REQUEST MADE BY APPLICANT: A Special Exception is requested under Article III, Section
100-30A.2B and 100-31 B, sub-sections 14a-d of the Southold Town Zoning Code (amended 2-7-9)
for the applicants' proposed Bed and Breakfast, accessory to their residence in the existing single-
family dwelling, for two (2) bedrooms, for lodging and serving of breakfast to not more than four(4)
casual, transient roomers.
PROPERTY DESCRIPTION: This property contains an acre of land area and fronts along the
north side of Harper Road West in Southold. The property is improved with a 1-1/2 story frame
house with attached garage, which is maintained and used as the owners' residence.
OTHER INFORMATION: A minimum of four(4) parking spaces (two for the Bed and Breakfast Use and
two for the single-family dwelling) is required under the Zoning Code and the spaces are proposed on-
site as shown on the applicant's diagram submitted with this request. The applicants are the owners
and agree to occupy the dwelling as their principal residence, and understands that a Certificate (of
Occupancy or Compliance must be obtained from the Building Department before occupancy as a Bed
and Breakfast.
REASONS FOR BOARD ACTION, DESCRIBED BELOW.
1) This accessory use as requested is reasonable in relation to the District in which is located,
adjacent use districts, and nearby and adjacent residential uses.
2) The Special Exception is for approval of the Bed and Breakfast as an accessory use incidental
to the applicant-owner's residence in this dwelling and will not prevent the orderly and reasonable
use of adjacent properties and the use has adequate parking and available open space.
3) This accessory use will not prevent orderly and reasonable uses proposed or existing in
adjacent use districts.
4) No evidence has been submitted to show that the safety, health, welfare, comfort, convenience,
order of the town would be adversely affected by this accessory use. This accessory use is subject
to further review by the Building Department under the New York State Fire and Building Codes
(which is not in the jurisdiction of the Board of Appeals).
5) This accessory use is an authorized zoning use which is subject to a Special Exception review
and approval by the Board of Appeals and a Certificate for Occupancy from the Building Inspector

for other safety and health regulations.
6) No adverse conditions were found after considering items listed under Section 100-263 and
100-264 of the Zoning Code.
BOARD ACTION/RESOLUTION:
On motion by Chairman Goehringer, seconded by Member Horning, it was
RESOLVED, to GRANT the application as applied for, and SUBJECT TO THE
FOLLOWING CONDITIONS:
1. Applicants-owners must supply at least two (2) additional on site parking spaces
either in existing driveway leading from house/garage to paved street areas, in addition to the two
spaces required by the code for the current single-family residence.
2. No backing out of vehicles onto public road
3. Applicant owner must obtain a certificate for compliance as a new accessory Bed
and Breakfast use in residence.
4. No external noise shall be created by use of the Bed and Breakfast after 10:00 p.m.
each evening as well as the discharge of persons via automobiles associated with guest use not
later than 10:30 p.m. under this permit.
5. The Board reserves the right for the first six months of said permit to review the parking
plan. The Board, if it deems necessary, request parking on site by one additional vehicle. This task is
to be reviewed by the Chairperson and one member designated by the Chairperson.
6. A chain rope ladder shall be placed for upstairs bedroom areas as an extra measure for
fire escape.

NOTICE IS HEREBY GIVEN, pursuant to Section 267 of the Town Law and Chapter
100 (Zoning), Code of the Town of Southold, the following application will be heard at
public hearing by the SOUTHOLD TOWN BOARD OF APPEALS at the Town Hall, 53095
Main Road, Southold, New York 11971, on THURSDAY, DECEMBER 13, 2001, at the time
noted below (or as soon thereafter as possible):
6:35 p.m. Appl. No. 5037 — KEVIN and KATHERINE LEAVAY. Applicant-Owner is

two Zoning Board positions were filled by new individuals, Members Ruth Oliva and Vincent
Orlando (filling the positions held by Lora S. Collins and James Dinizio, Jr.).
Before a vote of the Board may take place and a determination rendered on this
application, the two new members will be conducting full reviews of the record and
familiarizing themselves with the property and areas under consideration.

Dear Mr. Goehringer:
Re: Application of Kathy and Kevin Leavay -
I was present at the Dec. 13 meeting at which the Leavays' neighbors voiced their
objections to having a bed-and-breakfast home in their neighborhood. I understand
their fears and objections, but I think it is important that they, and the board, lmow
more about the Leavays.
First, they conduct themselves at all times in the highest standards. They would not
want a loud, unkempt, disorganized lifestyle and they would not tolerate that sort of
behavior from any patrons of their B&B.
Secondly, when the neighbors know more about the Leavays,they will bless the day
the Leavays moved into the neighborhood. The Leavays have been residents of
Southold for some 20 years and Kevin has been a teacher in the Southold school
district for that time. He is well respected by the school staff and parents. Before
coming to Southold, Kevin was an officer in the United States Army, stationed in
Germany. His father, also a resident of Southold, is a retired firefighter and served in
the Army Air Corps.
Kathy Leavay has a degree in education, but has chosen to stay at home to be a
homemaker and full-time mother. She and her husband are both hard-working
people. Over the years, both have done volunteer work for St. Patrick Church in
Southold and for the school district.
Third, the Leavays are very loving, caring people. At times when their neighbors have
been affected by illness or misfortune,they have been quick, in their quiet way,to
provide food,time and support. I consider them true angels on earth. They are joyful,
hopeful and very kind people They forgive and accept everyone.

