, N.Y., to place 9,000 cubic yards fill in marsh area.

Description of Action:
Place and grade approximately 9,000 cubic yards of fill to complete
filling of parcels from Main Road to the L.I.R.R. embankment. Finished
grade to match that of adjacent property. Applicant proposes to fill in
marsh and install culvert to handle water.

Reasons supporting this determination:
Trustees have performed 2 inspections of this site and have determined
that evidence of intertidal marsh exists. Spartina is present on site,
salinity tests indicated intertidal waters. Applicant proposes to fill
marsh, unknown amount of fill already deposited.

RE: VINCENT GERAGHTY - ~10-89-1243.
Dear Mrs. Amara:
After careful deliberation of the potential use of this
property, the plan has been modified to take into account
the concerns stated by the NYSDEC in previous corre-
spondence.
An Irregularly-shaped two-story building will be con-
structed a minimum of 17' from the edge of the existing
fill and, thus, wetland. For this, we recognize the
necessity for a variance.
Parking associated with the structure will be located
immediately south of the building while the sanitary sys-
rem will be constructed as close to the easterly property
line as possible and a minimum of 100' from wetlands.
The existing upland to the west will be used only as a
boat display area. Access between the two sections of
upland will be via a 4' x 85' pedestrian bridge that will
span the wetlands and the drain ditch. None of the wet-
lands will be filled or otherwise developed.
The need for variance for structure to wetlands setback
is dictated by the limited amount of uplands that we are
able to utilize. Of the total area of 64,087 sq. ft.,
approximately 33,000 are comprised of "upland."

Of this, approximately 2,500 sq. ft. is a wooded band
extending into the meadow and, therefore, unusable for
development. The irregular shape and disparate location
of these uplands made development with a variance and
impossible without it.
If we were to maintain a 75' setback, only a very small
portion of the upland in the southeast corner would be
usable. Taking into account the side and frontyard set-
backs of the Town of Southampton and the necessity for
placing the sanitary system here as well, no usable area
for construction would result.
We do not believe that the proposal as presented will
have any adverse effect upon the adjacent wetlands. %~is
belief is based upon the nature of the surroundings and
the fact that the Long Island Railroad right-of-way is
located on the north, Main Road on the south~ and filled
Parcels to the east and West. This heavy utilization is
ex~pected to impact upon the usage of the wetlands by
wildlife.
The capacity of the wetlands as a drainage and absorption
basin for floodwaters will be undiminished. The feasi-
bility of the site for instruction, recreation, etc., is
also minimal. There should be no change in drainage pat-
terns as the proposed structure will be fitted with dry-
wells to recharge roof runoff.
Pavement will be bluestone so that drainage can occur
through it.
The usage of the property is in keeping with local zon-
ing.
Please consider these comments in your deliberations on
the amended project.

Purpose: The full EAF is designed to help applicants and agencies determine, in an orderly manner, whether a project
or action may be significant. The question of whether an action may be significant is not always easy to answer. Frequent-
ty, there are aspects of a proiec[ that are subjective or unmeasureable. It is also understood that those who determine

You raised two issues today, and this memo will give you some legal direction
on them. First, you indicated that the Planning Board had asked to assume
lead agency status on the Geraghty matter and asked what factors went into
deciding which agency is lead agency for SEOR review.
SEQR regulations require that as early as possible, an agency shall decide:
whether the action's subject to SEQR,
whether the action involves one or more agencies,
whether the action's Type I, II or Unlisted,
whether a short or full EAF is required.
If only one agency is involved, it is the Lead Agency. If there are multiple
agencies involved, they must decide on the Lead Agency. The criteria for
deciding a Lead Agency shal be:
which agency has the broadest governmental powers for investigation
of the impact of the proposed actions, and
which agency has the greatest capability for providing the most
thorough environmental assessment of the proposed action.
If the agencies cannot decide this issue among themselves, they can apply to
the Commissioner of Environmenta Conservation to decide. An agency may
send a request to the Commissioner by certified mail, identifying each agency's
jurisdiction over the action, the other agencies have 10 days to respond, and
the Comm|ss~oner makes a decision w~thin 20 days.

themselves. The-decision regarding Lead Agency isn't committed to until action
is taken adopting a Negative or Positive Declaration.
On another matter, the Trustees are a public body and are subject to the Open
Meetings Law (in Public Officers Law 100 et seq). Every meeting of a public

