No. 5077—THEODORE and ANGELA LAOUDIS County Tax Map Parcel No. 70-13-20.35 (20.21 &20.32 combined) Property Location: 405 Kimberly Lane, Southold(Lot 3, Map of Paradise by the Bay) BASIS OF APPLICATION: Building Department's January 4, 2002, amended January 16, 2002, Notice of Disapproval under Sections 100-30A.3 and 100-230C.3 due to insufficient side setbacks and yard location for the accessory building and walkway structures, height of accessory building over 18 feet, and lot coverage in excess of the 20% code limitation for above-grade structures (excluding certain steps and uncovered walks, patios, driveway, and the like). Section 100-30A.3, Bulk Schedule, requires a side yard minimum of 15 feet, and minimum of 35 feet total for both side yards for a conforming parcel in an R-40 Low-Density Residential Zone District. AREA VARIANCES REQUESTED: Requested are a proposed covered walkway structure and covered stone path structure which do not meet the minimum 15 ft. side yard setback from the property line, and additions/alterations to an existing accessory non-habitable pool house structure which will not meet the height limitation of 18 feet as applied for and with a side yard location, and tennis court structure at 1.6 ft. from the side lot line at its closest point, and for all buildings and structures, a proposed lot coverage in excess of 20% of total lot size as shown on the plans. The total covered area of the lot, shown on Map AO- 2B prepared by Bohn Associates, Inc., including covered patios and walkways, an accessory 24' x 507' garage, and 30.3 x 18.3 ft. accessory building near the pool is 14,113 sq. ft. is proposed. This parcel (Lot 3) and the adjacent parcel (Lot 4) are presently used by the same family. Note: The applicant has agreed to remove the covered walkway which will overlap the property line in the event the properties are to be sold independently in the future and the future purchaser desires to maintain separate uses of the two residential parcels. (For extensive details please see plans on file with the ZBA prepared by Bohn Associates, Inc. Drawings AO-2 dated 3/14/02, AO-2B dated 4/18/02, and survey prepared by Joseph A. Ingegno, L.S. last dated 12/12/01). FINDINGS OF FACT The Zoning Board of Appeals held public hearings on this application on March 21, 2002 and April 18, 2002, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION. The applicant's property is located on the easterly side of Kimberly Lane in Southold and consists of a total land area of 48,360.57 sq. ft. and lot width of 188.28 feet. The total above- grade covered area of the lot is more particularly detailed as shown on the Maps AO-2 and AO-213 prepared Page 2—May 2,2002 ZBA Appl.No 5077.—T and A Laoudis Parcel 70-13-20 35(20.31,20.32 combined)at Southold by Bohn Associates, Inc This lot is improved with the following structures, cabana, tennis court, and swimming pool. ADDITIONAL INFORMATION. At the time of the site visit, work activities at both north wings of the dwelling on Lot 4 started (after leveling the old rock foundation of the dwelling), with placement of the new partial foundation. New and existing, uncovered patio areas and landscaped areas in front of the dwelling were also started (see plans on file). No construction was commenced on site improvement for the proposed new garage building, and no site improvements were started for the covered walkway. REASONS FOR BOARD ACTION: In accordance with the review standards set forth in Town Law 267b-3 (area variances), the Board has considered the benefit to the applicant if the variance is granted, as weighed against any detriment to the health, safety and welfare of the neighborhood and community by such grant, and determines that: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. Applicants are reconstructing the existing large, two-story home as well as other improvements, and all improvements are within keeping of the neighborhood. The surrounding dwellings are comparable in size and stature, and this structure will have no undesirable effect on the neighborhood. Applicants prefers to conform to the code by keeping the two parcels as separate lots, providing for one residence on each of the two lots, for a total of two dwellings on 3+acres. (If the lots were merged, the minimum side setbacks to the present dividing lot, and the lot coverage relief, would no longer be necessary, however, the applicant would only be able to have one dwelling on 3+- acres (both 20.35 and 20.04 if combined as one lot). 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Since the adjoining lot is also owned by the applicant, the side yard encroachment created by the covered stone walk and overhang of the north wing of the main house can only be addressed by an area variance with conditions and restrictions related to both properties. 3. The variance granted herein is substantial due to the extensive nature of the improvements. 4 The difficulty has been self-created. The swimming pool and tennis court are the major lot coverage areas, as compared to the size of the other proposed covered structures. 5. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. 6. Grant of the requested variance is the minimum action necessary and adequate to enable applicant to enjoy the benefit of a roof overhang, covered walks and other structures, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. Existing residence is being renovated, the existing eves/roof overhang extend 4 . 2 feet over the foundation (setback of structure) which is located at 13 . 1 feet from the southerly property line . The proposed foundation remains the same, the new roof line is overhanging 3 ' 6" so the encroachment will be less than the exiting setback. The existing residence will be connected to the adjacent residence with garage by a covered walkway. The covered walkway runs to the property line and continues on the adjacent property (also the subject of a variance for the covered walkway) resulting in a 11 0" lot line 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance . The covered walkway will connect the house with the garage, this walkway could be removed in the event that a purchaser to either the lot or the house wished to disconnect the structures . The two properties have been used as one parcel, however, the owners have not wished to combine the parcels in order to retain their value . The lot would be prevented from constructing a residence which is not desired by the applicant . i ' t r 5D-7 T 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The setback for a minor structure (covered walkway) if it were not covered could encroach up to 4 feet from the property line pursuant to Article XXIII, sec 100-230 C. 3 . , adding a roof and attaching it to the house and garage requires principal setbacks . The code does not provide for unique circumstances which are presented in this application. The Zoning Board is the only avenue of relief . 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . 5 . The alleged difficulty was not self-created. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant .
