FINDINGS, DELIBERATIONS AND DETERMINATION
MEETING OF MARCH 28, 2002
Appl. No. 5104— MARTIN KOSMYNKA Parcel: 98.-1-11.2.
BASIS OF APPEAL: Building Department's Notice of Disapproval dated February 20,
2002, denying a permit for an addition with in-ground swimming pool, for the reason that
Section 100-244B of the Zoning Code requires a setback of 10 feet on one side yard and
15 feet on the other side yard, for a minimum total side yard area of 25 feet.
AREA VARIANCE REQUESTED: Applicant wishes to construct a new swimming pool
attached to the dwelling with a setback of three feet on the west side of the house
instead of the code requirements. The total side yards are proposed at seven feet.
- FINDINGS OF FACT
The Zoning Board of Appeals held a public hearing on this application on March 21,
2002, at which time written and oral evidence was presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning
Board finds the following facts to be true and relevant:
PROPERTY FACTS: Applicant's property contains 16,306 sq. ft. in area and is located
on the easterly side (House #1985) Pine Tree Road in Cutchogue. The property is
improved with a single-family dwelling and structures as shown on the survey prepared
by Kenneth H. Beckman, revised January 11, 2002.
REASONS FOR BOARD ACTION: IN ACCORDANCE WITH THE REVIEW
STANDARDS SET FORTH IN TOWN LAW 267B-3 "AREA'VARIANCES," THE BOARD
HAS CONSIDERED THE BENEFIT TO THE APPLICANT IF THE VARIANCE IS
GRANTED, AS WEIGHED AGAINST THE DETRIMENT TO THE HEALTH, SAFETY
AND WELFARE OF THE NEIGHBORHOOD AND COMMUNITY BY SUCH GRANT,
AND DETERMINES THAT:
1. Grant of the area variance as requested will produce an undesirable change in the
character of the neighborhood or detriment to nearby properties. The proposed addition
would extend toward the adjacent lot leaving a setback of three feet.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for
the applicant to pursue, other than an area variance, because the applicant desires a
pool area due to the medical need requiring constant physical activity.

3. The variance requested is substantial and represents a seven-foot reduction in the
code requirement of 10 feet, and total reduction of a combined side yard setbacks.
4. The variance granted will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district. No evidence has been
submitted to suggest that this variance will have an adverse impact on physical or
environmental conditions in the neighborhood. The applicant has agreed to accept
alternative relief with conditions.
5. Grant of the requested variance is the minimum action necessary and adequate to
enable applicant to enjoy the benefit of a swimming pool attached to the dwelling, while
preserving and protecting the character of the neighborhood and the health, safety, and
welfare of the community.
BOARD RESOLUTION ACTION OF THE BOARD: In considering all of the above
factors, and applying the balancing test under New York Town Law, motion was offered
by Member Orlando, seconded by Chairman Goehringer, and duly carried, to:
DENY the application as applied for, and GRANT alternative relief for setbacks
from the easterly side property line at six (6) feet at its closest point and nine (+1-)
feet at the opposite point, SUBJECT to the following CONDITION:
That the walkway, if placed, shall be located only on the south side and extended
from front to rear.
This action does not authorize or condone any current or future use, setback or other
feature of the subject property that violates the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
Vote of the Board: Ayes: Members Goehringer (Chairman), Tortora, Oliva, and
Orlando. (Member Horning of Fishers Island was absent as authorized.) This
Resolution was duly adopted (4-0).

Chapter 100 (Zoning), Code of the Town of Southold, the following
applications will be heard at a public hearing by the SOUTHOLD TOWN
BOARD OF APPEALS at the Town Hall, 53095 Main Road, Southold, New
York 11971, on THURSDAY, MARCH 21, 2002, at the times noted below (or
as soon thereafter as possible):

under Zoning Code Section 100-244B based on the Building Department's
February 20, 2002 Notice of Disapproval of a building permit application to locate
an addition with inground swimming pool, all located at less than the code
requirement of 10 feet on one side and 15 feet on the remaining side, and less
than 25 feet for total combined side yards. Location of Property: 1985 Pine Tree
Road, Cutchoque; Parcel 1000-98-1-11.2.

