No. 5121 —CUSTOM DESIGNER HOMES, INC. Property Location: 35.-5-5.1; Street Address: 4700 Main Road,Greenport BASIS OF APPLICATION: Building Department's March 4, 2002, Notice of Disapproval for the reason that applicant's foundation for the new dwelling, under construction at this time, does not meet the 50 ft. setback from the front property line facing a private right-of-way. AREA VARIANCE REQUESTED: Applicant was disapproved in an amendment to a building permit application, amending Building Permit#27873-Z issued November 7, 2001, for a new dwelling location. Applicant is requesting a permit amendment to allow the "as built" foundation's front yard setback, at 41.8 feet at its closest point from the southerly edge of the line of the right-of-way, or front line, or an Interpretation that the existence of the 25 ft. right-of-way does not create a front yard area for the purposes of zoning. FINDINGS OF FACT The Zoning Board of Appeals held a public hearing on this application on April 18, 2002, at which time written and oral evidence was presented. Based upon all testimony, documentation, personal inspection of the property and the area, and other evidence, the Zoning Board finds the following facts to be true and relevant. PROPERTY DESCRIPTION: The applicant's property is a 41,049 sq. ft. lot with frontage of 165 feet along the Main Road and of 375.31 feet along a 25' right-of-way, or south property line, in Greenport. The property is improved with a new foundation located at 63.4 feet from the east property line at its closest point and 95.5 feet from the west property line, 66.8 feet from the southerly property line. (See foundation survey dated 2-5-02 prepared by Kenneth M.Woychuk, L.S.) REASONS FOR BOARD ACTION: IN ACCORDANCE WITH THE REVIEW STANDARDS SET FORTH IN TOWN LAW 267B-3 "AREA VARIANCES," THE BOARD HAS CONSIDERED THE BENEFIT TO THE APPLICANT IF THE VARIANCE IS GRANTED, AS WEIGHED AGAINST THE DETRIMENT TO THE HEALTH, SAFETY AND WELFARE OF THE NEIGHBORHOOD AND COMMUNITY BY SUCH GRANT,AND DETERMINES THAT: 1. Grant of the area variance will not produce an undesirable change in the character of the neighborhood or detriment to nearby properties. The location of the dwelling contains more than the minimum front yard setbacks along the three remaining lot lines: to the north, 85+- feet from the Main Road, to the east 63+- feet from the private road named Maple Lane; to the west 95.5 feet. These setbacks exceed the code requirements of 50 feet for the front yard and 60 feet for the rear yard. The Building Department also describes the private right-of-way owned by the applicant that traverses the length of the southern lot line as a road or street requiring another front yard setback. This type of situation, with a definition of three front yard areas, is a unique situation, and a characteristic which defines relatively few properties. The benefit sought by the applicant cannot be achieved by some method,feasible for the applicant to pursue, other than an area variance. The applicant was granted a building permit, constructed a foundation, and completed other major aspects of construction prior to a stop work order. It would create a severe hardship for the applicant to relocate the building on the basis of gaining approximately eight (8) feet or more clearance from the afore-mentioned private right-of-way. 3. The variance granted herein is not substantial. The setback cited in the Notice of Disapproval is 66.8 feet from the property line at its closest point. The distance to the inward edge of the applicant-owned private right-of-way will be +-41 feet, representing a setback reduction of approximately 16% from code requirement for a front yard setback if this area were to be used as a road or street. 4. The variance granted will not have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. There is no evidence to indicate that the granting of the relief would create any kind of adverse physical or environmental conditions for the property, neighborhood, or the district. 5. Grant of the requested variance is the minimum action necessary and adequate to enable applicant to enjoy the benefit of continuing with construction of a new dwelling in accordance with a building permit, while preserving and protecting the character of the neighborhood and the health,safety, and welfare of the community. BOARD RESOLUTION ACTION OF THE BOARD: In considering all of the above factors, and applying the balancing test under New York Town Law, motion was offered by Member Oliva, seconded by Chairman Goehringer, and duly carried,to APPROVE the variance as applied for. This action does not authorize or condone any current or future use, setback or other feature of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Note for the Record: With regard to applicant's request for an Interpretation,the Board was not able to garner the votes required for a formal interpretation. Cron Maple Lane , near Greenport NY Dear Mr. Raynor: The purpose of this letter is to indicate to the Board my com- plete disagreement with the ruling of the Suffolk County Planning Commission as indicated in the letter of Charles G. Lind, Chief Planner, dated December 3 , 1982 , in which it is indicated the Suffolk County Planning Commission disapproved the above minor subdivision map for the reason that a right of way running from Maple Lane to provide access to rear lots was considered to be poor planning due to the fact that a conflict might arise between the owners of said lots. Needless to say, I am utterly amazed at such reasoning in that on numerous occasions the Suffolk County Planning Commission has recommended common driveways between adjacent lot owners. In those instances, at no time did the Suffolk County Planning Commission indicate that a conflict might arise between such owners. The Southold Town Planning Board has reviewed this minor sub- division on numerous occasions and has seen fit to approve same as so indicated on the minor subdivision map. A review of all factors in- volved in this minor subdivision will, to the contrary, indicate that the layout of the right of way constitutes sound planning with respect to this specific minor subdivision. In this regard, the right of way comes -directly off Maple Lane (a private road) in lieu of providing access ,from -the main highway to Lot #1. Secondly, all ofthelots on the proposed minor subdivision are furnished with public water from the Greenport Village Water District. Thirdly, the proposed right, of way is not a public road but merely to provide ingress and egress for A Mr. Henry E . Raynor, Jr. , Chairman -2- December 28 , 1982 Lots 1 and 4 . Finally, any possible conflict between lot owners relative to any right of way, remote or otherwise, is of no justifi- able concern to the Suffolk County Planning Commission. For all of the reasons above indicated, I would respectfully request that the Southold Town Planning Board override the recommenda- tion of the Suffolk County Planning Commission to disapprove the subject minor subdivision map.
