No. 5064—MARY LEONARDI Property Location: 1285 Reydon Drive, Southold 80-2-15.1 BASIS OF APPLICATION: Building Inspector's December 5, 2001 Notice of Disapproval for the reason that the northeast section of applicants' proposed dwelling will be less than 50 feet from the rear property line as required under Article XXIV, Section 100-244B. AREA VARIANCE REQUESTED: Applicant is requesting a location of a new dwelling, as amended with the Board of Appeals on February 19, 2002, for a setback of 35 feet at its closest point from the northeast property line. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on February 21, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION: The applicant's vacant property is a pie-shaped lot located on the north side of Reydon Drive and south side of an unnamed roadway, at Reydon Shores, Southold, according to the map of Anthony W. Lewandowki, L.S. dated, September 13, 2000, updated August 27, 2001. The property contains an area of 20,850+- sq. ft. and is referred to as Lots 33, 34, and 35 on the former Reydon Shores,Block E, map. REASONS FOR BOARD ACTION: Based on the testimony and record before the Board and personal inspection,the Board make the following findings: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties., ,The variance involves a small corner portion of the dwelling at the northeasterly section part of the proposed dwelling. The'dwelling is modest, at 1300 sq. ft. The property contains three yard areas which are front, with the only remaining yard as the rear yard. Under the definitions of the zoning code, there is no designated 15 ft. minimum side yard on this corner lot that might otherwise be available. The available area is very restricted, and the lot has an unusual shape. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. The proposed location will meet the minimum requirements of the code for all other property line setbacks, and is similar to other dwellings in the community. The applicant's lot has an unusual shape which limits the available area to build a dwelling. 3. The variance granted herein is not substantial because only a small portion of the dwelling, at a corner, falls within the code required 50 ft. minimum from the rear property line. The difficulty was self-created when the applicant became aware of the size and purchased the property. 5. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. There are no wetlands or other low-lying areas on this property, and no evidence has been submitted to suggest that this minor variance will have an adverse impact on physical or environmental conditions in the neighborhood. 6. Grant of the requested variance is the minimum action necessary and adequate to enable applicant to enjoy the benefit of a new dwelling, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. BOARD RESOLUTION ACTION OF THE BOARD: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Oliva, seconded by Member Tortora, and duly carried,to GRANT the relief for a setback at 34 feet as shown on the amended plan by Proper-T Permit Services dated Feb. 15,2002. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The error was the omission of the front porch on the house as shown in the architect's plans, The inclusion of the front porch requires an adjustment to the proposed location of the house on the property. The rear yard setback,the subject of this application for a variance, is now shown as 34 feet. It was originally shown as 40 feet. A new Project Plan has been prepared and a copies of it are enclosed. In addition, drawings show- ing the dimensions of the foundation of the proposed house are enclosed, as are photographs of the project site. Strang and filed simultaneously herewith at the Town Clerk ' s Office . ) The board took the following action after the hearing:and deliberations : WHEREAS, a public hearing was held and concluded on March 7 , 1985 , in the Matter of WILMA MEEHAN and MARY LEONARDI under Appeal No. 3318 , during which time testimony was received in behalf of this application , and there was no opposition ; WHEREAS, the board members have personally viewed and are familiar with the premises in question and its surrounding area , as well as all -- - - , • Southold Town Board of Appeals -4- March 7 , 1985 Regular Meeting (Appeal No . 3318 - MEEHAN AND LEONARDI , continued: ) the statements of record; and WHEREAS, the board made the following findings of fact : 1 . The property in question is located in an "A" Residential and Agricultural Zoning District and contains a total area of 39 , 900± sq . ft. and total frontage along Reydon Drive of 326. 10± feet; 2. The property in question is shown to be Lots No . 29, 30 , 31 , 32 , 33 , 34 and 35 of the 1936 Subdivision of Reydon Shores , Block E, Suffolk County Clerk Map No. 631 , and is more particularly identified on the Suffolk County Tax Map as District 1000 , Section 80 , Block 02 , Lot 15 ; 3. The applicants are requesting: (a ) proposed Lot 1 of an area of 19 ,050 sq.. ft. , comprising Reydon Shores Lots 29, 30, 31 , and 32 , and having a lot width of 120 .6± feet and lot depth of 153. 1± and 158 .4± feet; (b) proposed Lot 2 of an area of 20 ,850 sq . ft. , comprising Reydon Shores Lots 33 , 34 and 35 , and having a lot width of 205. 5 feet and lot depth of 158.4 feet ; 4. Proposed Parcel 1 is improved with a one-family, one-story dwelling set back approximately 20 feet from Reydon Drive and 461 feet from its northerly side property line ; proposed Parcel 2 is vacant at the present time . 5. Article III , Section 100-31 , Bulk Schedule of the Zoning Code requires a minimum lot area of 80 ,000 sq . ft. , lot width of 175 feet and lot depth of 250 feet; 6 . For the record, it is noted that on January 21 , 1985 , the Planning Board recommended approval of this application; 7. In viewing the character of the neighborhood, the board finds the lots as proposed to be consistent with those existing in the neighborhood , and of similar or larger size accordingly. In considering this appeal , the board determines : (a) the relief requested is not substantial in relation to those existing in the neighborhood; (b) there will be no effect on population density and will not affect available governmental facilities ; (c) there will, be no substantial change in the character of the neighborhood or substantial detriment to adjoining properties; (d) the circumstances of this appeal are unique in that the land in question consists of lots on a subdivision map filed in the County Clerk' s Office; (e ) there is no other method feasible for appellant to pursue , other than a variance; (f) that in view of the manner in 'which the difficulty arose , justice will be served by allowing the variance applied , as noted below. - Southold Town Board of Appeals -5- March 7 , 1985 Regular Meeting (Appeal No . 3318 - Meehan and Leonardi , continued : ) .; NOW, THEREFORE, on motion by Mr. Goehringer , seconded by Mr. Grigonis , it was RESOLVED , that the relief requested under Appeal No , 3318 in the Matter of WILMA MEEHAN and MARY LEONARDI for approval of insufficient lot area and width of Parcel 1 of 19,050 sq . ft. and 120.6± feet , and of Parcel 2 of 20 ,850 sq . ft. in area , BE AND HEREBY IS APPROVED, SUBJECT TO THE FOLLOWING CONDITIONS: 1 . There be no further subdivision or lot area reductions ; 2 . Buildings to be constructed must comply with the setback requirements of the zoning ordinance applicable to this lot size .