The Suffolk County Department of Health Services (SCDHS; "Department") has received
your letter concerning the above-referenced project. The Department has no objection to your
designation as lead agency.
Based on a review of the subject coordination, the Department offers the following
comments. However. the Department wishes to reserve ks right to provide more detailed
information within the comment period(s)established for this action. Also. these comments
should not be construed as an implicit SCDHS approval or rejection of the project. Alt
applications are reviewed thorouglzly with respect to Suffolk County Sanitary Code concems by
appropriate departmental personnel when SCDHS applications are completed.
An application for this proposed project has not been submitted to the SCDHS.
We are concerned with the on-site soil types which may impede the proper functioning of a
subsurface sewage disposal system. Subsu_rf_ace soil conditions will be evaluated by SCDHS via
excavation haspection as part of the SCDHS application procedure. Our concerns with the
proposed sanitary system are magnified by the shallow depth to groundwater which exists at the
site. which may also hinder the operation of a samtary system. Diminished treatment of
wastewater can result in increased bacteriological, virological, and nitrogen (and phosphorus)
loading to groundwater md/or surface water.

Additionally, we are concerned with the proposed sanitary system with respect m the
proximity of the proposed project to surface waters. The surface waters of this area are stressed
by stonnwater runoff and septic system effluent pollution contribution created by past and
present development pressure. In general, septic systems near surface waters can result not only
in increased bacteriological and virological contamination, but also in elevated BOD, solids, and
nutrient (nitrogen and phosphorus) loading to surface waters. Such loading could result in
adverse effects on a surface water ecosystem and, ultimately, in the accelerated pollution and/or
eutrophication of the system. Thus. any project which may have an adverse impact on these
surface waters deserves close scrutiny m exam/ne measures to mitigate the potential adverse
impacts to the maximum practicable extent. In the case of the proposed project, this scmtiny
should extend to an evaluation of impacts of stormwater runoff and septic system effluent on on-
site~afi~ neigh~boring wetlands and natural resources in addition to groundwater and surface
water. The loss of vegetatmn, wilctllfe habitat, and open space should also be carefully assessed,
as should any available hydrogeologic and surface water quality data).
The tidal wetlands which occttr on and/or near the subject property are affected by Article 25
(Tidal Wetlands). A New York State Deparmaent of Environmental Conservation (NYSDEC)
permit may therefore be required prior to SCDHS approval of this project. A NYSDEC-
approved wetlands line should be designated on the site plan. The proposed development of the
subject property should subsequently incorporate the maximum practicable setback from any
wetlands boundaries.
The applicant must comply with the requirements of the Suffolk County Sanitary Code and
relevant construction standards for water supply and sewage dksposal. Design and flow
specifications, subsurface soft conditions, and complete site plan details am essential to the
review of this project. These considerations are rewewed completely at the time of SCDHS
application. SCDHS maintains jurisdiction over the final location of sewage disposal and water
supply systems. The applicant, therefore, should not undertake the construction of either system
without Health Department approval.

The Department has reviewed your January 3, 1994 letter with
associated project plans, and has the following comments:
The SEQR Determination of Significance from the Town of
Southold has not yet been submitted. As stated in the
January 12, 1994 letter from Carol A~ara, Program Aide,
the Department cannot submit the proposal for public
notice until this determination is received.
The fee for this application is $900. Please submit
$890. to my attention as soon as possible.
Plans indicate that the proposed sales and service
office will be a minimum of 4 feet from the top of
existing fill. The Department will require that plans
show the limit of'disturbance at the top of fill, and a
permanent fence or shrub barrier be placed along the
top of fill to minimize disturbance to the wetland.
Please show this barrier on the site plan. In
addition, if 4 foot clearance will not be adequate for
construction purposes, emergency vehicles or
maintenance activitles, the building should be
redesigned to provide additional clearance.
The current plan shows 4 additional parking spaces (a
total of 19). The applicant should revise the plan
limiting parking to 15 spaces as shown on previous
plans, and seek a variance from Town parking
requirements if necessary.
The parking are~is labeled "bluestone pavement". This
should be revised to state "pervious unconsolidated
bluestone". No asphalt or oil based agents will be
permitted.
Plans must clearly show how storm water will be
handled. Roof runoff must be directed into dry, ells
and upland area must be graded away from wetlands.
The plan must contain additional details concerning the
"boa% d~splay area". The Plan must clearly show the
~oundaries of this area, Including a fence or shrub
barrier at the top of the slOpe toward the wetland·