Fourth, the Leavays are very respectful of living near holy ground,the cemetery
behind their house. They are familiar with cemeteries, having lost several of their
closest relatives over the years. Most recently, Kathy has lost a brother and a sister to
illness. She remains strong in her faith and filled with love for all. She is a role model
for everyone.
Finally, I would like to express my regret that some of the Leavays' neighbors have
chosen to put a cloud over the Leavays' entrance into the neighborhood. I am sure
that they will find that the Leavays are top-quality people and that their small and
modest B&B will also be a top-quality operation.

When my husband Rich and I went looking for a neighborhood that we could
call home, we had certain criteria. In the 70's and 80's I very often worked on
the North Fork as a high school sports official. I took note of what a beautiful
and tranquil place the Township of Southold was. After two (2) years of
searching, investigating, talking to neighbors, visiting town hall to find out the
history and flavor of different neighborhoods, we decided upon Grigonis Path
in Southold Village. That was seven (7) years ago. Other neighbors have been
in this small enclave for 20 or more years. Some have just moved in and built
their retirement home, others fixed up existing homes enabling their children
to have a traffic-free environment to play in. A vast majority of the neighbors
do not want a B&B in this enclave as shown by our petition. Should we have
NO say as to what develops into our neighborhood.
Rich and I are not opposed to B&B's in general, we don't want to make this
personal. It is not what it is, it is where it is. This is a small lot with a large
house making their house and parking facilities closer to the street than others
on the block. But this is where the Leavays have decided to locate their dream
as stated by Mr. Leavay at the meeting. As my husband stated at the same
meeting, it was seven years ago and is still our dream to live here on Grigonis
Path. Why should our dream be infringed upon?
A few points I would like to make about the meeting and this situation:
• I was the only petitioner who canvassed the Calves Neck area. I did not
coerce or use scare tactics on anyone. I take great exception to the
accusation that Mrs. Wassmer made at the meeting. I would not
respond at the meeting and give credence to such a falsification of the
truth. Was this meeting a place for personal confrontations? Should
that have been allowed to even happen? Friends of the Leavays who
spoke at the meeting are irrelevant to this situation. They don't live
near the Leavay's dwelling.
• It also disturbed me that the chairman gave his clarification of the law
about B&B's before we even started. Is that always done? I felt it gave a
tone to the hearing that the board's minds were made up about this
special exemption. It made the neighbors feel that anything they would
say would be irrelevant. Is that not why we came before this board so

you could hear our concerns and rule with all the facts pertaining to this
specific situation? Am I misinterpreting the scope of the board of
appeals?
• We know what happened to us concerning the sale of our home. The
fact is the value of our home will go down because of a business venture
directly next door to us. It was demonstrated to us over and over when
we attempted to sell our home. It was our experience that no one would
purchase our home when they found out that there would be a B&B next
door. -
• Harper Road West goes into.Grigonis Path very sharply. As a matter of
fact we had drivers `cruising down Harper Rd. West wind up in our
driveway because they did not realize the road bends so sharply.
• The Leavay's have been building their house for nearly two (2) years.
They never came to us or to the other immediate neighbors to express
their desire to build a B&B or even introduce themselves. The
immediate neighbors found out about this venture from others. They
have kept their distance.
• We are extremely concerned about the parking situation because of the
close proximity of they house and driveway to the street. There is NO
buffer for the immediate neighbors in regard to the parking of transient
vehicles of all sizes. When cars were parked on the west side of their,
house in the street, it would block our driveway.
• The issue of a sign was not even brought up at the meeting. Would size
be the only issue again?
When the B&B law was introduced in 1989 (according to Ms. Collins) the North
Fork was a virtually undiscovered tourist destination: Almost 12 years have
passed and we all know how,that status has undergone a tremendous change.
We are the "discovered" fork now. That is why more real estate agencies have
moved to this fork. They know of the explosion of people wanting a quiet
place to live, -even as a second home. There must be provisions and
limitations for B&B's to establish themselves in a given area not just if they
meet a building code. What defines a neighborhood is not just about size.
In closing, does this mean that at anytime anyone can open a B&B in any
existing home or build a house on the few pieces of vacant properties that are
left in our neighborhood with no regard to the already established residents or
to property codicils that are in effect? How do we protect our rights. How do
we preserve our way of life?

two Zoning Board positions were filled by new individuals, Members Ruth Oliva and Vincent
Orlando (filling the positions held by Lora S. Collins and James Dinizio, Jr.).

application, the two new members will be conducting full reviews of the record and
familiarizing themselves with the property and areas under consideration.
