BASIS OF APPLICATION: Building Department's January 4, 2002 Notice of Disapproval under Sections 100-30A.3 and 100-230C.3 due to insufficient side setbacks of a walkway structure, roof overhang of a covered path structure(s), and roof overhang of the dwelling at greater than two feet into the side yard on the northern end of the property, instead of the code requirement of 15 feet minimum on one side. AREA VARIANCES REQUESTED: Requested are replacement of the dwelling, with enlargement, covered walkway structure, roof overhang of covered stone path structures, and roof overhang of the dwelling, all of which do not meet the minimum 15 ft. setback, and total 35 ft. side yards, from the side property line. Details related to the location and sizes of these structures are more particularly shown on the survey for Lot 4, Map of Paradise by the Bay, prepared by Joseph A. Ingegno, L.S. dated November 17, 2000, revised 12/12/01, and Maps AO-2 and AO-2B prepared by Bohn Associates. The applicant has agreed to remove the covered walkway which overlaps the property line in the event the properties were sold independently, and a purchaser desired to separate the use of the two parcels. The two parcels are presently used the same family. FINDINGS OF FACT The Zoning Board of Appeals held public hearings on this application on March 21, 2002 and April 18, 2002, at which time written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION: The applicant's property is located on the easterly side of Kimberly Lane in Southold and consists of a total land area of 87,938.03 sq. ft. and a width of 227.34 feet. The total above- grade covered area of the lot is shown on Map AO-2B prepared by Bohn Associates, Inc. The property is improved with a single-family dwelling. ADDITIONAL INFORMATION: At the time of the site visit, activities at both north wings of the dwelling started (after leveling the old rock foundation of the dwelling), with placement of the new partial foundation. New and existing, uncovered patio areas and landscaped areas in front of the dwelling were started (referred to on the plans submitted). REASONS FOR BOARD ACTION- In accordance with the review standards set forth in Town Law 267b-3 (area variances), the Board has considered the benefit to the applicant if the variance is granted, as weighed Page 2—May 2,2002 ZBA Appl.No 5078—T and A.Laoudis Parcel 70-13-20.04 at Southold against any detriment to the health, safety and welfare of the neighborhood and community by such grant, and determines that: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. Applicant is reconstructing the existing large, two-story home as well as other improvements, and all improvements are within keeping of the neighborhood. The surrounding dwellings are comparable in overall square footage and stature, and this structure will have no undesirable effect on the neighborhood. The applicant prefers to conform to the code by keeping the two parcels as separate lots in order to provide for one dwelling use on each of the two lots, for a total of two dwellings on 3+ acres. (If the lots were merged, the minimum side setbacks to the present dividing lot, and the lot coverage relief, would no longer be necessary, however, the applicant would only be able to have one dwelling on 3+- acres (both 20.35 and 20.04 if combined as one lot). 2. The benefit sought by the applicant cannot be achieved by some method, feasible for the applicant to pursue, other than an area variance. Since the adjoining lot is also owned by the applicant, the side yard encroachment created by the proposed covered stone walk and overhang of the north wing of the main house can only be addressed by an area variance with conditions and restrictions related to both properties. 3. The variance granted herein is substantial due to the extensive nature of the improvements. 4. The difficulty has been self-created. 5.The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. 6. Grant of the requested variance is the minimum action necessary and adequate to enable applicant to enjoy the benefit of a new dwelling with covered walkways and related structures, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. BOARD RESOLUTION ACTION OF THE BOARD: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Orlando, seconded by Member Tortora, and duly carried, to CONDITIONAL GRANT of the requested area variances, SUBJECT TO the following covenants, conditions, and restrictions related to both lots (20.04 and 20.35) owned by the applicants: 1) In the event the owners (applicants) of either/both parcels 20.204 and 20.35 decide to convey either lot, structures within the code restricted area, 15 feet of the side property line, must be removed or cut back, to meet this minimum 15 ft. side yard setback. A survey of the property, dated December 12, 2001, by Joseph A. Ingegno, notes a single yard setback of zero (0') feet, based on the construction of a covered walkway, attaching the proposed dwelling to an existing single family dwelling located on the adjacent parcel. In addition, the plans note a total lot coverage of 38.04 percent, a 12.76 percent increase over the existing non-conforming lot coverage of 25.28 percent. The construction of the new dwelling will relocate the existing pool house and tennis court into the side yard. In addition,planned alterations to the existing accessory pool house note a new building height of+/- 23 feet. Moore PCM/mr Encls . s 1(_ Reason for Appeal Continued Zoning Board of Appeals re : Laoudis (Lot) Pursuant to Town Law section 267b-3 the Southold Town Zoning Board of Appeals is to analyze and assess the personal benefits anticipated by the applicant against the potentially deleterious effects that a grant of the relief requested would have on the health, safety and welfare of the effected neighborhood or community. In performing this balancing test, the Zoning Board is charged with the responsibility to consider the five factors enumerated in Town Law Section 267b-3 (b) . The variance should be granted for the following reasons : 1 . No undesirable change will be produced in the character of the neighborhood or a detriment to nearby properties, if the variance is granted. Premises contains existing tennis court and pool used by adjacent residence. ZBA granted relief for a tennis Court and fence (Appeal 2313 dated August 4, 1977) , the pool was constructed prior to subdivision of the parcels . A house with garage is proposed on the subject parcel making the accessory structures conforming. The addition of the house and garage increases the lot coverage accordingly. The construction of a covered walk will connect the house and garage to the neighboring residence . The two properties, subject premises, and adjacent parcel have always been used by the owners as one property. The covered walkway could be removed in the event that the properties were sold independently and the purchaser desired to separate the use of the two parcels . 