MEETING OF MARCH 28, 2002
Appl. No. 5104— MARTIN KOSMYNKA Parcel: 98.-1-11.2.
BASIS OF APPEAL: Building Department's Notice of Disapproval dated February 20,
2002, denying a permit for an addition with in-ground swimming pool, for the reason that
Section 100-244B of the Zoning Code requires a setback of 10 feet on one side yard and
15 feet on the other side yard, for a minimum total side yard area of 25 feet.
AREA VARIANCE REQUESTED: Applicant wishes to construct a new swimming pool
attached to the dwelling with a setback of three feet on the west side of the house
instead of the code requirements. The total side yards are proposed at seven feet.
FINDINGS,OF FACT
The Zoning Board of Appeals held a public hearing on this application on March 21,
2002, at which time written and oral evidence was presented. Based upon all testimony,
documentation, personal inspection of the property, and other evidence, the Zoning
Board finds the following facts to be true and relevant:
PROPERTY FACTS. Applicant's property contains 16,306 sq. ft. in area and is located
on the easterly side (House #1985) Pine Tree Road in Cutchogue. The property is
improved with a single-family dwelling and structures as shown on the survey prepared
by Kenneth H. Beckman, revised January 11, 2002.
REASONS FOR BOARD ACTION: IN ACCORDANCE WITH THE REVIEW
STANDARDS SET FORTH IN TOWN LAW 267B-3 "AREA VARIANCES," THE BOARD
HAS CONSIDERED THE BENEFIT TO THE APPLICANT IF THE VARIANCE IS
GRANTED, AS WEIGHED AGAINST THE DETRIMENT TO THE HEALTH, SAFETY
AND WELFARE OF THE NEIGHBORHOOD AND COMMUNITY BY SUCH GRANT,
AND DETERMINES THAT:
1. Grant of the area variance as requested will produce an undesirable change in the
character of the neighborhood or detriment to nearby properties. The proposed addition
would extend toward the adjacent lot leaving a setback of three feet.
2. The benefit sought by the applicant cannot be achieved by some method, feasible for
the applicant to pursue, other than an area variance, because the applicant desires a
pool area due to the medical need requiring constant physical activity.

3. The variance requested is substantial and represents a seven-foot reduction in the
code requirement of 10 feet, and total reduction of a combined side yard setbacks.
4. The variance granted will not have an adverse effect or impact on the physical or
environmental conditions in the neighborhood or district. No evidence has been
submitted to suggest that this variance will have an adverse impact on physical or
environmental conditions in the neighborhood. The applicant has agreed to accept
alternative relief with conditions.
5. Grant of the requested variance is the minimum action necessary and adequate to
enable applicant to enjoy the benefit of a swimming pool attached to the dwelling, while
preserving and protecting the character of the neighborhood and the health, safety, and
welfare of the community.
BOARD RESOLUTION ACTION OF THE BOARD: In considering all of the above
factors, and applying the balancing test under New York Town Law, motion was offered
by Member Orlando, seconded by Chairman Goehringer, and duly carried, to:
DENY the application as applied for, and GRANT alternative relief for setbacks
from the easterly side property line at six (6) feet at its closest point and nine (+1-)
feet at the opposite point, SUBJECT to the following CONDITION:
That the walkway, if placed, shall be located only on the south side and extended
from front to rear.
This action does not authorize or condone any current or future use, setback or other
feature of the subject property that violates the Zoning Code, other than such uses,
setbacks and other features as are expressly addressed in this action.
Vote- of the Board: Ayes: Members Goehringer (Chairman), Tortora, Oliva, and
Orlando. (Member Horning of Fishers Island was absent as authorized.) This
Resolution was duly adopted (4-0).

Dear Chairman and members of the zoning board of appeals:
I am writing to address some of the questions I did not understand at last
night's hearing.The board had asked me if I could move the addition(room)toward
the back of my house so that the sideyard setback would be greater than three feet.
Enclosed please find a new set of plans that show the building being shifted
approximately 8 feet towards the back of my house,which is now even with the
handicapped ramps.The width of the room is now smaller by approximately 2 feet.
As the board had suggested,I was able to gain 6 feet from the closest point to the
sideyard. The sideyard increases to 9 feet as the building moves towards the back of
my house.I hope this new plan addresses some of your concerns. The first set of
plans that you were shown were drawn as per the Board of Trustees suggestion. The
building ended evenly with the deck of my house.

