DIMAGGIO 1000-75-4-22.10 STREET & LOCATION: 1450 South Harbor Road, Southold DATE OF PUBLIC HEARING. January 10, 2002 FINDINGS OF FACT PROPERTY FACTS: The subject property is a parcel of 48,997 sq. ft. in Southold, with frontage of 269 feet on South Harbor Road (west) and depth of 165 feet (north) and 177 feet (south). It is improved with a frame house, detached garage and in-ground pool. BASIS OF APPEAL: Building Department Notice of Disapproval, dated October 15, 2001, denying a permit for an addition to the house because it will be 20 feet from the easterly lot line, which is treated as the rear line under the Zoning Code. Code section 100-244 requires a 60-foot rear yard, and a Planning Board approval of this lot as part of a 3-lot subdivision requires a 50-foot rear yard. AREA VARIANCE RELIEF REQUESTED: Applicant requests a variance authorizing construction of the house addition as proposed, with a 20-foot setback at the closest point to the easterly lot line and 27 feet at the furthest point. REASONS FOR BOARD ACTION, DESCRIBED BELOW: On the basis of testimony presented, materials submitted and personal inspection, the Board makes the following findings: 1. The subject property is the westernmost of three created as a subdivision. Access to this parcel is from South Harbor Road (west), and under the Code the westerly yard is the front yard and the easterly yard is the rear yard. However, the house is oriented to face the open farmland to the south, making the easterly yard functionally a side yard. The characteristics of this property were previously recognized by this Board in its grant of a variance authorizing the garage in the northerly yard (Appeal No. 4564). 2. There appears to be no way to expand the house, other than that proposed, which requires a variance. 3. The two other lots in the subdivision are reached from Grange Road to the north, and their east and west yards (when developed) will be side yards under the terms of the Code. Applicant in effect argues that his easterly yard should also be treated as a side yard, rather than rear yard. A 20-foot side yard is permitted on this property under Code section 100-244. Although the requested variance is substantial — a 20-foot setback where 60 feet are required — the orientation of the existing house and of future houses on the other two lots supports the argument that the setback in question be treated as a side yard,setback. 4. For the reasons set forth above, grant of the requested variance will not produce an undesirable change in the character of the:neighborhood or detriment to nearby properties. . q Pat 2 -January 10, 2002 ` ZBA'Appl. I have attempted to visit Ms. Scopaz on three occassions and she has either been on vacation or not in her office during business hours.As of 1/9/02, the ZBA office had no further input from the Planning Board or from Ms. Scopaz,as I was informed by staff in the ZBA office. The variance sought is to amend the required rear yard from 50 feet to 20 feet. In reviewing the Planning Board subdivision file for this cluster minor subdivision, I searched for specific reasons for the Planning Board's imposition of alternative setback requirements on the lots in this subdivision. The setbacks that were imposed by the Planning Board are equivalent to the setbacks normally required in the R-40 zone. The subject lot (of this application before the ZBA) fronts on South Harbor Road. The other two lots in this subdivision front on grange Road. Therefore, the rear yard of this lot is adjacent to the side yard of 'le adjacent lot to the east. Given that there don't seem to be any specific environmental constraints on this lot prohibiting construction within 20 feet of the rear property line, this appears to be a matter that where the Zoning Board of Appeals must determine the potential impact of such a variance on the neighborhood (specifically the adjacent lot to the east). I hope this information is of help to the Zoning Board members in their deliberations. This lot contains a total area of 48,997 sq. ft. with 286.68 ft. frontage along South Harbor Road. The survey map dated February 12, 1998 shows that the subject premises is improved with two concrete foundations. BASIS OF APPEAL: Building Inspector's February 10, 1998 Action of Disapproval which reads as follows: "proposed accessory garage .. .in an R-80 District is required to be in the rear yard pursuant to Article III, Section 100-33." AREA VARIANCE RELIEF REQUESTED BY APPLICANT: The request made by applicant is to locate a 20' by 24' accessory garage building separate from the proposed dwelling location a minimum of 74-i-- feet from the northerly property line, and a minimum of 66.9+- feet from the property line along South Harbor Road. The building envelope designated on the Cluster Map shows the area recommended by the Planning Board to allow flexibility (adjustments) in locating a principal building. REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1) The granting of the area variance will not produce an undesirable change in character of neighborhood or a detriment to nearby properties because the requested side yard location is consistent with the goals of a conservation plan between the applicant and the Peconic Land Trust to preserve the open _ farm vistas, not only for this three-lot cluster subdivision, but for the enjoyment of neighboring properties as well. (2) The benefit sought by the applicant' cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. (4) The proposed variance will not have an adverse effect or impact on the:physical or environmental conditions in the neighborhood or'district because it will be in keeping with the location of the original farm house and structures on this property and will provide open vistas that will enhance and preserve the neighborhood. (5)' The situation has been self-created and is due to the applicant's desire to reduce the potential density on the parcel and maximize vistas through layout and design. In considering this application, the Board finds that the relief requested is the minimum necessary and adequate and at the same time will' preserve and protect the character of the neighborhood, and the health, safety, and welfare of the community.
