Dear Mr. Haje:
The following action was taken by the Board of Town Trustees during
its regular meeting held on Thursday, April 29, 1993 regarding the
above matter:
WHEREAS, En-Consultants on behalf of Michael Gambardella applied to
the Southold Town Trustees for a permit under the provisions of the
Wetland Ordinance of the Town of Southold, application dated February
24, t993 and,
WHEREAS said application was referred to the Southold Town
Conservation Advisory Council for their findings and recommendations,
and,
WHEREAS, a public hearing was held by the Town Trustees with respect
to said application on Thursday, April 29, 1993 at which time all
interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar
with the premises in question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation
submitted concerning this application, and,
WHEREAS, the Board has determined that the project as proposed will
not affect the health, safety and general welfare of the people of
the town,
NOW, THEREFORE BE IT
RESOLVED that the Board of Trustees approves the application of
En-Consultants on behalf of Michael Gambardella to construct a
timber dock consisting of a 4' X 110' fixed elevated (including ramp
at inner end); a 4' X 12' hinged ramp; (2) 8' X 16' floats secured by
{2) 2 piling dolphins.
Permit will expire two years from the date it is signed. Fees must
be paid, if applicable, and permit issued within six months of the
date of this notification. Two inspections are required and the
Trustees are to be notified upon completion of said pro~ect.
Permit will be issued upon payment of the following fees
be done below Mean High Water Mark:
catwalk 4' X 75' = 300 sq.ft. X $2.00 = 600.00
Ramp 4' X 12' = 48 sq. ft. X 2.00 = 96.00

of Permission. This is in accordance with current Federal Regulations
governing work in navigable waters of the United States. To accomplish
the coordination required, prior vo the issuance of a Letter of
Permission, your review of the enclosed drawing(s) is requested.
Pursuant to Section (c) of the Coastal Zone Management Act of 1972
as amended [(16 U.S.C. 1456 (c)], the applicant has certified that the

Dear Mr. Meyer:
This letter is in response to yours of February 22, 1993.
The area in which the dock is to be constructed is not as
pristine as you might believe. Many docks and bulkheads
are located in the area, including a bulkheaded slip im-
mediately to the east and docks in close proximity to the
west.
In addition, many docks and bulkheads are located on the
opposite shore, including one that was constructed in
1992 for which this office obtained all perr..it~.
We do not believe that shading will be a significant
problem in that construction will adhere to Corps stan-
dards of 4' above the grade of the marsh. As the par-
cel lies on an indented portion of the shoreline, the
dock will notpose a hazard to navigation as other parts
of the existing shoreline already are located farther to
the north. No dredge navigation channel is located
within this indentation but lies farther to the north
well beyond the proposed dock.
The photographs already presented to you are representa-
tive of the character of the area. I cannot legally
trespass upon properties of others to present individual
photographs of surrounding existing structures, nor would

they present an overall view of their location in
relation to the proposed dock. You may, however, have
aerial photographs either from the NYSDEC or Corps of
Engineers that would show existing improvements.
We submit that the proposal is totally in keeping with
the character of the neighborhood, usage of waterfront
property, and does not contravene either environmental or
navigation standards. We urge your approval as soon as
possible.

Dear Mr. Haje:
Pursuant to t5 CFR 930.58, the following data and information is necessary
to enable the ~epartment of State to adequately assess the coastal zone effects
of this proposed project.
1. This project as proposed would be within the Cutchogue Harbor Wetlands
significant habitat. The narrative for this significant habitat
states that "nesting osprey, hems, and plovers inhabiting the area
are vulnerable to disturbance by humans from April through
mid-August." It also states that recreauional activities in areas near
nesting sites should be minimized during this period. The narrative
also etates that "Construction of shoreline structures , such as
docks, piers, bulkheads, or revetments, in areas not previously
disturbed by development, may result in the loss of productive areas
which suppert the fish and wildlife resources of the Cutchogue Harbor
area.
From the submitted photographs, it appears that construction is sparse
in this area of the Haywater Cove. The addition of the proposed dock
may result in adverse shading impacts to the intertidal and salt marsh
areas. Additionally, it appears that due =o the sparse development,
this area may offer valuable nesting area to some of the above
mentioned shore-bird species. Please comment on the potential of
adverse impac= from this proposed construction and associated increaBe
of human activity during the summer months.
If similar strucnures exist in this area of Haywater Cove, please
submit photographs depicting such dock structures. This proposal may
not be in character with the use of this cove.

Navigational and public access problems may result from this proposed
structure. Traditional boating uses of this small cove area may be
adversely impacted as the result of this structure. In addition,
public access ~long the shore may be diminished. Please comment on
these issues.
Pursuant to 15 CFR 930.60(a), the review of your consistency certification
will begin after we receive and determine that the necessary data and
information is ad~/uate to assess coastal zone effects.
Any additional information which you believe will facilitate Our
consistency review of this project would be appreciated~
