No. 5100—Robert Mills Olsson 88.-5-27, 28 Property Location: Rambler Road and Main Bayview Road, Southold BASIS OF APPLICATION: Building Department's February 5, 2002 Notice of Disapproval for the reason that Lot#27 is merged with Lot#28, due to common ownership for some time after May 1983. REQUEST SUBMITTED: Applicant is requesting a Waiver under Section 100-26 of the Zoning Code to unmerge the westerly half of the property (CTM Lot 88-5-27) from the adjacent easterly half containing a house(CTM Lot 88-5-28). FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 16, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION: The applicant's property is located on the south side of Main Bayview Road in Southold. The entire area of both lots consists of 54,139 sq. ft. The vacant lot in this merger is 26,410 sq.-ft. The remaining house lot is 27,729 sq. ft. Both lots have at least 150 feet along Main Bayview Road. The house lot is improved:with a single-family dwelling shown at 38.8 feet from the front property line and 27+-feet from the center line between the properties. ADDITIONAL INFORMATION: See all title references for dates of conveyances by deeds, and the .owership history submitted for the record. REASONS FOR BOARD ACTION: In accordance with the review standards set forth in Town Law 267b-3 "area variances," the Board has considered the benefit to the applicant if the variance is granted, as weighed against the detriment to the health, safety and welfare of the neighborhood and community by such grant, and determines that: 1. The waiver of merger will recognize the original lot lines described on the Map of Terry Waters and in the original deeds creating the lots. These two lots, when separated, will be equivalent in size to the neighboring lots. 2. The waiver of merger will allow for the ultimate construction of one additional single-family residence in the neighborhood,which will not result in a significant increase in the density. 3. Waiver of merger will avoid economic hardship. The applicant submitted adequate information to establish an economic hardship if the waiver is not granted. 4. There will be no significant change to the details and character of contours and slopes of these lots, nor will there be any substantial filling of land that would affect any environmental or coastal areas. , _ , , , p`'�p Page 2- May 16, 2002 ZBA Appl. WAIVER OF MERGER ZBA MAY WAIVE THE MERGER AND RECOGNIZE ORIGINAL LOT LINES UPON PUBLIC HEARING AND UPON FINDING THAT: (1) THE WAIVER WILL NOT RESULT IN A SIGNIFICANT INCREASE IN THE DENSITY OF THE NEIGHBORHOOD The subject property are lots on a filed map of Terry Waters subdivision. The parcels were acquired by Edward Mills in 1946 (lot 28) and 1958 (lot 27); the lots were inherited by Robert Mills Olsson. Mr. Olson received the lots on August 17, 1998 after probate of the estate. The properties have been treated as separate parcels. The house (lot 28) was financed in 1999 with a $130,000 mortgage. The lot was placed on the real estate market and is under contract for $120,000. The additional lot will not result in a significant increase in the density of the neighborhood. (2) THE WAIVER WOULD RECOGNIZE A LOT THAT IS CONSISTENT WITH THE SIZE OF LOTS IN THAT NEIGHBORHOOD The lots are slightly larger than the other lots in Terry Waters subdivision. The house faces Main Bayview and adjacent to the Angel Shores subdivision open space. (3) THE WAIVER WILL AVOID ECONOMIC HARDSHIP The Estate paid estate tax on the value of the two properties,Mr. Olsson was the beneficiary of the estate, therefore the taxes came out of his inheritance. The house has been financed ($130,000) and the lot is under contract for$120,000. In the Terry Waters subdivision, lot 27 is like any other lot in that subdivision, to deny this waiver of merger result in a detriment to the owner of the property.
