parr of the conslderafion for the issuance of the Permit do~ understand ami prescribe to the fol-
lowing: 1. The Southold Town Trustees Permit must be prominently
displayed on premises effected during ½eriod of work.
i. That the said Board of Trustees and the Town of Southold are released from any and
all damages, or d~irn~ for dnm~ges, of suits arising directly or indirectly as a result of any oper-
ation performed pursuant to this permit, and the said Permittee villi, at his or her own expeme,
defend any and all such suits initiated by ~ parties, and the said Pennittee resumes full li~
with respect thereto, ~o the complete exclusion of the Bo~ed of Trustees of the Town of Southold
2. That this Permit is valid for a period of 2 4 mos. which is considered to be the
estimated time required to complete the work involved, but should circumstances werram, request
for an extension may be made to the Board at a later date.
3. That this Permit should be retained indefinitely, or as long as the said Pe~-mittee wishes
to maintain the structure or project involved, to provide evidence to anyone concerned that enth-
orizadon was originally obtained.
4. That .the work involved will be subject to the inspection and approval of the Board or
its agents, and non-compliance with the provisions of the origi~t;ng application, may be cause for
revocation of this Permit by resolution of the said Board.
5. That there will be no unreasonable interference with navigation as a result of the work
herein authorized.
6. That there shall be no interference with the fight of the public to pass end repass along
the beach between high and Iow water marks.
7. That if future operations of the Town of Southold require the removal and/or alterations
in the location of the work herein authorized, or if, in the opinion of the Board of Trustees, the
work shall came unreasonable obstrucnon to free navigation, the said Petmittee will be required,
upon due notice, to remove or alter this work or project herein stated without expenses to the Town
of Sonthold.

plemental to this permit which may be subject to revoke upon failure to obtain same.

Dear Mr. Bowman:
The following action was taken by the Board of Town Trustees
during their regular meeting held on May 31, 1989 regarding the
above matter:
WHEREAS, Land Use Company on behalf of Anthony Gambino applied to
the Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated April 5,
1989, and
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on May 31, 1989 at which time all interested
persons were given an opportunity to be heard, and
WHEREAS, the Board members have personally viewed and are familiar
with the p~emlses in question and the surrounding area, and
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
'the town,
NOW, THEREFORE BE IT
RESOLVED that Land Use Company ON BEHALF OF Anthony Gambino BE AND
HEREBY IS GRANTED PERMISSION UNDER THE WETLAND ORDINANCE TO:
Construct 4' x 32' catwalk, 3~ x 12' ramp, two 5' x 20' floats, adn
install 12 pilings to secure structures, with the condition that a
buffer zone be maintained. Property is located at 1450 Luptons Point
Road, Mattituck, N.Y.
This permit will expire two years from the date it is signed if
work has not commenced by said date. Fees must be paid and permit
issued within six months of the dateof this notification. Two
inspections are required and the Trustees are to be notified upon
completion of said project.
Please return to the Building Department for a determination on
the need for any other permits which may be required for this project.
Permit will be issued upon payment of the following fees for

Dear Ms. O'Brien:
Thank you for you letter of April 23, 1989. We have been in
contact with Mr. Gambino and he advised us that a landscaper placed
the trees in the Right of Way without his knowledge and that the
trees will be removed as soon as possible.
We would also like to assure you and other property owners that
projects involving the wetlands are done with the rights of other
property owners in the area in mind. Mr. Gambino's application will
be processed accordingly.

SUPPLEMENTARY SPECIAL CONDITIONS

following conditions apply to all permits:
If any of the permit conditions are unclear,the permittee shall con-
tact the Division of Regulatory Affairs at the address and telephone
noted below.
A copy of this permit with supplementary conditions and approved
plans shall be available at the @roject site whenever authorized
work is in progress.
The permit sign enclosed with the permit or a copy of letter of
approval shall be protected from the weather and posted in a con-
spicuous location at the work site until completion of authorized work.
At least 48 hours prior to commencement of the project, the permittee
shall complete and return the top portion of the enclosed receipt form
certifying that he is fully aware of and understands all provisions and
conditions of this permit. Within one week of completion of the
permitted work, the bottom portion of that fcrm shall also be com-
pleted and returned.
For projects involving activities to be accomplished over a period of
more than one year, the permittee shall notify the Regional Permit
Administrator in writing a5 least 48 hours prior [u the commencement
of resumption of work each year.
If project design modifications take place after permit issuance, the
permittee shall submit the appropriate plan changes for approval by
the Regional Permit Administrator prior 5o undertaking any such modi-
fications. The permittee is advised that substantial modification
may require submission of a new application for permit.
Ail necessary precautions shall be 5aKen to preclude contamination of
any wetlands or waterway by suspended solids, sediment, fuels,
solvents, lubricants, epoxy coatings, paints, concrese, leachate or
any other environmentally deleterious materials associated with the
pro~ect work.

From the information submitted it appears that the proposed work
is authorized by our General Permit for Non-Commerical Mooring
Structures (NYI)GP-08) a copy of which is enclosed. Your work should be
performed according to the conditions of this General Permit.
Please display the enclosed Notice of Authorization sign at your
work site. A copy is enclosed for your records.
You are required to submit to this office the dates of
commencement and completion of your work . Enclosed are two postage
paid postcards for you to use to submit the required dates.
Notice is hereby given that the permittee should recognize that a
possibility exists that the structure permitted herein may be subject
to wave wash from passing vessels. The issuance of this permit does
not relieve the permittee from taking all proper steps to insure the
integrity of the structure permitted herein and the safety of boats
moored thereto from damage by wave wash and the permittee shall not
hold the United States liable for any such damage.
It should be noted that this permit does not relieve you of the
obligation to obtain any State or local approvals for your work.
If, for any reason, a change in your plans or construction
methods is found necessary, please contact us immediately to discuss
modification of your permit. Any change must be approved before it is
undertaken.

You are required to submit to this office the dates of
commencement and completion of your work . Enclosed are two postage
paid postcards for you to use to submit the required dates.
Notice is hereby given that the permittee should recognize that a
possibility exists that the Structure permitted herein may be subject
to wave wash from passing vessels. The issuance of this permit does
not relieve the permittee from taking all proper steps to insure the
integrity of the structure permitted herein and the safety of boats
moored thereto from damage by wave wash and the permittee shall not
hold the United States liable for any such damage.
It should be noted that this permit does not relieve you of the
obligation to obtain any State or local approvals for your work.
If, for any reason, a change in your plans or construction
methods is found necessary, please contact us immediately to discuss
