The property is .375 of an acre (16,327 sq. ft.) and improved with a single-family dwelling, all as shown on the map prepared by Stanley J. Isaksen, Jr. surveyed February 18, 1995. BASIS OF APPLICATION: Building Inspector's November 27, 2001 Notice of Disapproval citing Article XXIV Section 100-244B, which requires a minimum front yard setback of 35 feet. The proposed second-story addition and covered porch addition are extending towards Fleetwood Road, with a proposed setback of 19'6" from the front property line facing Fleetwood Road. (No protrusion is proposed within the 35-ft. limited front yard area facing East Road.) , AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance for additions as specifically shown on plans prepared by Thomas Heine, Archit ect dated 11/24/01, for setbacks at 19'6" from the front line facing Fleetwood Road and greater than 35 feet from the front line facing East Road. Additional information was offered at the public hearing describing details of the plan, which may be referenced from ZBA tape recordings and/or written transcript of statements offered by Mr. and Mrs. Curtin on February 21, 2002, if needed for reference. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection,the Board makes the following findings: 1. Grant of the area variance will produce an undesirable change in character of neighborhood or a detriment to nearby properties. The proposed addition would extend towards Fleetwood Road leaving a setback of approximately 19 feet 6 inches towards Fleetwood Road. 2. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance, because the applicant wishes to expand do to a growing family tided and no other location provide a reasonable opportunity for this benefit. 3. The requested area variance is substantial and represents a 10 foot reduction in the code requiring 35 feet minimum side yard setback. Page 2—Appl. There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district. In considering this application, the Board deems this action to be the minimum necessary and adequate to preserve and protect the character of the neighborhood, and the health, safety, welfare of the community. RESOLUTION/ACTION: On motion by Member Orlando, seconded by Chairman Goehringer, it was RESOLVED, to deny the applicants request for a setback from Fleetwood Road at 19 feet 6 inches for the proposed additions; and BE IT FURTHER RESOLVED, to GRANT Alterative Relief for similar additions at not closer than 24.5 feet(24'6") from the front line facing Fleetwood Road, This action does not authorize or condone any current or future use, setback or other features of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. The existing location of the house is not parallel to either street line therefore an addition off of either end is severely limited by the setback. The location and width of the addition is dictated by the need for a functional garage depth below the addition adjacent to the existing Fleetwood Road driveway access. Any addition to the rear is restricted by the required demolition of a perfectly adequate existing deck, and would reduce the usable rear yard area. 3. The total area of intrusion is just 244 square feet of which 33 square feet already exist. The area of intrusion is triangular in shape with it's greatest point being 15.5' into the setback and then angling away from there. The total lot coverage when completed will be 13% well below the 20% allowed. The total height of the structure will be just 21' also well below the 35' height allowed. If the home were not restricted by the two front yards it would easily fit within a required side yard setback of 15'. 4. The variance is within the footprint of the existing garage and a cleared lawn area. The size is such that it will not block the air and light on the neighboring properties.
