BASIS OF APPLICATION: Building Inspector's May 1, 2001 Notice of Disapproval denying a
building permit for an "as built" deck addition because part of the deck has a side Notice of
Disapproval for the reason that the deck addition, as built, is less than the code requirement of 15 feet
from the property line, pursuant to Article XXIV, Section 100-244B.
AREA VARIANCE REQUESTED: Applicant requests authorization to locate a 16'7" x 18 ft. "as
built open wooden deck, a part of which is seven (7) feet +- at its closest point to the south, side
property line, instead of the code's required 15 ft. minimum.
FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on February 21, 2002, at which
time written and oral evidence was presented. Based upon all testimony, documentation, personal
inspection of the property and the area, and other evidence, the Zoning Board finds the following facts
to be true and relevant.
PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the easterly side of Cox
Neck Road in Mattituck. The property is .579 of an acre (to tie line at water) with 160 feet of street
frontage. The property narrows at it extends easterly toward the water, and more site details are as
shown on the survey map under consideration prepared by Roderick VanTuyl, P.C. on February 13,
1992.
REASONS FOR BOARD ACTION:
1. Grant of the area variance will not produce an undesirable change in the character of the
neighborhood or detriment to nearby properties. The variance involves part of an existing 16'7" by
18' small open deck addition that extends from applicant's single-family dwelling into the side yard
and hill to the property line. The deck is not readily visible from Cox Neck Road, and is not visible to
adjoining property owners. According to applicant's testimony, the deck was constructed prior to
their purchase of the property, and they seek authorization to correct the deficiency.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant
to pursue, other than an area variance. Applicant has testified, and the board agrees, that it would be
very costly to remove that part of the deck which is nonconforming, and/or to remove the entire deck
and construct it in a conforming location. Since the impact to the neighborhood is di minimus, the
$4,000-$5,000 cost does not justify an alternative location.
3. The variance granted herein is not substantial because only a corner of the total deck area is
nonconforming, and 60% of the deck falls within the code-required 15 ft. side yard minimum.

4. The alleged difficulty has been self-created because the applicants should have known that the deck
did not have a Certificate of Occupancy when they purchased the property.
5. The variance granted will not have an adverse effect or impact on the physical or environmental
conditions in the neighborhood or district. The Southold Town Trustees have reviewed this
application and issued a Wetland Permit for the existing deck on January 23, 2002. No evidence has
been submitted to suggest that this minor variance will have an adverse impact on physical or
environmental conditions in the neighborhood.
6. Grant of the requested variance is the minimum action necessary and adequate to enable applicant
to enjoy the benefit of an open deck addition while preserving and protecting the character of the
neighborhood and the health,safety, and welfare of the community.
BOARD RESOLUTION ACTION OF THE BOARD: In considering all of the above factors, and
applying the balancing test under New York Town Law, motion was offered by Member Oliva,
seconded by Member Tortora, and duly carried, to
GRANT the variance AS APPLIED FOR and with the CONDITION that the deck remain
open to the sky.
This action does not authorize or condone any current or future use, setback or other feature of the
subject property that violates the Zoning Code, other than such uses, setbacks and other features as
are expressly addressed in this action.
Vote of the Board: Ayes: Members Goehringer (Chairman), Tortora, Oliva, and Orlando. (Member
Horning of Fishers Island was absent.) This Resolution was duly adopted (4-0).

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and Chapter 100
(Zoning), Code of the Town of Southold, the following application will be heard at a public
hearing by the SOUTHOLD TOWN BOARD OF APPEALS at the Town Hall, 53095 Main, Road,
Southold, New York 11971, on THURSDAY, FEBRUARY 21, 2002, at the time noted below (or as
soon thereafter as possible):
6:35 p.m. Appl. No. 5055 - VINCENT O'NEILL — This is a request for a Variance under
Zoning Code Section 100-244B based on the Building Inspector's May 1, 2001 Notice of
Disapproval. The applicant is requesting approval of the location of an existing (deck) addition
with a side yard setback of less than 15 feet. Location of Property: 3500 Cox Neck Road,
Mattituck; Parcel 1000-113-8-1.
The Board of Appeals will hear all persons, ortheir representative, desiring to be heard
at the hearing, or desiring to submit written statements before the conclusion of this hearing.

Dear Mr.O'Neill::
The following action as taken by the Board of Town Trustees during a Regular Meeting, held on
January 23, 2002, regarding the above matter.
WHEREAS, VINCENT O'NEILL applied to the Southold Town Trustees for a permit under the
provisions of the Wetland Ordinance of the Town of Southold, application dated December 27,
2001
WHEREAS, said application was referred to the Southold Town Conservation Advisory Council
for their findings and recommendations, and
WHEREAS, a Public Hearing was held by the Town Trustees with respect to said application on
January 23, 2002 at which time all interested persons were given an opportunity to be heard, and,
WHEREAS, the Board members have personally viewed and are familiar with the premises in
question and the surrounding area, and,
WHEREAS, the Board has considered all the testimony and documentation submitted
concerning this application, and,
WHEREAS, the structure complies with the standard set forth in Chapter 97-18 of the Southold
Town Code.
WHEREAS, the Board has determined that the project as proposed will not affect the health,

safety and general welfare of the people of the town,
NOW THEREFORE BE IT.
RESOLVED, that the Board of Trustees approved the application of Vincent O'Neill for a
Wetland Permit for existing deck.
BE IT FURTHER RESOLVED that this determination should not be considered a determination
made for any other Department or Agency, which may also have an application pending for the
same or similar project.
Fee must be paid, if applicable and permit issued within six months of the date of this
notification.
Two inspections are required and the Trustees are to be notified when project is started and on
completion of said project.

I request that the board hear my application in my absence. We purchased the
home in 1999. The existing C.O. did not include the deck. The survey, dated 1992
showed the deck but the 1992 C.O. did not include this. The building department required
a set of plans with an architects stamp because the deck was already built. In addition to
the plans a variance was required because the corner of the deck is approximately 7feet
too close to the property line.
More than a year ago my family and I planned a trip during mid-winter recess. I
did not anticipate at the time of application that the dates would overlap. Time is
important in this matter because a sale is pending and I am trying to correct the C.O. to
include the deck. Canceling the trip would be difficult because of reservation penalties
and the time schedule of my wife and son, a teacher and student respectively. Your
consideration of this matter is greatly appreciated.