Provide detailed plans for bridge construction
including type of materials to be used and cross
sections for each end of the bridge.
This proposal requires significant variances under
Section 661.6 for setback requirements. The applicant
is proposing to place structures between 12 and l~ feet
away from thewetland. Theappli~ation does nothing to
overcome the burden of demonstrating the compatlbllity
of the proposed project to t~he values of tidal
wetlands. Under Section 66~12(a) the applicant .must
discuss what restrictions the variance relief is sought
from, the minimum relief tha~ is necessary, the
practical difficulties, alternate site possibilities,
and m?s~ i~rtantl~, envir~.~mental impact reduction
and m~tlgation measures. T~is application does not
mention the idea of mitigation at all. Mitigation must
be explored ~or stormwater runoff and creation of
buffer areas to the tidal wetland·

Dear Mrs. Amara:
After careful deliberation of the potential use of this
property, the plan has been modified to take into account
the concerns stated by the NYSDEC in previous corre-
spondence.
An irregularly-shaped two-story building will be con-
structed a minimum of 17' from the edge of the existing
fill and, thus, wetland. For this, we recognize the
necessity for a variance.
Parking associated with the structure will be located
immediately south of the building while the sanitary sys-
tem will be constructed as close to the easterly property
line as possible and a minimum of 100' from wetlands.
The existing upland to the west will be used only as a
boat display area. Access between the two sections of
upland will be via a 4' x 85' pedestrian bridge that will
span the wetlands and the drain ditch. None of the wet-
lands will be filled or otherwise developed.
The need for variance for structure to wetlands setback
is dictated by the limited amount of uplands that we are
able to utilize. Of the total area of 64,087 sq. ft.,
approximately 33,000 are comprised of "upland."

Of this, approximately 2,500 sq. ft. is a wooded band
extending into the meadow and, therefore, unusable for
development. The irregular shape and disparate location
of these uplands made development with a variance and
impossible without it.
If we were to maintain a 75' setback, only a very small
portion of the u~land in the southeast corner would be
usable. Taking i~to account the side andfrontyard set-
backs of the Town of Southampton and the necessity for
placing the sanitary system here as well, no usable area
for construction would result.
We do not believe that the proposal as presented will
have any adverse effect upon the adjacent wetlands. This
belief is based upon the nature of the surroundings and
the fact that the Long Island Railroad right-of-way is
located on the north, Main Road on the south, and filled
parcels to the east and west. This heavy utilization is
expected to impact upon the usage of the wetlands by
wildlife.
The capacity of the wetlands as a drainage and absorption
basin for floodwaters will be undiminished. The feasi-
bility of the site for instruction, recreation, etc., is
alsominimal. There should be no change in drainage pat-
terns as the proposed structure will be fitted with dry-
wells to recharge roof runoff.
Pavement will be bluestone so that drainage can occur
through it.
The usage of the property is in keeping with local zon-
ing.
Please consider these comments in your deliberations on

Thank you for your efforts in expediting my project referenced
above.
After reviewing your letter of September 8, 1993, I am enclosing
a revised plan that I believe will satisfy your request for changes
from the original plan.
With reference to paragraph 6 in your letter, I cannot agree with
the requirement of a $900 fee for a variance request. If you
would refer to a letter dated March 31, 1992 from Mr. Roy ~aje,
which refers to a letter dated November 22,1991, you will find that
we never received any correspondence from your office in a period
of ove~ four months. If we had received any letter regarding your
requirements in that period, I feel we would have still been
working under the original permit fee, as I feel we supplied all
of the information requested by your office as soon as it was
possibls to do so. As you can see, by referring to twenty-two
letters back and forth, this application has been on-going since
1987. I feel that your September 8th letter regarding project
~10-89-1243 is really the first time we have received something
definitive from your office that I believe both of us can live
with, with a few minor changes. One of those involves the $900
fee, with which I completely disagree, since the chain of this
application has never been broken on the part of the applicant.
Furthermore, on October 11, 1993, i personally sent a hand-
written letter to your office requesting a permit to cut the grass
on the uplands of this project, no lower than 'the four-foot topo
lines on the survey, which would not interfere with any wetlands.

To date, I have not received any answer.
In your letter, paragraph 7 refers to ownership of the property.
If you will refer back ~o the original correspondence, you will
see the communication referred to William and Vincent Geraghty,
for example, the letter dated March 31, 1992 from Mr. Roy ~aje
referred to "File ~10-89-1243 - William and Vincent Geraghty".

