Feb. 21,2002 FINDINGS OF FACT PROPERTY FACTS/DESCRIPTION: The applicant's property is located on the south east of Westland Rd. The property is approx. 118th of an acre improved with a single- family dwelling, identified as District-1000 Section-59 Block-2 Lot-20, all as shown on the map prepared by Anthony W. Lewandowski, L.S surveyed dated November 7, 1994. BASIS OF APPLICATION: Building Inspector's October 25, 2001 Notice of Disapproval citing Article XXIV, Section 100-242A which states, Reconstruction or enlargement of a non-conforming building shall not increase the non-conformance or degree. Article XXIV Section 100-244 requires single side-yard setback of 10 feet, a total of 25 feet for combined sides, and a front yard setback of 35 feet. AREA VARIANCE RELIEF REQUESTED: Applicant requests a Variance for a single side yard setback of nine (9) feet, a combined side yard setback of 23 feet total, and a front yard setback of approximately 26.5 feet for a proposed second-floor addition over the existing dwelling, and a covered front porch. Please see plans prepared by Gary, D. Cannella, Architect dated 6.27.01 revised 9/17/01, Project No. 00.208 for specific construction details. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will produce an undesirable change in character of neighborhood or a detriment to nearby properties. The front porch addition will extend to the preexisting frontage of the house @ 26.5 feet and the non-conforming total of both side yard setbacks will remain the same after construction is finished, at nine (9) feet on the Northeast side and 14 feet on the Northwest side. The benefit sought by the applicant cannot be achieved by some method, feasible for applicant to pursue, other than an area variance. This is an unusually small lot and applicant's request is not unreasonable. 3. The requested area variance is not substantial. 4. There is no evidence that the grant of the variance will have an adverse effect or impact on the physical or environmental conditions in the neighborhood or district, and the addition is similar to those existing in the area. RESOLUTION/ACTION: On motion by Member Orlando, seconded by Member Oliva, it was RESOLVED, to GRANT the variance as applied for. This action does not authorize or condone any current or future use, setback or other features of the subject property that violates the Zoning Code, other than such uses, setbacks and other features as are expressly addressed in this action. Should you require any additional information, please contact our office directly. The scope of our project is basically a second floor addition on an existing one-story, single-family residence. The lot is non-conforming. We are also adding a covered front porch. As you will see, the construction drawings are complete, as would not typically be required for a variance application. It appears we were caught in a recent policy revision for reviewing such applications to add"straight-up" on existing non-conforming properties. We have committed a great deal of resources to the project that would have otherwise been held, pending a Zoning Board decision. REASONS FOR BOARD ACTION, DESCRIBED BELOW: Based on the testimony and record before the Board and personal inspection, the Board makes the following findings: 1. Grant of the area variance will produce an undesirable change in character of neighborhood or a detriment to nearby properties The front porch addition will extend to the preexisting frontage of the house @ 26.5 feet and the non-conforming total of both side yard setbacks will remain the same after construction is finished, at nine (9) feet on the Northeast side and 14 feet on the Northwest side.
