FINDINGS OF FACT PROPERTY FACTS: Applicant's property is on the west side of Great Pond Way in Southold, with 200 ft. of road,frontage, and an average depth of 192 feet. APPLICANT'S REQUEST: Applicant requests a Special Exception under Code Section 100-31(b)(14) [ref. 100-30A.2(B)(1) to operate a bed-and-breakfast accessory use in her home. Floor plans submitted with the application show two B &B guest bedrooms, and the application proposes a maximum of four guests. REASONS FOR BOARD ACTION, DESCRIBED BELOW: (1)'After hearing testimony, reviewing submitted materials and making personal inspection of the property, the Board has considered the General Standards set forth in Code Section 100-263, and finds and determines the following: (A) The proposed bed-and-breakfast accessory use will not prevent the orderly and reasonable use of adjacent properties, or of properties in adjacent use districts, or of permitted or legally established uses in its zoning district or adjacent use districts. (B) The safety, health, welfare, comfort, convenience and order of the Town will not be adversely affected by the proposed use and its location. (C) The proposed use will be in harmony with, and promote the general purposes and intent of, the Zoning Code and will be compatible with its surroundings and with the character of the neighborhood and of the community in general. (D) The structure will be readily accessible for fire and police protection. (2) No adverse findings result from a review of the matters to be considered under Code section 100-264 -j a Page 2—April 18, 2002 V:o Appl No. 5075—D Danek(B&B) , Q` 59-9-10.3 at Southold RESOLUTION/ACTION: On motion by Member Oliva, seconded by Chairman Goehringer, it was RESOLVED, to GRANT the application for a Special Exception for an accessory bed-and-breakfast use, subject to the following CONDITIONS. (1) Owner-applicant shall obtain a bed-and-breakfast permit from the Building Department as required by Code section 100-31(B)(14). ( "Alliance" ) of such offer stating the. name and address of the party by whom or to whom the offer was made , the price named in the offer , and other terms and • conditions of such offer , and the Alliance may at any time within 60 days after receipt of such notice elect to repurchase the property herein conveyed upon the terms stated in such notice or upon the payment to the landowner of the market value of the premises as determined by a licensed real estate appraiser mutually agreed upon by the landowner and the Alliance. If one appraiser is agreed upon the cost of such appraisal shall be borne by the Alliance . - b . The Notice will be published in the next issue of the Suffolk Times. Pursuant to Chapter 58 of the Southold Town Code (copy enclosed), formal notice of your application and hearing must be now mailed with a map or sketch showing the construction area or variance being considered. Send the enclosed Notice CERTIFIED MAIL, RETURN RECEIPT REQUESTED, with the above sketch or survey showing the new construction area, or details of your request, by Wedneday, April 10th, to all owners of land (vacant or improved) surrounding yours, including land across any street or right-of-way that borders your property. Use the current addresses shown on the assessment rolls maintained by the Town Assessors' Office (765-1937) or the County Real Property Office in Riverhead. If you know of another address for a neighbor, you may want to send the notice to that address as well. When picking up the sign, a $15 check will be requested for each metal stand as a deposit (if needed). There is no cost for a poster without a stand. Please post the Town's official poster/sign no later than April 1lth. Securely place the sign on your property facing the street, no more than 10 feet from the front property line bordering the street. (If you border more than one street or roadway, an extra sign is available for the additional front yard.) The sign(s) must remain in place for at least seven (7) days, and should remain posted through the day of the hearing. If you need a replacement sign, please contact us. By April 16th, please either fax or deliver to our office your Affidavit of Mailing (form enclosed) with parcel numbers noted for each, and return it with the white receipts postmarked by the Post Office.