Dear Sir,
This is a letter of medical necessity for Martin Kosmynka to have an indoor lap pool.
Aquatic therapy would positively impact in his reaching and maintaining his maximum
physical potential. His independent mobility is limited to trunk and upper extremity use
secondary to a spinal cord injury that is permanent. The ability to exercise his body in
water on a regular basis could be key to his survival, as swimming exercises his heart and
lungs as no other exercise that he is capable of performing could. It would allow him to
remain a productive taxpayer and member of society.

Dear Members of the Board:
I am the owner of the property adjoining 1985 Pine Tree Road and am writing to
state that I do not approve of the granting of a variance for the construction of the
planned addition to the Kosmynka house. Circumstances will not permit me to attend the
public hearing and I would appreciate your consideration of my views that are
summarized in this short letter.
Despite my intentions to try to be a supportive and accommodating to Marty's
needs, I cannot accept the plain fact that this addition will be barely three feet from the
property line. The structure already encroaches on both side yard requirements to a
substantial degree and I feel that it would be unfair to permit the construction of a
swimming pool just a few feet from my home.

To Whom It May Concern:
This letter is written in reference to the proposal for the construction of an
indoor lap pool addition to the home of Martin Kosmynka on Pine Tree Road in
Cutchogue. As you may know Mr. Kosmynka has a heart condition and is paralyzed
from the waste down. Every day he must overcome many hardships, which we, easily
mobile and transportable persons,take for, granted. Simple movable acts such as
"getting out of bed" each morning requires patience, time and extreme physical
concentration. These feats are not only physically taxing but mentally also. His request
for a small addition surrounding a pool, in which to aid blood circulation and slow down
the muscle degeneration in his legs is very important to his well-being. Any opposing
Feedback should be considered insignificant in light of the reality of the situation-
he is a victim of an unfortunate physical handicap.
A small addition, although close to the property line, shielded with the correct
vegetation, will have minimal impact of both the environment and the neighborhood.
His home is presently one of the more aesthetically pleasing and well maintained
homes in our neighbothood.

It is my understanding that the Southold Town Board of Appeals will hear an appeal by Martin Kosmynka
on March 21,2002 for a variance under Zoning Code Section 100-244B. It is further my understanding that Martin
Kosmynka seeks to build an addition including a swimming pool on his property which requires a variance granted
by the Southold Board of Appeals.
My wife and I are contiguous property owners with the Kosmynka property at 1935 Pine Tree Road. Martin
Kosmynka's development of his property has at all times conformed with and been in the best interest of the
property and the residents of Nassau Farms. It is my belief that the Kosmynka home and the manner in which
Martin and Christina maintain their property improves the community and increases the value of all the property
in the area. It is my firm belief that any additional construction performed by the Kosmynka's will, likewise,be a
positive addition to the community.
My wife and I have known the Kosmynkas for approximately ten years. They are two of the most wonderful
people we know. I think it is important for the Town Board to also consider that this addition is needed by Martin
Kosmynka to maintain his health and the quality of his life. We strongly urge the Board to grant the variance
requested by Martin Kosmynka.

Friends,
We wish to register our objection to the granting of the side yard variance
sought in App1. No. 5104. The under-sized lot (7/16 of the required size
under current zoning) is already cluttered to the point that a fire-rescue
vehicle might not be able to get around the house if necessary, which could
be a risk not only for that property and its occupants but for others in the
neighborhood as well. In addition, that a gasoline fueled boat is moored
behind the house raises an even greater question concerning fire-rescue
access.
These issues bring into question the proposed location of the pool when
there are other places on the property where it could be built.

