1. That the said Board of Trustees and the Town of S0uthold are released from any and

4. That the work imml~ed will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the originating application, may be cause for
revocation of this Permit by resolution of the said Boa.rd.
5. That there will be no mareasonable interference with navigation as a rma~lt of the work
herein authorized.
6. That there shall be no interference with the right of the public to pass and repa~ along
the beach between high and Iow water ma~ks.
7. That ff future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Tm.,~ees, the
work shall cause unreasonable obstruruon to free navigation, the said Permirtee will be t~luired~
upon due nod(e, to remove or aires this work or project herein stated without expenses to the Town
of Southold.
8. That the said Board will be notified by the Permirtee ot the completion of the work auth-
orized.
That the Permittee will obtain all other permits and consents that may be required sup-
plemental to this permit which may be subject ro revoke upon failure to obtain same.

from upland source. Deck & boardwalk to be removed and replaced

structures.

Dear Mr. Costello:
The following action was taken by the Board of Town Trustees during
its regular meeting held on September 5, 1991 regarding the above
matter:
WHEREAS, COSTELLO MARINE IN BEHALF OF J.E. VALK applied to the
Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated July 5,
1991 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held b¥ the Town Trustees with respect
to said application on September 5, 1991 at which time all interested
persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and doculnentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED THAT COSTELLO MARINE ON BEHALF OF J.E. Valk BE AND HEREBY
IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO: replace within
18" 160' existing bulkhead & return. Fill with approx. 60 yds.
Clean fill from upland source. Deck & boardwalk to be removed and
replaced after bulkhead is constructed. No expansion to existing
structures.
This permit will expire two years from the date it is signed. Fees
must be paid, if applicable, and permit issued within six months
of the date of this notification. Two inspections are required and
the Trustees are to be notified upon completion of said project.
Please return to the Building Department for a determination on the
need for any other permits which may be required far this project.

project will not have a significant effect on the environment.

Dear Sirs:
I represent John P. Gantly and Susan M. Gantly who purchased the above-referenced
property from Shirley G. Valk. Mrs. Valk or her husband John G. Valk obtained a permit
from the Southold Town Trustees to repair the bulkhead at the premises and I understand that
the permit has not expired.
Neither Mrs. nor Mr. Vaik attended the November 6, 1992 closing of the sale of the
premises. An authorization for permit transfer executed by the Valks was not turned over at
the closing and has not been made available to the purchasers. The Valks have moved out of
state and I do not have their address in the north. The Ganflys wish to proceed with the
repair of the bulkhead on the property and request that the Trustees transfer the permit so
that work may begin.
Pursuant to your instructions, enclosed 1s a copy of the executed deed. You indicated
that th~s letter plus the deed should be sufficient to transfer the permit.
If you have any questions, please call me. In the meantime, thank you for your
attention to and assistance in this matter.
