No. 5085 -John & Cynthia Kitsner Parcel: 110-2-9 STREET& LOCALITY: 300 Holden Avenue, Cutchogue DATE OF PUBLIC HEARING: April 18, 2002 BASIS OF APPLICATION: Building Department's November 20, 2001 Notice of Disapproval citing Section 100-33, for the reason that the accessory building in not located in the required rear yard area, AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance for the location of the 14.6' x 11.6' accessory building located, in part, in the easterly front yard, north of the dwelling, at 64+- feet from the north property line. Part of the shed is located in a yard which may be designated a rear or a side yard on this corner lot. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 18, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY FACTS/DESCRIPTION: Applicant's property is a 34,063 sq. ft. parcel with frontage on two streets: 211.35 feet along Holden Avenue and 159.53 feet along Dick's Point Road. The property is improved with a 1-1/2 story frame dwelling and the "as built" 14.6' x 11.6' accessory building. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will produce an undesirable change in character of neighborhood or a detriment to nearby properties. The as built shed was tastefully built to match the existing house and will not be out of character in the neighborhood, since it partly in a permitted yard area. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. Due to the challenging topical terrain of this lot, the location is reasonable and meets or exceeds the setback requirements under the bulk schedule. 3. The requested location is justifiably due to the topical layout of the lot, with two front yards and a limited rear yard area. Ie 10 17�� Page 2—April 18, 2002 Appl. No. 5085—J. and C. Kistner 110.-2-9 at Cutchogue 4. There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. This shed blends in with the house and is not unusual in its design, sign, or location. 5. Grant of the minor area variance is the minimum action necessary and adequate to enable applicant to enjoy the benefit of an accessory storage building, while preserving and protecting the character of the neighborhood and the health, safety, and welfare of the community. RESOLUTION/ACTION: On motion by Member Orlando, seconded by Member Horning, it was RESOLVED, to GRANT the variance, as applied for. This action does not authorize or condone any current or future use, setback or other 1 features of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The Chairman opened the hearing at 7:33 P.M. by reading the application for a' variance, legal notice of hearing and affidavits attesting to its publication in the local and official newspapers, Notice of •D:isappt.oval from the Building Inspector, and letter from the Town. C.letk that notification to adjoining property owners was made; fee paid- $15. 00. CIs there anyone here who wishes to add anything to this application? Is `there anyone against it? Is there anyone who wishes to be heard? (There was no response. ) Well, we went down, and inspected it and it is very true what Mr. Schultheis said in his application. If he went back 50 feet, he would be dropping down maybe 20 feet from where the house would be. It drops right down. And we checked some of the other houses around, especially along Holden Avenue, and most of them are set back about 35 feet • a Southold Town Board of Appeals -2- March 20, 1980 which has been there for quite some time, some of them. So, if there is no one else who has any further question, is there any discussion, Terry, Serge? MR. TUTHILL: I agree he has a hardship and I move that it be approved. After investigation and inspection, the Board finds that the applicant is requesting permission to construct dwelling with an insufficient frontyard setback to 35 feet due to the natural hilly topography- of the land. The Board finds that the properties in the neighborhood are similar to the proposed and most of the dwellings are also set back about 35 feet, and that such relief would not alter the character of the locality nor decrease residential values in the area. The Board finds that the circumstances present in this case are unique, and that strict application of the ordinance would produce - practical difficulties or unnecessary hardship. The Board believes that the granting of a variance in this case will not change the character of the neighborhood and will observe the spirit of the ordinance. On motion by Mr. Tuthill, seconded by Mr. Doyen, it was RESOLVED, that GERARD H.