The Department of Environmental Conservation has completed its
field review of the proposed project and has the following
comments:
1)
The Department objects to the project as proposed. The
plan proposes to fill approximately 23,000 square feet of
high marsh and the ditch which bisects the property which
consists of shoal/mudflats and littoral zone. Pursuant
to Part 661.5(b) this activity is presumptively
incompatible for the type of area involved. Almost the
entire site is composed of very productive varieties of
tidal wetland vegetation. Filling of this property would
have an undue adverse impact on the system. The high
marsh meadow acts as flood and hurricane and storm
control and aids in cleansing of the ecosystem and
absorption ~f_ silt ~,~--~ organic material.
2)
Filling of the ditches would cause an undue adverse
impact on marine food production and wildlife habitat.
The replacement of the ditches with a drainage pipe would
have a high probability of impacting the marsh system
north of the LIRR tracks, in that the pipe would not be
suitable habitat and therefore would be a deterrent for
finfish to access the ditch system to the north.
3)
The proposal to donate 20,024 square feet of parcel to
NYSDEC or Southotd Town is not sufficient. Of the total
area of Parcel 2, only about 10,000 square feet are
actual marsh lands.

The largest portion of upland exists to the east of the
high marsh area, and a 50 foot wide by 300 foot long
portion of upland adjacent to Main Road, including a CCA
bridge and no division of land.
Submit a revised plan showing the development of the
upland area, no filling of wetlands, the required
variances and pervious parking area. At this time the
application is awaiting a determination of significance
from the Town, therefore, the application remains
incomplete.- Please submit the required $900 for the
variance request and complete the enclosed Long EAF.
A cross section of the sanitary system (showing tank and
pools a minimum of 2 feet above seasonal high water), a
clarification of who the property owner is, William
Geraghty or Vincent Geraghty, and a current mailing
address for the current owner has not been received as
request in Susan Ackerman's correspondence dated
March 23, 1993 and again June 29, 1993. Please provide
this information.

A site plan has been prepared based upon the results of
last fall's on-site meeting between the Board and the
applicants.
We now propose to divide the property into two parcels.
Parcel 1 will consist of 44,062.81 sq. ft., which will be
developed with a two-story boat sales and service office
building, parking, and area for boat display.
In order to accomplish this, it will be necessary to fill
approximately 23~000 sq. ft. of what may be considered to
be wetlands. It will also be necessary to replace the
existing drainage ditch with a 36" drainage pipe to
insure continued drainage of the property to the north.
In exchange for permission to undertake the above, it is
proposed to donate Parcel 2, consisting of 20,024.24 sq.
ft. to either the Town of Southold, New York State
Department of Environmental Conservation, or other not-
for-profit entity for preservation purposes.
After considerable analysis of the property, it was
determined that this site plan affords the applicant a
reasonable use of his property while still preserving at
no cost to any governmental agency a large percentage of
the wetlands.

An applica~on is currently pending before you vo
place fill and regrade property located on the Main
Road.
We have encountered various delays due to problems
in surveying the property to obtain accurate grades.
The surveyor has advised us that the Long Island Rail-
road has buried some of the montmzenvs and the Phragmites
are making surveying difficult. Therefore, we request
a waiver to cut down the Phragmites to allow easier
access.
Another reason for wishing to cut the Phragmites is
to show the property to a prospective temporary
nanv whc wi2hes to place boats on the property for
winter storage. That activity will only require a
minor modification such ass the placement of a fence
on the presently filled property to prevent vandalism
to the boats. A trailer type office may also be
placed on the property. Once the accurate survey had

my clients wish to modify their wetlands application
now pending before you_and for which you have issued
a positive deblaration.
It is now proposed to place a maximum of approximately
1000 cubic yards of spoil, on existing filled areas
only to crea~e a finished elevation of plus 7' above
mean sea level. All filled areas will then be graded
and seeded. No filling of adjacent wetlands will
occur.
It is my understanding that the positive declaration
will be rescinded and a negative declaration issued
in its place.

side of Main State Road at Arshamomaque for the pur-
ose of rectifying an alleged violation issued by the
Town.
In a recent discussion with the Secretary to the Trus-
tees, I have been advised that a summons has been
issued to Mr. Geraghty recently. The purpose of this
letter zs 5o assure ~hat Mr. Geraghty does intend
to file an application and that the delay is due only
to the current heavy workload of both this office
and the surveyor, Roderick Van Tuyl, P.C.