Sirs:
It has come to our attention that our neighbor,Martin Kosmynka, has filed a request for a
variance to allow him to add an extension to the side off his house for a small, completely
enclosed pool designed specifically as an exercise pool.
Mr. Kosmynka suffered an unfortunate accident several years ago resulting in a severed
spinal cord. This has left him a paraplegic confined to a wheelchair. He is convinced that
medical knowledge will progress to the point that people with spinal cord injuries will once
again regain the use of their limbs. His task is to keep himself in excellent physical shape so
,,. that when the call goes out for volunteers to take part in an experimental treatment
.d$s program, he will be first on the list. To achieve this, he can be seen almost every day,
weather permitting, on his hand driven quadricycle zipping around the neighborhood. (Did
you know that he participated in and completed the New York City Marathon as a
wheelchair entry?) In warmer weather he is out in Little Creek rowing in his skiff. The
addition of an exercise pool will enable him to continue his exercise regimen year round
and in inclement weather
We have absolutely no objection to the ZBA granting Mr. Kosmynka a variance for the
addition of this extension. It is our opinion that, for health reasons, this is "a good thing".

FINDINGS OF FACT
• PROPERTY FACTS/DESCRIPTION:
This property is located in an R-40 Low-Density Residential Zone
District, being situate on the easterly/northeasterly side of Pine
• Tree• Road, Cutchogue. This lot contains a total area of 16,306 sq.
ft. as depicted on the survey map last dated 7/17/91. The survey
shows' the following improvements: two-story frame house and
in-ground drainage basin located within stone blend driveway,
cesspool and water well locations.
BASIS OF APPEAL: Building Inspector's Action of Disapproval dated
January 17, 1995, updated December •6, 1995, which reads as
follows: "under Article III-A, Section 100-30A.4, property
construction of accessory garage will have insufficient front -
setback. R.40 Zone, nonconforming lot size under 20,000 sq. ft.
requires 35 ft. front yard setback and 3 ft. side yard setback."'
AREA VARIANCE RELIEF REQUESTED BY APPLICANT: To locate
proposed accessory garage 24 ft. by 24 ft. in size with a three ft.
setback from the side property line and 19 feet from the front
property line at its closest points. Height is proposed to 'conform
• with zoning code for'aceessory buildings.
REASONS FOR BOARD ACTION, DESCRIBED BELOW:
Section 100-33C of the Zoning Code provides for a front yard
location of accessory buildings, provided they meet the principal
setback froth the front property line. (35 feet in this instance).
The difficulties in locating the accessory building at 35 feet are
due to an existing under-ground drainage basin which is necessary
in retain ground water run-off and drainage, due to the existing
septic pool. locations, and narrowness of the lot in the front yard.

There is no area available in the rear yard due to the restricted
buffers, wetlands, and adjacent areas to wetlands.
The opposite side to the south is landscaped with arborvitaes and
other established plantings.
•
(1) -The granting of the area variance as applied would produce an
undesirable change in character of neighborhood or a detriment to
nearby properties because there are no other parcels in the _
immediate area on the same side of applicant's improved premises that
have accessory garages in the front yard area.
(2) The benefit sought, as originally requested by the applicant,
can be achieved by some method, feasible for applicant to pursue -
such as the alternative location noted below - as the minimum
necessary.
(3) The relief requested is substantial with a setback at 19 feet,
consisting of 54% of a variance,from the 35 feet setback requirement.
(4) The proposed variance will have an adverse effect or impact on
the physical or environmental conditions in the neighborhood or
district because the building can be moved with a greater setback.
(5) The situation has not been self-created and is related to the
layout of the property.
(6) This action is the minimum that the Board deems necessary and
adequate and at the same time preserves and protects the character
of the neighborhood, and the health, safety, welfare of the
community.
RESOLUTION/ACTION: On motion by Chairman Goehringer,
seconded by Member Tortora, it was .
RESOLVED, to DENY the relief requested for a 19 ft. front yard
setback; and BE IT FURTHER
RESOLVED, to GRANT alternative relief, subject to the following
CONDITIONS:
1. The building shall be setback at 25 feet (closest point) from the
front property line and five (5) feet from the side property line to
the north.
2. Plantings of three to five ft. high evergreens shall be planted
and continuously maintained, separated 5 ft. to 6 ft. apart along the
side of garage facing front property line.

4. Accessory . building (garage) shall contain only utility, of
