No. 5113 - Kim and Beverly Norkelun. Property Location: 2200 Grand Avenue, Mattituck; 107.-2-10.2. BASIS OF APPLICATION: Building Department's February 27, 2002 Notice of Disapproval, under Zoning Code Sections 100-242A and 100-244B, for the reason that applicants' proposed addition to the existing dwelling will have a front yard setback at less than 40 feet. AREA VARIANCE REQUESTED: Applicants at the May 16, 2002 public hearing, amended their original request (originally for an 8.9' extension in front of the house), reducing it to 4 ft. x 12 ft. wide landing/step entry, at the front of the dwelling, and a 12'x 22.2+- addition which will be in line with the 17'9" front yard setback of the existing dwelling. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on May 16, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION: The applicants' property contains 33,588 sq. ft. of land area with 251.80 feet along the east side of Grant Avenue and 135 feet along the north side of Maple Avenue, a private 15.5 ft. wide right-of-way. This property is improved with a single-family, two- story frame house, accessory frame garage and swimming pool structure, located as shown on applicants' June 14, 1999 survey prepared by Peconic Surveyors, P.C. REASONS FOR BOARD ACTION: In accordance with the review standards set forth in Town Law 267b-3 "area variances," the Board has considered the benefit to the applicant if the variance is granted, as weighed against the detriment to the health, safety and welfare of the neighborhood and community by such grant, and determines that: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The extension is one story in height and is limited to a four ft. protrusion from the house setback. There are other varied setbacks of principal dwellings in the immediate area easterly towards a private right-of-way, will be one-story, and will not extend beyond the four ft. protrusion as requested. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The nonconforming location of the existing buildings at the southerly end of this corner lot removes any opportunity for another method for additional living area without a variance. 3. The variance granted is substantial, representing a 31+- ft. reduction from 40 feet. 4. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. Grant of the requested variance is the minimum action necessary and adequate to enable applicant to enjoy the benefit of an addition at the east side of the dwelling, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. BOARD RESOLUTION ACTION OF THE BOARD: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Orlando, seconded by Chairman Goehringer, and duly carried, to APPROVE the variance as applied for, SUBJECT TO the condition that the setback be no closer than 13.9 ft. to the step/walkway and 17'9' to the addition. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. THE CHAIRMAN: How about the main house? MR. HEWER: The main house has been empty for one ,year. A year this past January. MR. BERGEN: I would say that he sould not use that summer bungalow as a residence at any time. THE CHAIRMAN: Why is that, Bob? MR. BERGEN: It makes two houses on a small parcel. THE CHAIRMAN: There is about 30 ,000 square feet on that lot. MR. BERGEN: Not when you divide it. That is just my opinion. MR. BERGEN: See, there was an acre there, and now we are cutting down to 3/4 an acre. THE CHAIRMAN: The ares of the lot directly across the street is 115 x 150 which gives you about 16 ,000 square feet. The lot next to that is 15,000 square feet. We are talking about lots on Grand Avenue. Tow, lots directly to the south and across Maple aL ne, one is approximately, 16,000 square feet and one is approximately 15,000 square feet. The Jemmot lot to the north appears to be somewhat larger, 300 feet by 136 feet which gives you about 53 ,000 square feet. Across the street are 100 x 150, 161, all approximately 1/3 of an acre, which is about what this would become. I would think this lot should not be further divided. MR. OLSEN: I do not think it is particularly significant to limit the use of .the cottage to a seasonal use. The cottage is there and again it is a pre--existing use. I really wouldn't like the Board to put a limitation on the use of the cottage, if possible. I know the-,intention of my client is to put alot of money in the main house and renovate it. THE CHAIRMAN: Mr. Heuser, how long have you lived there? MR. HEUSER: I have been here for 40 years, but have lived there permanently for 14 years. THE CHAIRMAN: Can you tell us who occupied the bungalow? MR. HEUSER: Yes, a party by the name of Sylser rented it every summer. TEE CH P.MA : And it was used for summer rental? MR. BERGEN: How long ago was that? MR. HEUSER: The last time was THE CHAIRMA] : I think the reactivation of the property should be limited to seasonally. I think it would be wise for the Hord to specify that this southerly portion net be further divided and the bungalow be limited to seasonal rental for not more than 6 or 7 months of the year. The garage has 3 doors• off and 2 doors broken. Everyone on Maple Lane who -has visitors, their first comment is about the condition of that property as you drive uP the road. You have seen it haven't you? THE CHAIRMAN: Yes, we have, and it i dilapitated. Our exper- ience here is that when you have a dilapitated situation some encourage- ment be given to the applicant to renovate it. In a couple of cases we have done this with excellent results. Some break has to be given to get the property improved, MR. HEUSER: As you know we are both neighbors'. Everybody on Maple Avenue would like to see that property improved. ; - MR. JEMMOT: ' We have no problem with ghat as long as we hake the proper safeguards. We could have two disastrous places on Maple Avenue and Grand Avenue instead of one. I do not think that would be- in the best interest of anyone. THE CHAIRMAN: Suppose we deny this? Who is going to buy this ' - whole piece of property, and renovate 2 old houses? MR. Mudd along the north side of the premises, which right-of-way is one rod in width. That is an old right-of-way that has been established through deeds. At the time of inspection, the board found that there is a deck area at the northerly side of the house and stockade/chainlink fence surrounding the inground swimmingpool. The premises in question is a corner lot with 126' frontage along Grand Avenue and 210' frontage along Maple Avenue, and containing an area of ?9,448 square feet. The board agrees with the reasoning of applicant and feels that the requested location is the most practical and feasbade under the cir- cumstances.