2 . The benefit sought by the applicant can not be achieved by some method, feasible for the applicant to pursue, other than an area variance. The property is a very valuable one acre parcel on the water, if the properties were merged the owner could construct the covered walkway but would be prevented from constructing a second residence on the property. The need for variances would not be eliminated: tennis court and pool would need the side yard variance from the adjacent residence, as well as other variances may be required with regard to lot coverage . 3 . The area variance is not substantial The application of the balancing test weighs in favor of the grant of the variance. The properties have been used as one parcel since the date of the subdivision. The property is being remodeled, the patios are being redone, the pool house which is presently a height of 19 . 5 ' is being renovated, the only new structures are the house and the covered walkway which connects the structures . 4 . The variance will have no adverse effect or impact on the physical or environmental conditions in the neighborhood or district . The property is very large and has been developed, no adverse affect will be made to the physical or environmental conditions . 5 . The alleged difficulty was not self-created. 6 . The variance requested is the minimum variance practicable given the personal benefits anticipated by the applicant . No. 5150—Theodore and Angela Laoudis Property Location: 635 Kimberly Lane,Southold 1000-70-13-20.4 SEORA DETERMINATION: The Zoning Board of Appeals has visited the property under consideration in this application and determines that this review falls under the Type II category of the State's List of Actions, without an adverse effect on the environment if the project is implemented as planned. PROPERTY DESCRIPTION: The applicant's property_is located on the easterly side of Kimberly Lane in Southold, and consists of a total land area of 87,938 sq. ft. and width of 227.34 feet. The property is improved with a single-family dwelling. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on August 22, 2002, September 5, 2002, October 3, 2002, and November 14, 2002, at which times written and oral evidence were presented. Based upon all testimony, documentation, personal inspection of the property, and other evidence, the Zoning Board finds the following facts to be true and relevant: BASIS OF APPLICATION: Building Department's April 22, 2002, amended April 30, 2002, Notice of Disapproval denying a permit for a stone wall, entry gate, pillars and sculpture with varying heights that exceed the four-foot height limit set forth in Article XXIII, Section 100- 231. AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance authorizing a stone wall, entry gate, pillars and sculpture with varying heights from 5`6" at the lowest point, to 16'+- at the highest point. REASONS FOR BOARD ACTION: On the basis of testimony presented, materials submitted and personal inspections,the Board makes the following findings: 1. Applicants wish to replace an existing wood fence and gate with a larger and more decorative entry gate, pillars stone wall, and sculptures near the front property line of the residence on Kimberly Lane. Applicants request the additional height of the entry gate to accommodate design features that are unique to the architectural style of the residence. The added wall height, applicant's attorney testified, would provide privacy for the residence and would also create a buffer between the residence and neighbors and vehicles that stop to view the residence. Several neighbors, who live near the property opposed the entry gate because they maintained that it would be highly visible from their houses, and become a viewing attraction that would increase traffic and present safety problems. 3. On November 14, 2002, an amended detailed elevation drawing of the project was submitted to scale down the proposal. A description of the amended plan was articulated in a November 19, 2002 letter by applicant's attorney. 4. The board finds that the requested height variances in the amended plan are still quite substantial, 60% above the maximum permissible(total height of pillars with sculptures). 5. The board is unaware of any other entry gates and pillars with sculptures, or any other gate-type structures, in the neighborhood that are 10 feet high. Therefore, the proposed project would not be in character with the neighborhood, and could have a negative physical impact on nearby properties by attracting increased traffic. 6. The action set forth below will enable the applicant to construct a wall and entry gates that will afford privacy for the residence. The board concludes that this action will not produce an undesirable change in the character of the neighborhood or be a detriment to nearby properties. 7. The action set forth below is the minimum necessary to enable the applicant to construct a wall and entry gate on the subject lot while preserving and protecting the character of the neighborhood and the health, safety and welfare of the community. BOARD RESOLUTION: NOW, THEREFORE, on motion by Member Tortora, seconded by, Member Oliva,it was RESOLVED, to DENY the variance applied for, and alternately to GRANT a variance authorizing the following height limitations for the plans submitted November 14, 2002 (plans entitled, "Gate Elevation"): 1.
