No. 5081 -ANDREW and WILLIAM LUTKOWSKI 77.-2-18, 25 STREET & LOCALITY: 480 Birch Lane, Southold DATE OF PUBLIC HEARING: May 16, 2002 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The subject property is a vacant lot shown on the Map of Goose Bay Estates (Lot#121-125), with a total lot area of 9214 +-sq. ft. The property is 19.74 feet along Cedar Avenue, 165.14 ft. along the south side of Birch Avenue, 127.68 ft. along the easterly line which abuts Lot Numbered 85-90, and 125 ft. along the southerly property line (abutting Lot 120). BASIS OF APPLICATION: Building Inspector's January 24, 2002 Notice of Disapproval which states that under Section 100-25A the subject parcel was held in common ownership with adjoining lot CTM 77.-2-25, and at some time after July 1, 1983, lots 77-2-18 and 25 merged. RELIEF REQUESTED: Applicant requests a Lot Waiver to unmerge CTM Lot 18 from CTM Lot 25. ADDITIONAL INFORMATION: Goose Bay Estates is referred to as Map No. 1176, filed on November 13, 1934, in the Office of the Suffolk County Clerk. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. The merged vacant property (CTM Lot 18) was transferred from the applicants' father, Andrew Lutkowski, and transferred to his wife, Helen Lutkowski, on 1/24/73 by deed recorded at Liber 12128. 2. The adjacent house lot (CTM Lot 25) was owned by Andrew and Helen Lutkowski (deed at Liber 7344 page 548, from 1948 and 1/24/73, with Helen Lutkowski acquiring all ownership on 1/24/73. 3. On 6/27/01, the vacant lot (18) was conveyed by Helen Lutkowski in a family transfer to her sons, William J. and Andrew K. Lutkowski, the applicants'"The'applicants now-wish-.to-build-a_.- dwelling. The unimproved Lot is similar in size to other lots on this Subdivision Map. 7. Waiver of the merger will recognize the lot lines described in the 1948 and 1973 deeds, and outside lines shown on the former Goose Bay Estates Map. 8. The vacant CTM Lot 18 comprises 9,214 sq. ft. in area with a proposed circular driveway on the north side along Birch Avenue, near the center. The Board understands that any future construction will be subject to reviews by other appropriate agencies and that drainage from rain or other water runoff will be collected into drywells on site installed by the owners. 9. If the merger is not waived, the applicants will not be able to use their land for a single-family dwelling. RESOLUTION/ACTION: On motion by Member Tortora, seconded by Member Orlando, it was RESOLVED, to GRANT the Lot Waiver, to unmerge Lots 18 and 25, as applied for and SUBJECT TO THE FOLLOWING CONDITIONS: 1. The provisions for drywells and for drains leading thereto shall be implemented. Prior to the issuance of a Certificate of Occupancy for any house erected on the subject property, the Southold Town Engineer, or a Professional Engineer designated by him, shall confirm the adequacy of the drywells and drains, based on his professional assessment of the provisions necessary to contain runoff water on the site. Any costs associated with such confirmation shall be borne by applicant. 2. The provisions for hay bales and silt fences shall be implemented, and applicant shall make every effort to minimize and control runoff and erosion during construction. 3. There shall be only one driveway, except for a circular driveway, and the major portion of the driveway areas closest to the point of access along Birch Avenue shall have a base of water- pervious construction. 4. Prior to the issuance of a Certificate of Occupancy for the proposed dwelling, the owner(s) of the subject property shall execute and file with the Suffolk County Clerk a covenant imposing the above-noted constraints on the property. The Lutkowski property in question is part of a steep hill whose summit is the Cohen property, lots 114-106. On the Lutkowski property, the elevation on the northeast corner rises from 44.2' to 48.2' and the southwest boundary from 41.2' to 59.6' . The test hole data shows pale brown silty sand1-:from-,0=22' and pale brown fine to .medium. sand 22-28' . The Lutkowski property is across Cedar Avenue from the Hammel/Dempsey property (Application #4974: decision rendered September 20, 2001) . Both the Hammel/ Dempsey property and the Lutkowski properties share very similar slope and sand. We do not oppose the division of the Lutkowski property providing that, in order to insure against the flooding and erosion caused by possible development, the safeguards placed on the Hammel/Dempsey property be also placed on the Lutkow- ski property. After an extensive visit and review of the property with my brother several findings need addressing. LOT# 125 If it is your intention to covenant this corner lot to remain in its natural state, please be aware that this lot offers the lowest incline from road base to natural grade. This area would be the easiest driveway approach, and allowing for efficient run off control. Please allow for a possible driveway cut, leaving the remanding area in its natural state. (See attached picture) Non-Impervious Driveway The driveway slopes that would be present on this property need to have the water runoff controlled, by means of diverting water to garden areas and dry wells. This can only be achieved by an impervious surface (black top) so multi and compound angles can be maintained. Contours that cannot be achieved with a moveable and constantly migrating gavel surface. Driveway Cuts This property being a odd shape parcel and with a limited building envelope a final driveway location can not be determined until the home is-completed and a landscape architect design is presented.
